The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, May 9, 1951 at 1:00 o'clock F. M. Fresent were Mayor Lowe, Commissioner
Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelance and the Clerk when the follow-
ing proceedings were had:
Minutes of the regular session of May 2, 1951 were read and it was moved by Commissioner Healy,
seconded by Commissioner Secor, that the minutes be approved as read, and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner
Healy; those voting No, none.
Buddy Foppy Day Set
A request from the local VFW Fost No. 903 to have the dates of May 18 & 19, 1951 as the days for
the sale of "Buddy Popfies" was presented and read. It was moved by Commissioner Healy, seconded by
Commissioner Secor, that the request be arproved and the motion was oarried by the following Aye and
No vote: those voting Aye being Mayor Lowe, Commissioner Seoor and Commissioner Healy; those voting
No, none.
Appointments
Recreation & Library Boards
Mayor Lowe announced the following appointments to City Boards:
Recreation Board: John Parker 3-year term expiring January 1, 1954
John Breeden 3-year term expiring January 1, 1954
Library Board: Mrs. M. G. Burlingame 2-year term expiring January 1, 1953
John D. Shively 2-year term expiring January 1, 1953
It Was moved by Commissioner Secor, seconded by Commissioner Healy, that the appointments be
approved and the motion wes carried by the following Aye and No vote: those voting Aye being Mayor
Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
Blue Shield-Blue Cross for City Employees
A proposal of the Blue Shield-Blue Cross for their Comprehensive Agreement to cover city employees
who wish to take advantage of their plan by payroll deductions was read. The proposal w as acceptable
subject to the condition that the city will not be responsible in any way except for the monthly deduc-
tion and remittance upon written authorization by the employee.
Tax Le~j for Cemetery to be Considered
The Manager stated the Cemetery Board, at its meeting of May 4, 1951. recommended levying of a
tax by the city and county for cemetery purposes. Arrangements have been made with the Cemetery Board
and the County Commissioners to meet with the City Commission at their regular meeting on May 16th to
discuss this matter further.
Request of Montana Power to Cut Pavement
A request of the Montana Power Company to cut the pavement for a gas line extension on East Lamme
Street, between Perkins Place and Church Avenue, was read. This is a street which was newly paved last
year. It was pointed out that all pavement cuts need maintenance for a considerable time after being
made. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the request be granted
subject to the M9ntana Power Company replacing the pavement to its original condition, under the City's
supervision and guaranteeing that it will be kept in its original condition for not less than three
years, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe.
Commissioner Secor and Commissioner Healy; those voting No, none.

Resolution No. 709 -- Vacating Street & All~s for Baseball Park
A proposed plat of ground east of Cypress Street, owned by Dr. R. A. Williams, WaS presented.
This is ground on which Dr. Williams has built a baseball field and on which he proposes to have a
number of residential sites. Since the plat necessitates rearrangement of streets in tile area, it
will be necessary that existing flatted and unused streets be vacated before the new ~lat is approved.
The City Commission having given tentative approval to the proposed plat, Resolution No. 709, stating
it to be the intention of the City Commission to vacate these certain streets and alleys as petitioned
for by Dr. Williams on August 24, 1949, was presented, entitled:

It was moved by Conunissioner Healy. seconded by Conunissioner Secor, that the' Resolution be passed
and adopted, and May 23, 1951 be set as the date for the hearing of protests, and the motion was carried
by the followingqe and No vote: those voting Aye being Mayor Lowe, Conunissioner Secor and Conunissioner
Healy; those voting No, none.
Building Permit for College Shops
A written request from Mr. H. C. Cheever, of the Montana State College, asking the building permit
issued in July, 1949 for the construction of the College Shops on South Sixth Avenue in Block 51,
Capitol Hill Addition, continue in force, was read. !he communioation stated the following changes
would be made in the original plans:
1. The briok fence will be replaced witil a wooden fence.
2. The sheds proposed behind the fence will be omitted.
3. The wooden fence will set back two feet from the sidewalk.
It was moved by Commissioner Secor, seconded by Commissioner Healy, that the building permit
issued to the Montana State College for the construction of the shops continue in force with the changes
as set forth in the letter, and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
Claim -- Marshall-Wells Company
Claim No. 1137 on the Water Fund in the amount of $230.75 to Marshall-Wells Company WaS presented.
The claim is subject to a 2% cash disoount, whereupon. it was moved by Commissioner Hemy, seconded by
Commissioner Secor, that the claim be ~pproved and a warrant drawn for its payment, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and
Commissioner Hea1l.y; those voting No, none.
Hearing -- Vacation of Alley Block 5; Werre's Rearrangement
The Manager stated this was the time and place set for hearing protests to the vacation of the
alley in Block 5 of Werre's Rearrangement to the West Side Addition. He presented the affidavit of
publication of the Notice, and the Acknowledgement of Service that all property owners have been noti-
fied. The Manager stated that no protests have been filed and no one is present to protest. It was
moved by Commissioner Secor, seconded by Commissioner Healy, that the City Attorney be instructed to
prepare an ordinance vacating said alley, and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; tilose voting No, none.

Appointment of Recreation Director -- A. Glenn White
City Manager Henderson announced the aFPointment of A. Glenn Villi te as City Recreation Director, to
take over the duties of said position June I, 1951.
Contract -- Trunk Sewer -- Preliminary Survey
A contract between The City of Bozeman and the Morrison-Maierle, Inc. for preliminary survey for a
trunk line sanitary sewer to serve the west part of the city was presented. The contract was approved
as to form by the City Attorney. It was moved by Commissioner Healy, seconded by Comnissioner Secor,
that the Mayor end the Clerk be authorized to sign the contract for the City of Bozeman, and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and
Commissioner Healy; those voting No, none.
W & C 1951 -- Protest by Hauseman
A communication from Mrs. Marlyn Hausemen, 822 South Willson, was read, protesting the order to
construct a sidewalk on the Harrison Street side of her property. It was pointed out in the discussion
that this protest could not be sustained without the awne action on other protests, whereupon, it was
moved by Commissioner Healy, seconded by Commissioner Secor, that the protest be denied and the order to
construct this sidewalk stand, and the motion was carried by the following Aye and No vote: those vot-
ing Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Secor, seconded by Commissioner Healy, that the meeting adjourn and the motion was
carried by the follow:ing Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and
Commissioner Healy; those voting No, none.
