The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, September 17, 1958,at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, City Manager Henderson. City Attorney Lovelace and the Clerk. The follow-
ing proceedings were had:
I Minutes of the last regular session were read and it was moved by Commissioner Berg, seconded
by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being'Mayor Erwin. Commissioner Swanson and Commissioner Berg;
those voting No. none.
Resolution No. 916 -- Garbage Assessment
This was the time and pbce set for pub1io hearing on levying assessment for garbage collection
for 1958. Affidavit of publ ication of Notice was presented. No one was present to protest and, no
written protests having been filed, Resolution No. 916, as presented and provisionally passed at the
meeting of September 10, 1956, was presented for final passage. It was moved by Commissioner Swanson,
seconded by Commissioner Berg, that the resolution be finally passed and adopted and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Bids for Truck - Park Department
Bids received at the meeting of September 10, 1958 for a truck for the Park Department were further
considered. Recommendations of the Park Superintendent and City Engineer were presented. Action was
deferred until the next regular meeting.

The following reports for the month of August, 1958 were presented:
Cemetery Librarian
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the reports be accepted
and ordered filed and the motion was oarried by the foll~ing Aye and No vote: those voting ~e being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Montana Flour Mills Proposal to Sell Water & Ditch Rights
Proposal of the Montana Flour Mills to sell their water rights in Bozeman Creek and ditch rights
in the McAdow ditch was further considered. The matter was tabled until a later meeting.
Building -- 116 South Tracy Avenue
Request of August Gnehm to construct an addition to the building at 116 South Tracy Avenue, as
presented at the meeting of September 10, 1958~ was further considered. The Building Inspector and the
Fire Chief reoommend that permit for the proposed building should not be issued unless both it and the
existing "Sports Chalet" building are made to comply with present building and fire regulations. It
was pointed out that an exception to the Building Ordinance was made to permit construction of the
present building in 1952 partially on the basis that it was to be a temporary building. After oonsidera-
I tion, it was moved by Commissioner Berg, seoonded by Commissioner Swanson, that the Building Inspeotor
be instructed to inform August Gnehm that any addition or alteration to the present building at 116
South Tracy will have to comply with the regulations of the Building Code for Fire Zone No.1, and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting No, none.
Building - Request to Use Romex Wiring, 111 So~th Black, Denied
A written request was read from M. L. Hultgren asking for an exception to be made to the E1eotrioal
Ordinance to permit him to complete wiring of his building at 109-111 South Black Avenue with "Romex"
or other similar electric cable. The Eleotrical Ordinanoe, adopted after a permit for the construotion

of this building was issued, requires that metal conduit be used for wiring in this location which is in
Fire Zone No.1. After oonsideration, it was moved by Commissioner Berg, seoonded by Commissioner
Swanson, that the request be denied and the motion was oarried by the following Aye and No vote:
those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Special Use Permit for Procurement of "Reject Gravel
A special use permit was presented from the U. S. Department of Interior which allows the City I
to haul up to 10,000 cu. yds. of "reject" gravel from a pile of such material left on U. S. Government
owned land from gravel crushing operations of McLaughlin, Inc. This material is located in Bridger
Canyon near the U. S.Fish Hatchery. There is to be no charge against the city for this material.

Resolution No. 917 - Assessment S. I. D. 391
Resolution No. 917 levying the assessment in the amount of $30,895.27 for construction of Special
Improvement District No. 391 was presented entitled:

I Skating Fees Approved
Recommendations of the Board of Recreation to increase fees for skating as made at their meeting
of September 8th, 1958 were read. It was moved b,y Commissioner Swanson, seconded by Commissioner
Berg, that the reconunendations be approved and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Report
The City Manager reported on the meeting of the Legislative Committee of the Montana Municipal
League held in Helena on September 11, 1958.
Water Works Project - Completion Date - Long Construction COmpany Contract
A statement from Morrison-Maierle, Inc. was read certifying that the contract of Long Construction
Company for construction of the diversion dam in Ryali te Creek (Phase II Schedule I of Plans and
specifications for the Water System Improvement Project) is completed as of this date. On reconunenda-
tion of Morrison-Maierle, Inc., it was moved by Commissioner Swanson, seconded by Commissioner Berg,
that, subject to concurrence by the City Engineer, Long COnstruction COmpany be notified that their
contract is accepted as complete this 17th day of September, 1958 and that their one-year guarantee
will start from this date and the motion was carried by the following Aye and No vote: those voting

Investment of Cemeter,y Permanent Care Funds
There are sufficient funds in the Cemeter,y Permanent Care Fund to purchase $10,000.00 of Special
Improvement District No. 405 bonds.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the Director of Finance
be authorized to invest $10,000.00 in Special Improvement District No. 405 for the Cemetery Pe:nnanent
Care Fund and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
City Manager to Missoula
A meeting of City Managers in the State of Montana will be held in Missoula September 26, 1958.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the pity Manager be
authorized to attend this meeting and his expenses be paid from the General Fund and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
Adjourmnent
There being no further business to come before the Commission at this time, it was moved by
