The Commission of The City of Bozeman met in regular session in the Commission Room, City Hal I
Bui Iding, Wednesday, September 3, 1958, at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The
fol lowing proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner Berg, seconded I
by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the fol low-
ing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Bergi
those voting No, none.
Water System Improvement Froject - Change Order - Hyalite Creek Dam
Change Order No.2, recommended by Morrison-Maierle, Inc., providing for a revision on the meter
and meter box at Hyal ite Creek Dam (Phase I I Schedule I) Water System Improvement Project to cost an
additional $350.00, was presented. It was moved by Commissioner Berg, seconded by Commissioner Swanson,
that the Change Order be approved and the motion was carried by the fol lowing Aye and No vote: those
voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Bergi those voting No, none.
Water System Improvement Project - Change Order -Reservoir
Change Order No.9, recommended by Morrison-Maierle, Inc., to provide for revisions in the hydro
pneumatic system in the chlorination house and other changes over and above the original contract
(Phase I Schedule I) Water System Improvement Project to cost an additional $718.00 was presented.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the Change Order be approved
and the motion was carried by the fol lowing Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner Swanson and Commissioner Bergi those voting No, none. I

The Manager stated that he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman and recommends that warrants be issued for their payment. .After exami na-
tion of the claims in detai I by the City Commission and checking them against the Claim Register,
it was moved by Commissioner Berg, seconded by Commissioner Swanson, that the claims be approved
and warrants issued for their payment and the motion was carried by the following..AV6_sn-d No vote: I

Purchase of Calculator
The office of the City Engineer has need for a new calculator the cost of which would be $880.00.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City Manager be
authorized to purchase a new calculator as recommended and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Bergi
those voting No, none.

Purchase of Typewriter
There is need for a new typewriter in the general office of the City and the City Manager recom-
mends purchase of an electric typewriter at a cost of $370.00.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Manager be
authorized to purchase a new electric typewriter as recommended and the motion was carried by the
fol lowing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and

Purchase of Police Car for Fire Department
Proposed lease or purchl'lse of a 1957 Chevrolet station wagon now being turned back to the dealer
after approximately one year of use by the Police Department was discussed. It was proposed to
instal I a resuscitator, fire extinguishers and other emergency equipment in this vehicle and put it in
use by the Fire Department. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that
the City Manager be and is hereby authorized to lease from the Northern Automobi Ie Company the Chevrolet
used station wagon described above at a rental of $125.00 per month under an agreement whereby the City
may purchase this vehicle for a total price of $1,805.00 with any and al I rental which the City may
have paid between this date and the date of purchase to be applied on such purchase price and the motion
was carried by the fol lowing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
Separate Sewer & Water Services to Trailers at Rouse & Cottonwood
A communication from Rose Story was read requesting permission to have a separate sewer and a
separate water service to each trai ler located on her property at the corner ~f Rouse Avenue and
I Cottonwood Street. She stated that each trai ler would be set as to provide the required yard space as
specified in the Zoning Ordinance, and also requesting an extension of time to make this proposed change.
After discussion, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that permission
be granted to extend the sewer and water service west from Rouse Avenue to serve each trai ler unit, the
construction to be under the supervision and approval of the City Engineer, the entire work to be done at
her expense and that an extension of sixty days be granted to complete this work and the motion was
carried by the fol lowing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
Right-of-way to Forest Service for Pioneer Road
A proposed right-of-way deed to the U. S. Forest Service to cross city owned land on the Mystic
Lake Watershed with a pioneer road was presented. The right-of-way deed was approved as to form by the
City Attorney. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the right-of-
way be granted, and the Mayor and the Clerk of the Commission be authorized to sign the said deed for
the City of Bozeman and the motion was carried by the fol lowing ~ye and No vote: those voting Aye
being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Application for Right of-way Easement for Alley in Block C, Original Townsite
I A proposed appl ication to the State Board of Land Commissioners for a right-of-way easement for
al ley purposes in Block C, Original Townsite, across property owned by the State of Montana, was
presente d.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the Mayor and the Clerk
of the Commission be authorized to sign the application for the City of Bozeman and the motion was
carried by the fol lowing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Pioneer Road to Mystic Lake
A proposed communication to the Yellowstone Pine Company covering terms for the construction of a

road to Mystic Lake was read. It was moved by Commissioner Swanson, seconded by Commissioner Berg,
that the City Manager be authorized to send this letter to the Yellowstone Pine Company and the motion
was carried by the fol lowing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
Quit Claim Deed for Vacated Alley in Block 7, Fairview Addition
M. E. Henderson made verbal request for a quit claim deed from the City of Bozeman to the south
10 feet of the north twenty feet of Lot 15, Block 7, Fairview Addition to the City of Bozeman. This I
strip of ground abuts property owned by Mr. Henderson and was part of an al ley vacated by Ordinance
No. 783 of this city, dated August 31, 1955.
It was moved by Commissioner Berg, seconded by Commissioner Swanson that, upon request of the
owners of properties abutting said vacated al ley, quit claims be issued to them and the Mayor and the
Clerk of the Commission be authorized to sign the deeds for the City of Bozeman, and the motion was
carried by the fol lowing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
Reports
The fol lowing reports for the month of August, 1958 were presented:

It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the reports be accepted
and ordered fi led and the motion was carried by the fol lowing Aye and No vote: those voting Aye

Purchase of Copper Pipe I
The Water Department has need for additional supply of 3/4 inch copper pipe. It was moved by
Commissioner Berg, seconded by Commissioner Swanson, that the City Manager be authorized to purchase
up to 3000 feet of such copper pipe and the motion was carried by the fol lowing Aye and No vote:
those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Confirmation of Henry D. Wruck, Jr. as Regular F'ireman
A communication from the Fire Chief was read recommending that Henry D. Wruck, Jr. be confirmed as
a regular member of the Fire Department. It was moved by Commissioner Berg, seconded by Commissioner
Swanson, that Henry D. Wruck, Jr. be confirmed as a regular member of the Fire Department and the
motion was carried by the fol lowing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting No, none.
Hearing - Vacation of Portion of Alley, Block C, Original Townsite
This was the time and place set for hearing protests to the vacation of a portion of the al ley
in Block C, Original Townsite. Affidavit of publ ication of Notice, together with acknowledgement of
service of Notice to al I property owners whose property abuts on the al ley were presented. There was
no one present to protest and no protests have been fi led. It was decided that, before an ordinance
is adopted vacating a portion of this al ley, al I deeds and rights-of-way for the opening of a new I
al ley should be on hand.
Examination of' Def;ository Bonds
The Commission proceeded to examine and check the Custodian's Receipts covering securities for
city funds in the various city banks.
It was moved by Commissioner Berg, seconded by Commi'ssioner Swanson, that the securities be
approved and accepted and set out in fu II in the minutes, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg;
those voting No, none.

This is to certify that we, the Commission of The City of Bozeman, in compl i-

the several banks of Bozeman and find them to be as above stated, and are hereby
accepted and approved.

Water Improvement Project - Final Estimates and Certi:ficates of Comfletion
John Morrison, of Morrison-Maierle, Inc., appeared before the Commission and stated that final
estimates and certificates of completion of the contracts as stipulated in the Plans and Specifica-
tions for the Water System Improvement Project would be ready for the Commission in the immediate
future.
