The Commission of the City of Bozeman met in regular session in the Commission Room. City Hall
Building, Wednesday, July 9, 1958 at 1:00 o'clock F. M. Present were Mayor Erwin. Commissioner
Swanson, Commissioner Berg. City Manager Henderson, City Attorney Lovelace and the Clerk. The f 011 ow-
ing proceedings were had:
I Minutes of the last regul?r session of July 2. 1958 were read end it was moved by Commissioner
Swanson. seconded by Commissioner Berg. that the minutes be approved es read end the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin. Commissioner Swanson and
Commissioner Berg; those voting No, none.
Award of Bid on Garbage Truck & Packer
Bids submitted July 2nd. 1958 for furnishing the City wi th a truck end packinc unit for the Garbage
Department were reviewed for the City Commission. Bids having been tabulated and investigated in
detail, itwes recommended by the City Manager that the bid of Owenhouse Hardware Company on an
International Model R-192 truck with an RD.450 motor and with 12 ply, nylon, mud-grip tires rear and
12 ply. nylon. standard tread tires front and with a Leach Packmaster garbage body of 17 cu. yd.
capaci ty at a total net cost of $9.272.50 is the best uni t to serve the fllqose for which the City
will use it. !t was moved by Commissioner Berg. seconded by Commissioner Swanson. that the bid of
Owenhouse Hardware Company for the unit above described be accel-ted. payment to be made at the rate
of $500.00 from date of delivery until January 1, 1959 and the full unpaid balance to be paid at that
time or at any time before January 1, 1959 when the City may wish to pay such balance and the motion
was carried by the following Aye and No vote: those voting Aye beinc Mayor Erwin, Commissioner $war.son

Water Improvement Project - Claim of Statewide Plumbing &: Heatint:, Co.
Claim of Statewide Plumbing & Heating Company in the amount of $70,772.98. covering Estimate
No. 10 as presented at the meeting of July 2nd, 1958. end recommended by Morrison-Maierle. Inc. for
payment, has been reduced by a credit of Change Order No. 13A to a net amount of 4>69.115.56. Claim
for ~69 .115. 56 was presented and reconunended by MQrrison-Maier1e, Inc. fo r paymen t . Don Whiteaker.
representing Morrison-Maierle. Inc.. Wil.S present and stated that claims have been presented to his
firm by Statewide Humbing end Heating ComFany against this City for approximately ~20,OOO.00 for
delays in comf-1eting their contract due to failure on the part of the City in securing; required rights-
of-way. He stated that his company will be prepared to present these and all other claims which
Statewide Plumbing and Heating Company may have aGainst the City of Bozeman and to make recorrnnendation
as to payment of' such claims at the next regular meeting of the City Commission. It was also ~ointed
out the t neither the Statewide Plumbing &: Heating Company nor Morrison-Maierle. Inc.. have complied
wi th the requirements set by action of the Commission at its meeting on July 9. 1958 and therefore
no further action on the claim was taken at this time.

The Manager stated that he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman and recommends that warrants be issued for their payment. After examination

of the cleims in detail by the Commission and checking against the Claim Register. it was moved by
Commissioner Swanson. seconded by Commissioner Berg. that the claims be approved and warrants drawn
for their payment and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Erwin, Cornmiss ioner Swanson and Commissioner Berg; those voting; No, none.
Proposed Electrical Ordinance
Proposed changes in the present Electrical OrdinBnce as presented by Roy Smart. Building
Inspector. were discussed. The City Attorney was instructed to prepare a revision of the Electrical I
Ordinance to include these proposed changes.
Award of Contract for S. I. D. No. 40B
Owners of only 57% of the property represented in Special Improvement District No. 406 have
replied to a letter sent them regarding; awarding the contract for the construction of this district
and 11.5% are opl-osed and 45.6% are in favor of awarding the contract as bid. After consideration.
it was moved by Commissioner Swanson. seconded by Commissioner Berg. that the bid of Kiely Construction
Company. submitted at the meeting of June 25th, 1958. be accepted and the motion was carried by the
following Aye and ~o vote: those voting Aye being Mayor Erwin. Commissioner Swanson and Commissioner
Berg; those voting No. none.
Bonds for S. I. D. Nos. 404 and 406
Bonds of Special Improvement Districts 404 and 406 must be sold to provide funds for construction
in these districts. It was moved by Commissioner Swanson, seconded by Commissioner Berg. that the
Clerk of the Commission be author ized to advertise for bids for the sa.le of bonds in these two
districts in the following al-p'y.oximate amounts:
Special Improvement District No. 404 - ~lO.OOO.OO
Special Improvement District No. 406 - 13.300.00 I
and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner Swanson and Commissioner Berg; those voting No. none.
Fire Insurance on City Vehicles
Values on City vehicles for fire insurance purfoses for the coming year should be set. The City
Manager recommended that. for fire insurance purposes Fresent insured values of vehicles of over
$;2.000.00 be reduced 15r~; values between $500.00 and $2.000.00 be reduced 10% and values of less than
$500.00 remain unchanged. It was moved by Commissioner Swanson. seconded by Comnlissioner Berg. that
this recommendation for fire insurance on vehicles be approved and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Erwin. Commissioner Swanson and Commissioner
Berg; those voting No, none.
Re~ort
The relort of the Recreational Director on Swimming Pool olerations for the month of June. 1958
was presented. It was moved by Commissioner Berg. seconded by Corrnnissioner Swanson, that the report
be apfroved and ordered filed Bnd the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Erwin. Commissioner Swanson and COlrunissioner Berg; those voting No. none.
4-Way Stop Bt Babcock & Black I
Police Chief Saunders was present and reported that. after study and investigation, he recommends
that a "4_Way Stop" be established at the intersection of Babcock Street and Black Avenue.
It wes moved by Commissioner Swanson, seconded by Commissioner Berg. that the recommendation be
approved and the City Manager be instructed to have necessary stop signs installed at this intersection
and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin.
Commissioner Swanson and Commissioner Berg; those voting No, none.
Adjournment There being no further business to come before the Commission at this time. it wa s
moved by Cormnissioner Swanson. seconded by Mayor Erwin. that the meeting adjourn and the motion was
