Montana .1 :):3 July 16. 1958 The Commission of the City of Bozeman met in regul~r session in the Commission Room, City Hall Building, Wednesday, July 16, 1958 at 1:00 o'clock P. M. Present were Mayor Erwin. Commissioner Swanson, Commissioner Berg, City Manager Henderson. City Attorney Lovelace and the Clerk. The 1'011 ow- in~ proceedings were hadl I Minutes of the last regular session of July 9. 1958 were read and it was moved by Commissioner Berg. seconded by Commissioner Swanson. that the minutes be approved as read and the motion was carried by the following Aye and No vo te: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Bert; those voting No, none. Water Improvement Project - Claim for Estimate 10. 10 of Statewide Claim of Statewide Plumbing & Heating Co., Inc. to cover Estimate No. 10. as compiled and approved by Morrison-Maierle. Inc. . for construction under their contract on the Water System Improveluent project. was again presented in a corrected amount of $69,090.41. The claim included all except one-tenth of the 10% reserve held by the City on this and all previous payments against this contract. Max L. Burdick. President of Statewide Plumbing & Heating Co.. was present to speak in behalf of their claim. He stated that. except for minor detail. their contract is completed and that to further hold a reserve of 10% of their entire contract or more than $70,000.00 worked undue hardship on them. After detailed consideration of this cleim, it was moved by Commissioner Berg, seconded by Commissioner Swanson. that a partial payment of $50.000.00 be made on the claim and that the balance of $19.091.41 be held as part of the retained reserve until adequate proof is shown of completion of the contract and the motion was carried by the following Aye and No vote: those votinE Aye being Mayor I Erwin, Commiss ioner Swanson and Commissioner Berg; those voting No, none. At the same time there were presented in informal 1'0 rm by Morrison-Maierle. Inc.. for Statewide Plumbing and Heating Co.. a number of claims of undetermined amounts but indicated to total more than $20,000.00 for extra work and for alleged cost of' delays in executing this contract. No action was taken on these claims pending further detailed check and recommendations by Morrison-Maierle. Inc. Building - Appeal of Kenyon-Noble Lumber Co.. Mendenhall 0: Black Mr. W. V. Ogle. Vice President of Kenyon-Noble Lumber Co.. appeared before the Corr~ission to request permission to use galvanized pipe for an emergency floor drain in the building being constructed by his firm at the corner of Mendenhall and Black Avenue. The pipe connects with a sump in the basement and is not a part of the city sewer system or part of the plumbing system of the building. After consideration by the Cou@ission, it was moved by Commissioner Berg, seconded by Cowmissioner Swanson. that use of galvanized pipe for the floor drain at this building be permHted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No. none. Award of' Contract to Kiely Construction Company for S. I. D. No. 406 Resc5nded A r-etition from owners of 75.56% of the property in Special Improvement District No. 406, paving I on Dell Place. was presented requesting that action of the City Commission at its meeting on July 9, 1958 in accepting the bid of Kiely Construction Company for constructing this paving be rescinded. The petition was based on the fact that the bid. together with engineering and other incidental costs, would make the total cost of this project more than 30ra above the estimate of cost quoted in the Resolution of Intention to create this district. In view of the fact that no contract has been entered into in this matter and that the petition represents such a large percent of the property in the district. it was moved by Commissioner Swanson. seconded by Commissioner Berg. that action taken in this matter at the meeting of' this Commission on July 9, 1958 be and is hereby rescinded. that all bids received on June 25. 1958 for construction of .15'\ paving in Special Improvement District No. 406 be rejected and that bid security posted with these bids be returned to the bidders and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Rel-orts The following reports for the month of June, 1958 were presented: Cemetery Board Cashier Water Collector and the report of the State Board of Health covering; their annual inspection of the City's water system. I It was moved by Co~~issioner Swanson. seconded by Commissioner Berg, that the rep,orts be acce};ted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being; Mayor Erwin, Conunissioner Swanson and Commissioner Berg; those voting No, none. Fees 6.: Fermits Waived for Dorj):icory at Cleveland &: Seventh A plet plan showing; the location of the proposed dormitory et the corner of Seventh Avenue and Cleveland Street was presented. It was moved by Commissioner Swanson. seconded by Comrrlissioner Berg. that the fees and permits for building. f,lumbing and electrical inspection be waived, and this inspection be provided by Montana State College and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin. Corr~issioner Swanson and Commissioner Berg; those voting No. none. Off-Street Parking at Montana State College The City Manager was instructed to prepare a letter to the President and the Superintendent of the Physical Plant at Montana State College pointing out the need for off-street parking with definite recommendations and plans to be carried out. Cha,nge Order - S. I. D. No. 386 A Ohe.nge Order in the construction of Sf';~cial Improvement District No. 386 to make oonnection for I S" storm drain inlets to en existing manhole at an additional cost of $60.00 was presented. It was moved by Commissioner Swanson. seconded by Commissioner Berg, that the Change Order be approved and the Mayor and Clerk of the Commission be authorized to sign the order for the City of Bozeman and the motion was carried by the following; Aye and No vote: those voting Aye being Mayor Erwin. Commissioner Swanson and Corrunissioncr Berg; those voting No. none. House Trailers at Cottonwood & Rouse on Story Property Investigation has been made of the situation as to trailers located on property at the corner of Rouse and Cottonwood Street owned by Mrs. Rose Story. Four trailers are located there 8.nc each connected to a common sewer and water connection. It is oonsidered that the location of two or more .' trailers on a single property constitutes a trailer court and trailer courts are not an allowable use of land at this location. The City Manager was instructed to notify the landowner that the present occupancy of this land is in violation of the Zoning Ordinance and that the situation must be corrected. Adjournment .
