M. Present were Mayor Lowe, GOlrunissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace, and the Clerk, when the following; proceedings were had: Minutes of the last reEular session were read, and it was moved by Conunissioner Healy, seconded by Corrunissioner Secor, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Corr~issioner Healy; those voting No, none. Fenalty & Bonus Clause for Sewer Contract Tho question as to wLether or not there should be a penal ty and bonus clause in the contract for the construction of the west trunk sewer was discussed. It was pointed out that a penalty clause is not enforceable without a bonus clause and a bonus clause is not advantageous unless an early cOLlJ}letion date is desi rable such as in a case of an emergency, and penalty and bonus clauses are not used by the federal government. After further consideration, the City Manager was instructed to have Morrison-Maierle, Inc. draw the contract without a fenalty or bonus clause, but the contract should state to have the job cOlll}leted within a certain number of working days. Right-of-Way Easements for West Trunk Sewer Ihe Manager rerorted he has contacted all I.roperty owners relative to a right-of-way easement for the construction of the west trunk sewer, and it aPI.~ears that a satisfactory agreement can be made with each. Bids for Misc. W & C 1951 'The Manager stated this was the time and place set for the opening; of bids for the construction of i>iisc. Iff 6:: C 1951. He presented the affidavit of publication of 'the Notice to Bidders, whereufon, it was moved by Commiss ioner Healy, seconded by CommissioTler Secor, that the bids be oI-,oned and read, and the motion we,s carried by the following Aye and No vote: those voting Aye being; Mayor Lowe, COlrnnissioner Secor and Commissioner He~y; those voting No, none. l'he following bids were opened and read: Iowell Construction U~m. Leave of Absence for John McCrosson A written request 01' John McCrosson was read, askinG the City Com.'1lission to grarct an extended leave of absence to him due to his illness. He asked that tLe leave become effective from June 14, 1961 until such time 8S he is able to return to his regular duties as Fire Chief. It was moved by Corrunissioner Healy, seconded by Conunissioner Secor, that }'ire Chief J. W. McCrosson be t::;ranted an extended leave 01" absenc~, without pay, to be effecti.ve from and after June 14, 1951 and the motion wes carried b;y the following Aye and No vot(.~ those voting Aye beint:; Mayor Lowe, Comnissioner Secor and Commissioner Healy; those voting, No, none. Conunissioner Secor and Commis~ioner Healy; those voting NOI none. Agreement -- I. O. O. F. Section of Cemetery An a,greement between the City of' Bozeman end Westen Star Lodge No.4. I. O. O. F. was :presented and read. The agreement provides for the City of Bozeman to take over the sale of the cemetery lots in the I. O. O. F. Section of the Sunset Hills Cemetery, similar to the agreement the City has witt the Masonic Lodge. The City will keep the records and pey $15.00 fer lot to the 1. O. O. L Lodge for each lot sold. The 1. O. O. F. Lodge agrees to make an annual pDyment of $75.00 fer year for the uI,keep of' said section. It was moved by Commissioner Secorl seconded by Commissioner Hea.1YI that the agreement be approved. and the Mayor and the Clerk of the City Conunission be authorized to sign the agreement for the Ci t"<J of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Corrwissioner Healy; those voting No, none. Application for Beer License -- R. K. Williams The 81'plication of Ral}=h K. Williams for an off'-l-rernises beer license at the corner of Durston Hoad and North Seventh Avenue was presented. It was stated th8t the Zonin[; Ordinance f.rol:ibi ts the sale of beer at this location, whereuponl it was moved by Commissioner Healy, seconded by Co:mnissioner Secor, that the aprlication be denied, the fee returned to Mr. Williamsl end the City Manager instructed to inform Mr. Williams why the aI'plication is denied, and the motion was carried by the followinl; Aye and No vote: those voting Aye being Mayor Lowel Commissioner Secor and Corrunissioner Healy; those voting Ke, none. llat of Marwyn Rearrangement Approved A pIa t of Marwyn Rearrangement of Blocks in the Northern l'ad fic Addi Hon was lresented and the Manager stated he has, as Director of Public Welfare, approved the l'lat. It was moved by Conunissioner HealYI seconded by Corrnnissioner Secor, that the action of the City Manager be apI-roved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Conunissioner Secor ~ and Conunissioner Healy,; those voting No, none. Purchase of New Cycle for Police Department . The Manager stated that a new Harley-Davidson, "Servi-Car" can be. purchased from Mrs. Birshir of Livin[;stonl Montana for $982.50, net, F. O. B., Milwaukee, Wisconsin. Accessories desired anei freight would be in addition to this quoted price. It is estimated that freight and added accessories will cost approximately $175.00. Request for Budget IteffiB A request from Galla tin County for an increase of $600.00 in the 1951-52 budget for the Ci ty-Count~l Health unit and a request by the Police Department for inclusion in the budeet of aNroximately $1,600.00 to cover expenses of the Police Captain's attendance at the F. B. I. School in Washington D. C. were Eiven consideration. The Manager was instructed to include these items in the budget for the coming fiscr,l year if funds are available.
