The Cmmnission of the City of Bozeman met in regular session in the Conunission Room, City Hall
Building, Wednesday afternoon, June 27, 1951 at 1:00 0' clock }. M. lresent were Mayor Lowe.
Commissioner Secor. Corrunissioner Healy. City Manager Henderson. City Attorney Lovelace, and the
Clerk when the followin6 proceedings were had:
Minutes of the lest regular session were read, and it was moved by Commissioner Healy. seconded
by Commissioner C00or. that the mi11utes be aI>proved as rend. and the motion was carried by the

Fetition to Close Fortion of Oak Street
A l-etition from the Montana Flour Mills was read. requesting the vacating of Oak Street from
Rouse Avenue to Montane. Avenue. and statinG they would deed a strip of ground thirty feet wide for
the openint; of vacated Birch Street from Rouse AVenue to Montana Avenue. and a thirty-foot strip
for the opening of vacated Montana Avenue from Birch Street to Osk Street. A cmmnunicat ion from the
Bonrd of' County Commissioners stating; they would deed an additional thirty feet for the opening of
Birch Street and Montana Avenue. tilUS making; these two streets sixty feet wide. A 1 ettar was read
from the Bozemen Carmine Company stating they had no objections to the vacation ai' Oak Street provided
another sui table entrance to their property is provided as proposed by the Montana Flour Mills. A
letter was read from the State Highway Commission stating; they would favor the openinG of Birch Street.
The Commission havinG lreviously considered this rroposal on May 23. 1951. it was moved by
Commissioner Healy, seconded by Commissioner Secor. that the City Attorney be instructed to draw an
sgreement between the City of Bozeman and the Montana Flour Mills covering the items profosed in their
Fetition. and also to lrepere a resolution of intention to vacate that fortion of Oak Street as
requested, and the motion was carried by the following Aye and :t;o vote: those voting Aye being; Mayor
Lowe. Commissioner Secor and Commissioner Healyj those voting No. none.
ProFosal for Automatic Fire Control System
Mr. H. L. Cook presented a I.:rol,os8l for the installation of an automatic fire control system for
the city shops.
S. I. D. #341 Assessment -- C.W. Downey
Mr. c. W. Downey a:PIJeared before the Commission in regard to the sewer assessment on his
rroperty discussed at the meeting of June 6. 1951. The Commission stated they had no legal obliga-
tion to make an adjustment on this sewer charge. but felt there is some moral obligation. and sug-
gested a compromise settlement of $160.00. Mr. Downey stated he should be reimbursed for the interest
prid because 0 f this addi banal assessment tog;ether with the ~160 .00. After discussion. Mr. Downey
was esked to i ile a claim which could be acted upon by the City Commission.
Meat Inspection Ordinance
J. D. C. Wilf of' the Livestock Sanitar~' Board. Lester Groom and Dr. Carl liammer of the City-
County Health Unit were I resent to urge the CitJ, COlnmission to adopt a meat inspection ordinance.

Mr. R. C. ltichnrdson, Vice-lresident of the Lovell Clay Iroducts Comlany was rresent, and stated
his bid on the sewer pipe could be BcceI- ted with the omicsion of the jointing; nwteria1. Mr. Harold
Eagle of Morrison-Maierle Inc. stated the bid was comp~rable to the estimates made b;y his organizat.ion,
and recommended tLe accel tance of the bid of the Lovell ClHY froducts ComF'any for the sewer lire. It
was decided not to accept a bid on the jointing material at this time. Whereupon, it was moved by
Commissioner Secor, seconded by Commissioner Healy, that the bid of the Lovell Clay lrotlucts COInIiany
for sewer pipe for the amOlmt of ;18,012.73 be accerted, and the Mayor and the Clerk of the Cit;r
Commiss ion be author1 zed to si gn a contract agreement with said compnny for the IJipe, and the motion
was carried by the following Aye end No vote: those voting; Aye being Mayor Lowe, Comnissioner Secor
and Commissioner Healy; those voting No, none.
Proposal to vacate Hayes Street
Mr. Hal Bolincer, 1222 South Willson was present to ask the COlnmission to view the Grounds at
his property, so they could consider the advisabilit;'l of his filine a I,eU tion to have Hayes Street
from South Vlillson Avenue east to the City Limits rartia11y veca ted.
Carnival License for Jaycees
