October 22, 1958
The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, October 22, 1958, at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The follow-
ing proceedings were had:
I Minutes of the last regular session were read and it was moved by Commissioner Berg, seconded
by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those
voting No, none.
Traffic - Arterial Streets as Recommended by Police Chief
Written recommendations of Chief of Police Saunders regarding traffic on newly paved streets were
presented as follows:
1. That the following streets and avenues be made arterial streets:
a) South Willson Avenue from Garfield to Grant Street
b) South Third Avenue from Garfield to the City Limits
c) Eleventh Avenue from College street to Curtiss Street,
Curtiss Street from Eleventh to Tenth Avenue, and
Tenth Avenue from Curtiss Street to Main Street.
2. That parking be prohibited on the east side of Willson Avenue from Cleveland to Garfield
Street.
3. That Babcock Street between Eighth Avenue and Eleventh be discontinued as an arterial
street.
4. That radar equipment to be purchased for use of the Police Department.

After consideration and discussion by the Commission, it was moved by Commissioner Berg, seconded
by Commissioner Swanson, that recommendations of the Chief of Police as to arterial streets and as to
prohibited parking on a part of South Willson Avenue be approved and that the City M9.nager be instructed
to issue the necessar,y order and to purchase and have the required signs installed to make these changes
in traffic regulations effective with ,the least possible delay and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg;
those voting No, none.
Resolution No. 932 - Assessing S. I. D. 393 - Final Passage
This was the time and place set for hearing protests to final adoption of Resolution No. 932
levying assessment for construction of Special Improvement District No. 393. The affidavit of publica-
tion of the Notice was presented. No one was present to protest and, no protests having been filed,
Resolution No. 932, as provisionally adopted October 17th, 1958, was presented for final passage. It
was moved by Commissioner Swanson, seconded by COmmissioner Berg, that the resolution be finally
adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Erwin, Commissioner SWanson and Commissioner Berg; those voting No, none.

The report of the Cemeter,y Board for the month of September, 1958 was presented. It was moved by
Commissioner Swanson, seconded by Commissioner Berg, that the report be accepted and ordered filed and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
COmmissioner Swanson and Commissioner Berg; those voting No, none.
Claims
Claims Nos. 2986 to 3002 inclusive were presented on various funds as follows:

The Manager stated that he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman and recommends that warrants be drawn for their payment. After examina-
tion of the claims in detail, it was moved by Commissioner Swanson, seconded by Commissioner Berg, I
that the claims be approved and warrants issued for their payment and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none.
Red Heart Tag Day
A letter from the "Ladies of Moose" requesting permission to have Saturday, October 25th, 1958,
as "Red Heart Tag Day" was presented. It was moved by Commissioner Swanson, seconded by Commissioner
Berg, that the request be granted and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Rental of Street Sweeper
Proposals for rental of street sweeper on a lease-purchase agreement which had previously been
presented to the Commission were taken up for further consideration. The following companies
presented proposals:
Hall-Perry Machinery Co. ---------~------- on an Austin-Western, Model "60"
Western Construction Equipment Company ---------- on an Elgin "Street King"
Industrial Equipnent Compa.1'IY ---------------------- on a Wayne, Model "550"

Recommendations were presented from the Street Superintendent, City Engineer and City M3.nager
that an Elgin Sweeper be acquired under a lease agreement with an option to purchase as offered by
the Western Construction Equipment Company. After consideration, it was moved by Commissioner
Swanson, seconded by Commissioner Berg, that the City of Bozeman enter into a rental-purchase agree-
ment with the Western Construction Equipment Company for an Elgin Sweeper as per their proposal
dated October 7th, 1955, and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Planning - Approval of Area of Jurisdiction and Street Net Wbrk
A map showing the proposed area of jurisdiction of the City-County Plan Board under the Master
Plan prepared by DeBoer and Company and a map of the proposed street plan under that Master Plan were
presented. A communication from the City-County Plan Board was read stating they have approved the two
plans as presented on the maps and that November loth, 1958 has been set as the date for a public
hearing on them.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the area of jurisdic-
tion be tentatively approved, subject to concurrent approval by the County Commissioners, and subject
to final approval after the public hearing and the motion was carried by the following Aye and No I
vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting
No, none.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the street net work for
the Master Plan be tentatively approved, subject to concurrent approval by the County Commissioners and
subject to final approval after the public hearing, and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those
voting No, none.

Planning - Corrections in Summar,y & Conclusions
In the preliminary edition of the "Summary and Conclusions" book prepared by S. R. DeBoer Go.
which is, in effect, the Master Plan which they were hired to prepare for this City, numerous errors
were pointed out by the City-County Plan Board which needed to be corrected. S. R. DeBoer Company
have now presented what is presumed to be the final edition of this book and the recommended correc-
I tions have been made by reference following each incorrect paragraph to an appendix which was added
to the book in which the recommended corrections are made in what is considered as incomplete and
unsatisfactory manner. H. D. Korslund, President of the City-County Plan Board, was present to
discuss these matters. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that
Mr. Korslund be requested and authorized to write to S. R. DeBoer Co. to inform them that the
manner in which they have made corrections in the book, "Summary and Conclusions" on the Master
Plan is considered inadequate and unsatisfactory and that these corrections should be made by reprint-
ing those pages of the book on which there are obvious errors or incorrect statements and the motion
was carried by the follOwing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting No, none.
Petition to Vacate Portion of Lincoln Street
A petition requesting that Lincoln Street, between Third Avenue and Grand Avenue, be vacated was
presented and read. It was moved by Commissioner Swanson, seconded by Mayor Erwin, that the petition
be referred to the Qity Engineer for study and recommendations and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none.
I water Improvement Project - Engineer's Recommendations as to Payment to Statewide
On October 1, 1958, Statewide Plumbing & Heating Company presented revised claims for alleged
delays and other extra costs on their contract on the Wlter System Improvement Project. These
claims were referred to Morrison-Maierle, Inc., Project Engineers, for review and recommendation.
A letter, dated October 20, 1958, was presented at this time from Morrison-M9.ierle, Inc., in which
they recommend that final settlement be made with statewide Plumbing & Heating Co. on the same basis
as was offered to them on July 15, 1958.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Swanson, seconded by Commissioner Berg, that the meeting adjourn and the motion was
