Wednesday afternoon, June 20, 1951 at 1:00 o'clock }. M. l-'resent were Mayor Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, J i ty Attorney Lovelace. and the Cle rk. when the following; proceedings were had: I Minutes oi' the last regular session were read. and it was moved by C01:lTllissi;:ll1er Healy, seconded by C omrnissioner Secor, that the minutes be aH,roved as read, and the motion wes carried by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Secor and Commissioner Healy; those voting No, none. Licensing of Auctioneers Emmett 'rypol t and B. 1,. Johnson, refresenting locel jewelers. arpeared before the Commission in regard to transient auctioneers selling lnerchandise, particularly jewelry, at auction. They stated many times there is a misunderstanding; regarding value of merchandise sold and inquired about city license covering; this type of business. They were informed of the requirements of the state law and ci ty ordinances regarding auctioneers. The Commission stated the city could not refuse to issue a license without grounds for so doing. It was decided to make inquiry as to ordinances in other citieS covering this type of work, and the City Attorney stated he would wri te to the City Attorney of Billin;;s where it is reForted auctioneers are now conducting such an auction business on jewelry. Audit for 1950-51 The matter of the annual audit for the year 1950-51 was discussed. It was moved by Commissioner Secor. seconded by Commissioner Healy, that Douglas Wilson. ferris Com~any of Great Falls. Montana be I employed to make the annual audit. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No. none. W & C 1951 Contract lbe contrect of Powell Construction for the construction of Misc. W & C 1951 was presented. The contract having been IJrepe.red by the City Attorney, it was moved by Commissioner Healy, seconded by Corrunissioner Secor, that it be ar:proved and the Mayor and the Cle rk of the City Commission be authorized to sign it for the City of Bozeman. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Secor and Commissioner Healy; those voting; No, none. Barricading of Sixth Avenue for Soap Box Derby It was reported the Soap Box Derby will be held on July 15th. and request has been made to barricade Sixth Avenue from Alderson Street to south of Cleveland Street for that event. After dis- cussion, it was moved by Commissioner Healy. seconded by Commissioner Secor. that the barricading of Sixth iivenue as requested be authorized as an emergency safety measure for the general welfare and protection of the citizens, and the motion Vias carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. City folice for Air Show I The matter of city I-,olicemen directing traffic for the Air Show to be held June 25th. at Gallatin l"ield Vias discussed. It was moved by Commissioner Secor. seconded by Commissioner Healy. that if the members of' the J)olice Department want to go to the Air Show. without eXI-ense to the City, to assist ill the control of traffic and the crowd, they be }'ermi tted to aPI-'enr in uniform. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Co~missioner Secor and COmIIlissioner llealyj those voting No. none. The City Commission expressed al-,r-:roval of the use of' the rolice car to stand by to be used strictly as an ambulance. 28 Sub-Lease of Armory An Extension A[;reement for the sub-leasin;;; of the Armory to the Montana National Guard was liresented. TIle agreement is the same as in former years. It was moved by Cormuissioner healy, seconded by Commissioner Secor, that the agreement be an roved and the Mayor and the Clerk of the Co;mnission be au thorized to sign the agreement for the City of Bozernen, and the motion was carried by the following; Aye and No vote; thuse voting Aye being Mayor Lowe, Co;lIDtissioner Secor and Commissioner Healy; those voting No, none. Fire Insurance for City Vehicles The Manager rerorted the fire insurance 1,01 icy on c1 ty motor vehicles expires July 1, 1~51. It was moved by Commissioner Secor, seconded by Commissioner Healy, that the City Manager be authorized to renew the fire insurance f.;olicy on the city vehicles at the sa.me valuation as last year, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Corrunissionor Secor and Com.:niss ioner Healy; those voting No, none. Examination of Derository Securities The City Connnission examined and checked the Custodian IS Receilts for securities to cover Ci ty of Bozeman funds on deposit in the various city banks. All lunds ueing amrly covered by securities, it was moved by Commissioner Healy, seconded by COITunissioner Secor, thBt the depository securities be aJ.proved. and included in full in the minutes, and the motion was carried by the following Aye and 10 vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting; No, none. Elevator Shaft -- Gallatin Cooperative Creamery On May 4, 1951, Virgil Muir, as agent for the Gallo.tin Coolerative Crealflery, made 8.f'plication for 8 r,ermit to replace a lroduce ramp at the creamery building of this com.r8.ny at 40 No. Grand Avenue with e.n elevator. 118.ns. shown wit!: this a-Iplication, showed that the elevator woule: raise from basement level to slightly above ground level end would be covered wi tb a celler type, metal cover'ed COOl'. Without permit from or consultation with the Building Insl_ector, a frame structure, anroxime,tely 7 ft. square and 14 ft. high has been rartially buH t over this elevator. Tbis buildinG is located in Fire Zone No. 1. The Commission recessed and looked this structure over on the g;round. After consideration of the fact that this structure is only rartiall~l buH t, that the eXTense of making; it of proper fire resistive rating; would not be prohibitive. end that l-ermitting it to be cOnllleted as a frRme structure would establish an. unsatisfactory rrecedent. it was moved by COITmis- sioner Secor, seconded by Commissioner Healy. that the owners be instructed to remove the rartially buH t frame structure and. if it is rebuilt, to make it conform to the buildin[. regulations and the motion was carried by the following Aye and No vote: ti.ose voting Aye being Mayor Lowe.
