October 1, 1955 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, October 1, 1955, at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The follow- ing proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner SWanson, seconded I by Commissioner Berg, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Resolution No. 921 - Final Passage - Weed Assessment This was the time and place set for hearing protests to levying assessments for weed cutting for 1955. Affidavit of publication of the Notice was presented. No one was present to protest and, no protests having been filed, Resolution No. 921, provisionally adopted at the regular meeting held September 24th, 1955, was presented for final passage. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Resolution No. 922 - Final Passage - Assessing S. I. D. 394 This was the time and place set for hearing protests to levying assessments for Special Dnprovement District No. 394. Affidavit of publication of the Notice was presented. No one was present to protest and, no protests having been filed, Resolution No. 922, provisionally adopted at the regular meeting held september 24th, 1955, was presented for final passage. It was moved by Commissioner Berg, seconded I by Commissioner Swanson, that, the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Resolution No. 928 - Final Passage - Assessing S. I. D. 405 This was the time and place set for hearing protests to levying assessments for Special Improvement I Distriot No. 405. Affidavit of publication of the Notice was presented. No one was present to protest and, no protests having been filed, Resolution No. 928, provisionally adopted at the regular meeting held September 24th, 1958, was presented for final passage. It was moved by Commissioner Berg, seconded by Commissioner.. Resolution No. 929 - Final Passage - Assessing S. I. D. 403 This was the time and place set for hearing protests to levying asseSSMents for Special Improve. ment District No. 403. Affidavit of publication of the Notice was presented. No one was present to protest and, no protests having been filed, Resolution No. 929, provisionally adopted at the regular meeting held September 24th, 1958, was presented for final passage. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. D. A. V. "Forget-me-not" Day I A letter from the Disabled American Veterans was read in which they requested permission to conduct their annual sale of "Forget-me-nots" in Bozeman on October 11, 1958. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that, the request be granted and the motion was carried by the following Aye and No vote: those voting AYe being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Proposal for Street Sweeper Guy Sperry, representing Western Construction Company, was present to explain a proposal of his organization for the rental of a street sweeper with an option to purchase. Mr. Sperry was requested to submit a copy of the proposed "rental - option to purchase" contract for examination and study by .. .1 ~}il the ,Commission. Reports The following reports for the month of September, 1958 were presented: Fire Chief Sewage Plant Operator Cashier Water Collector It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those vot- I ing Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Water - Pressures Throughout the City A written report from Morrison-Maierle, Inc. was read regarding tests they made on September 25, 1958 on water pressures throughout the city. They stated that existing water pressures are not exces- sive and are what may be expected as maximum pressures resulting from the newly completed Water System Improvement Project. A contour map showing pressures at different levels throughout the City accompanied the letter. Appointment - Airport Board Mayor Erwin announced re-appointment of T. G. Hagg&rty as a member of Gallatin Field Board. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the appointment be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Water Improvement Project -- Claims of Statewi~e Mr. Max Burdick, President, and Tom Liddel, Superintendent, of the Statewide Plumbing and Heat- ing Company appeared before the Commission relative to claims previously filed by their company for extra work on the Water System Improvement Project. I On July 23, 1958, this company presented claims for such work in the amount of $27,914.37. On recommendation of Morrison-Maier1e, Inc., the City offered settlement in the amount of $5,000.00. Statewide Plumbing & Heating Company has now presented claims in letter form covering the same extra work and now amounting to $67,253.75. In addition thereto, they request that the City's charge against them for repairs on water trenches in the streets in the amount of $1,969.70 be cancelled. Action on these claims was deferred until detailed study can be made of them and Mr. Burdick was informed that he would be notified and given an opportunity to be heard before final action is taken regarding them.
