City Hall Building, Wednesday, January 16, 1958 at 1100 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The following proceedings were had: I Minutes of the last regular session of January 8,1958 were read and it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the minutes be approved as read and the motion was carried by the following ~e and No vote: those voting Aye being Mayor Erwin. Commissioner Swanson and Commissioner Berg; those voting No, none. Wages for Police & Firemen - Longevity Pay Delegates from the Polioe and Fire Departments appeared before the Commission to request that the City reconsider its fonner action and make the 1% per year longevi~ pay. allowed for Policemen and Firemen by the 1957 LegislatureJbe based on the beginning date of each man's employment and made effeotive as of July 1, 1967 and that, if this request is not granted, the City waive any applicable statute of limitations which would limit the time within which they could take action to secure a court decision on this question. A case before the Distriot Court in Billings was expected to clarify these laws on longevity pay but a recent opinion handed down in that case failed to make such clarification. A proposed agreement to waive the statute of limitation was referred to the City Attorney for study and the Commissioners deferred action until their next regular meeting. Bids for Water Meters I Bids for water meters, received at the meeting of January 8, 1958, were further considered. A memorandum was read. from the Water Superintendent and his assistant, recommending that the bid of the Rockwell Manufacturing Company, Inc.. for "Empire" water meters at $26.00 each. F. O. B. Bozeman, be accepted. It was kllOved by Commissioner Swanson, seoonded by Commissioner Berg. that the bid of the Rockwell Manufacturing Co., Inc., be acoepted and that the bidder be requested to fUrnish either "Empire" or Rockwell "Sealed Register" meters in suoh quantities as the City may designate up to the total of 300 on which the bid was made provided that either of these meters will be furnished at the same prioe, and the motion was carried by the following Aye and No vote I those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Request for Street Light Denied - Aspen Street between 5th & 7th A request has been received for a street light to be installed on Aspen Street. between Fifth and Seventh Avenue. Beca.use the requested location is not at a street intersection and because both pedestrian and vehicular traffic are very light on Aspen Street it was not deemed advisable to have a street light installed at this location at the present time. Reports. The following rerorts for the month of December, 1967 were presen tedl I Cashier Chief of Polioe Director of Finance Water Colle ctor and the annual report of the Police Department for the year 1957. It was moved by Commissioner Swanson. seconded by Commissioner Berg, that the reI,orts be acoepted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Easement for Gas Line through Sewage Plant Propert,y A request from the Montana Power Company for a right-of-way easement aoross the Sewage Plant property to install a natural gas transmission line oheck valve and valve box was presented. It was :378 moved by Commies ioner Berg, seconded by Commissioner Erwin, that the easement be granted, and the Mayor and Clerk of the Commission be authorized to sign the right-of-way easement for the Cit,y of Bozeman. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Gas Fitter's and Electrician's Bonds -- George E. Wellhauser Gas Fitter's bond and Electrician's License Bond of George E. Wellhauser were presented. These I bonds were approved as to fonn by the City Attorney. It was moved by Commissioner Swanson, seoonded by Commissioner Erwin, that the bonds be approved and accepted and the motion was carried by the following Aye and No votel those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Resolution No. 879 -- Intention to Abandon Parking Maintenance District No. 301 The City Attorney, as instructed, has prepared a resolution of intention to abandon Parking Maintenance District No. 301. Resolution No. 879 was presented. entitledl A RESOLUTION OF THE CITY COMMISSION OF' THE CITY OF' BOZEMAN, MONTANA. DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO ABANDON CITY OF' BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO.301 AND TO ABANOON THE MAINTENANCE OF' STREET PARKINGS THEREUNDER. AND DIRECTING THE CLERK OF THE CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION. ALL PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROV IDEO. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the resolution be passed and adopted and January 29, 1958 be set as the date for hearing protests, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by I.
