HomeMy WebLinkAbout1951-05-23 17 Bozeman, Montana May 23, 1951 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, May 23, 1951 at 1:00 o'clock F. M. Present were Mayor Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace end the Clerk when the follow- ing proceedings were had: I Minutes of the regular session of May 16, 1951 were read and it was moved by Gommissioner Healy, seconded by Commissioner Secor, that the minutes be a~proved as read, and the motion was carried by the following Aye and No vote: those voting .lye being Mayor Lowe, Commissioner Secor and COllunissioner Healy; those voting No, none. Request by Montana Flour Mills to Vacate Oak Street The Montana Flour Mills Company is considering construction of a new warehouse and other improve- ments at their mill at No. Rouse Avenue and the city Umi ts. Their plans would necessitate closing tha t part of Oak Street whi ch crosses their property and, in lieu thereof, they propose to re-open Birch Street, along the south side of their property, and Montana Avenue, along the west s ide of their property, to connect with Oak Street at the southeast corner of the property of the Bozeman Canning Co. The Commission took no action in the matter pending the presentation of a petition by Montana Flour Mills Co. which petition should be signed or approved by the owners of all proFerties which would be affected by the proposed change. Requests of Band for Season of 1951 George Sime, Bud Henke, and Edmund Sedivy, representing the Bozeman Municipal Band, were present and made the following requests for the municipal band for the coming; season of 1951: I 1. Increasing the band membership from 33 to 40. 2. The purchase of the following items and the approximate cost: Mu sic Supplies for cataloging music F'ive unifonns Baritone horn $100.00 35.00 560.00 300.00 They stated the above requests together with the concerts for the Season would cost ap~roximate1y ~2,900.00. After consideration, it was moved by Commissioner Secor, seconded by Commissioner Healy, that the agreement with the Bozeman Municipal Band be amended so as to increase the normal size of the band to 40 members, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. The City Commission also expressed approval of the other requests made by the Bozeman Municipal B~nd. Report The rerort of the Director of Finance for the month of April, 1951 was fresented. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the rerort be aocepted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner I SeCor and Commissioner Healy; those voting No, none. Hearing - Vacat ion of Stree'bl and Alleys for Baseball Fark The Manager stated this was the time and p,lace set for the public hearinj;; of protests to the vaca- tion of the streets and alleys as requested by Dr. R. A. Williams in order to construct a baseball field. He presented the affidavit of publication of the Notice, and the acknowledgement of service of the notice to all property owners affected. There was no one present to protest, and no protests having been filed, it was moved by Commissioner Secor, seconded by Commissioner Healy, that the City Attorney be instructed to prepa,re an ordinance vacating the streets and alleys, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. 18 Ordinance No. 760. Vacating Alleys and Streets for Baseball Park The Meneger stated that the City Attorney, as instructed, has prepared the ordinance vacating the streets and alleys for the baseball park being constructed by Dr. R. A. Williams. He presented Ordinance No. 760. entitled: AN ORDINANCE OF THE CITY OF BOZEM.AN. MONTANA. VACATING n; SAID CITY THE FOLLOWING DESCRIBED PORTIONS OF STREETS AND THE FOLLOWING DESCRIBED ALLEYS: SOUTH McDOW AVENUE FROM THE SOUTH LINE OF' BABCOCK STREET TO THE NORTH LINE OF CURTISS STREET; SOUTH AYLESWORTH AVENUE FROM THE SOUTH LINE OF BABCOCK STREET '1'0 THE NORTH LINE OF CURTISS STREET; EAST OLIVE STREET FooM mE EAST LINE OF CYPRESS AVENUE TO THE WEST LINE OF SWITZLER STREET; THE WEST ONE-HALF' OF' SOuTH SWITZLER STREET FROM TIlE SOUTH LINE OF' BABCOCK STREET TO THE NORTH LINE OF CURTISS STRF..'ET; THE SOUTH ONE-HALF OF EAST BABCOCK STREET AS IT EXTmDS FROM .AN EXTm:JSION TO THE EAST LINE OF' BLOCK NINETEEN (19) OF' NORTHERN PACIFIC ADDITION TO BOZEMAN, MONTANA. I It was moved by Commissioner Secor, seconded by Commissioner Healy, that the ordinance be passed ~ld adopted anc the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Bond -- D. L. Henry. Cashier The bond of Lonald L. Henry, as City Cashier. in the amount of $2.000.00 was presented. The bond was approved as to form by the City Attorney, whereupon it was moved by Commissioner Healy, seconded by Commissioner Secor, that the bond be accer-ted end approved, end the motion was carried by the following Aye and No vote: those voting ~ye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No. none. Parking at Gas Station - Main & Church The parking situation on Main Street at Church Avenue. in front of the property owned by O. E. station and that there then be one stall marked for parallel parking on the west of his driveway and I Keys, described as Lots 1 & 2, Block E. Rouse's Addition, and used as a service station. was con- sidered. Mr. Keys has proposed that he will install some new curb along the front of' his service one similarly marked on the east of the driveway into the Main Motor Co. which adjoins his service station driveway. The Commission was of the opinion that it would be impractical to mark these two stalls for parallel parking on Main Street when all other parking; on that street is angle parking.
