But to bog down in legislating where they should and should not be allowed will not achieve the underlying issue of too many STRs being created. The issue is to bring reasonable regulation by creating a permit where every STR registers and is in compliance. That is what is lacking. In addition, then add a cap so that STRs do not become overly-saturated. As you know: *The public clearly supports STRs as shown by the public input gathered by the city last winter. *A limited number of STRs that are not the dominant housing bring value to a neighborhood. Renters use the houses for MSU graduation, local weddings, visiting relatives in town, attending Sweet Pea, etc..... *STRs are not the reason Bozeman has a lack of affordable owner/rental housing. That is a larger market/private/public finance issue. *The Zoning Commission unanimously rejected the proposal. *Banning current State-compliant STRs (paying bed tax and getting health/safety permits) is unfair and creates legal exposure for the city given that owners have been advised for 20 years NOT to get a Conditional Use Permit. *Type 3 STRs should be allowed in R2 zoning districts, and Type 2 STRs should be allowed in R1. Please consider a policy that addresses the underlying issue.
