The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, October 15, 1958, at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The
following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner Swanson, seconded I
by Commissioner Berg, that the minutes be approved as read and the motion was carried by the following
Aye and No vote: those voting ~ye being Mayor Erwin, Commissioner Swanson and Commissioner Berg;
those voting No, none.
Traffic - West Grant Street
Mrs. Creech Reynolds, 1404 South Third Avenue, appeared before the Commission and stated that,
since West Grant Street has been paved, fast and heavy traffic on this street is becoming hazardous
to small children in this area. She pointed out that traffic to and from M.S.C. Campus can now travel
without stop from the campus to Willson Avenue and thence to Babcock Street which tends to encourage
driving at excessive speed and makes it difficult and dangerous for school children to cross these
streets. She urged that action be taken to slow this traffic and reduce the e~sting hazards. She
was informed that this traffic problem is being studied and something will be done as soon as possible.
Street Sweeper, Proposals on Rental
Proposals for rental of a street sweeper were presented to the Commission. Action on them was
deferred pending a more detailed study and receipt of a specific recommendation from the City Engineer
and the Street Superintendent as to the sweeper best suited to the needs of this city.
Completion of Special Improvement Districts I
A Certificate from Harold Hoskins and Associates, Engineers, was read certifying that construction
work has been completed in Special Improvement Districts Nos. 385, 386, 389, 390, 391, 393, 394, 395,
397, 398,401, 403,404 and 405 in accordance with the plans and specifications. It was moved by
Commissioner Berg, seconded by Commissioner Swanson, that the districts be accepted as complete, that
the guarantee period begin as of October 15th, 1958 and that, upon presentation of claims by the
contractor, final p9.yment be made to them and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Resolution No. 930 - W & C 1958 Assessment - Final Passage
This was the time and place set for hearing protests to levying assessment for construction and/or
repair of sidewalks for the year 1958. Affidavit of publication of Notice was presented. No one was
present to protest and, no protests having been filed, Resolution No. 930, as provisionally adopted at
the meeting of October 8th, 1958, was presented for final passage. It was moved by Commissioner
Swanson, seconded by Commissioner Berg, that the resolution be finally passed and adopted and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting No, none. I
Resolution No. 931 - Assessing S. I. D. 398 - Final Passage
This was the time and place set for hearing protests to levying assessment for construction of
Special Improvement District No. 398. Affidavit of publication of the Notice was presented. No one was
present to protest and, no protests having been filed, Resolution No. 931, as provisionally adopted
October 8th, 1958, was presented for final passage. It was moved by Commissioner Berg, seconded by
Commissioner Swanson, that the resolution be finally passed and the motion was carried by the follow-
ing AYe and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg;
those voting No, none.

Resolution No. 932 - Assessing S. I. D. 393
Resolution No. 932, levying assessment for construction of Special Improvement District No. 393 in
the amount of $284,293.88 was presented, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A
SPECIAL ASSESSMENT OF TAXES UPON AU. THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 393
IN THE CITY OF BOZEMAN, OOUNTY OF GALIA TIN, STATE OF MONTANA, ro DEFRAY THE COST OF CON-
STRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMmT DISTRICT NO. 393.
I It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the resolution be pro-
visionally adopted and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Platting - Western Sub-Division
A proposed plat of a part of Western SUb-division, prepared for Simgraph Corporation, covering
a tract of approx:i.m.ately 10 acres, situated approximately one mile west from the city limits, having
a frontage of approximately 330 feet on U. S. Highway No. 191 and extending north therefrom a distance
of approximately 1334 feet was presented for approval. A plat of a similar tract as a part of Western
Sub-di vision, to extend north from the tract herein described to Durston Road was presented by
Alexander and Florins. Weaver at the last meeting of the Commission and was authorized to be approved
by the Director of Public Service. There was also presented at this time letters from Simgraph
Corporation stating that they will, upon approval of their plat, deed Lots 4 and 5, Block 3, of Western
Subdivision to the City of Bozeman in lieu of their having dedicated ground for park purposes in this
sub-division and from Alexander and Florina Weaver stating that they will deed Lots 6 & 7, Block 4,
Western SUb-division under the same conditions and applying to their part of the said Western Sub-
di vision. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that, conditioned on
I deeds to lots in lieu of dedication of ground for park purposes being furnished as described herein
so that such deeds can be filed simultaneously with the filing of the proposed plats of Western Sub-
division, authority is hereby given to the City Manager, acting as Director of Public Service, to
approve the plat presented by Simgraph Corporation and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those
voting No, none.
Unifonns for Police Department
Chief of Police Saunders has recommended that purchase be made of items of unifonn for replacement
of worn out and unserviceable items and of unifonn for new police officers at an approximate cost of
$770.00.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City Manager be
authorized to purchase items of police unifonn in accordance with Chief Saunderts recommendation and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner Swanson and Commissioner Berg; those voting No, none.
Planning - Presentation of Final Report
I The completed report of S. R. DeBoer & Company covering the M::l.ster Plan for this City was presented
to the Commission.
Annual Meeting Middle Creek Water Users' Association
The annual meeting of the Middle Creek water Userst Association is to be held WedneSday, October
22nd, 1958. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that Oscar Cutting
be appointed as its proxy and authorized to vote the shares of the City of Bozeman at this meeting
and the motion was carried by the following Aye and No vote: those voting Aye being M::l.yor Erwin,
Commissioner Swanson and COmmissioner Berg; those voting No, none.

Right-of-W8\V Easement for Water Line to Hyalite View Addition
A deed for right-of-way easement given by' R. R. Renne for the location of the water main to serve
the Hyalite View Addition was presented.
Appointment - United Nations Day Chairman
Mayor Erwin announced the appointment of Paul Grieder as Chairman for the arrangements of the
observation of United Nations Day.
Water & Sewer - Lutheran Church - Black & Olive I
A request from the First Lutheran Church to have one sewer line and one water line to serve the
church and the addition thereto now under construction and the pastor's residence at the corner of Black
and Olive Street was presented. Present policy of the City is that not more than one main building
may be served. by one service from either a water main or a sewer main. In view of the circmnstances
in this case and the fact that the church and the parsonage have up to this time both been connected to
a single water service and a single sewer service, it was moved by Commissioner Swanson, seconded by
Mayor Erwin, that, so long as this property remains under church ownership and continued in use for
church purposes, an exception be made to existing policy and that the church as re-constructed and the
parsonage be allowed to be re-connected to a single metered water service and a single sewer service
and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
,Commissioner Swanson and Commissioner Berg; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Swanson, seconded by Commissioner Berg, that the meeting adjourn and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and I
Commissioner Berg; those voting No, none.
