The Commission of the City of Bozeman met in regular session in the Commission Room. City Hall
Building. Wednesday. January 22. 1958 at laOO o'clock P. M. Present were Mayor Erwin. Commissioner
Swanson. Commissioner Berg. City Manager Henderson. City Attorney Lovelace and the Clerk. The
following proceedings were had:
I Minutes of the last regular session of January 15. 1958 were read and it was moved by Commissioner
Swanson, seconded by Commissioner Berg, that the minutes be approved as read and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Erwin. Commissiore r Swanson and
Commissioner Berg; those voting No, none.
Opening of Bozeman Creek watershed for Fishing
Lloyd Justus, U. S.Fish Hatchery Superintendent at Bozeman, recommends that the Sour Dough
Creek Watershed be opened for fishing and general recreational use. This recommendation is conourred
in by the U. S. Forest Service. After consideration, it was directed that the Montana State Board of
Health be informed of these recommendations and, if they concur in them, that they be requested to
inform the City of Bozeman and the U. S. Forest Service of any special restrictions which should be
placed or continued on the area.
Petition to Abandon Parking Maintenance District No. 117
A petition, signed by owners of property in Parking Maintenance District No. 117, Tracy Avenue
between Dickerson Street and College Street, was presented requesting that the Commission take
necessary action to abandon said district. It was moved by Commissioner Berg, seconded by Commissioner
Swanson, that the City Attorney be instructed to prepare a resolution of intention to abandon this
.1 distriot and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Claim for Gas Tax Refund
A claim to the State Board of Equalization, in the amount of $1,066.09. for refund of state
gasoline tax paid qy the Ci~ was presented. It was moved by Commissioner Swanson, seconded by
Commissioner Berg, that the City Manager be authorized to file the claim and the motion was carried
by the following Aye and No votea those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Wages for Police & Firemen - Longevity Pay
Delegates from the Police and F'ire De}artments were present in regard to longevity pay for
members of these departments. The City Attorney stated that the proposed agreement presented for his
study at the last meeting, which would waive the statute of limitations, was more lengthy and detailed
than necessary and that, in his opinion, a letter signed by the Mayor and City Commissioners would be
binding on the City and would serve the same purpose as the proposed agreement. Delegates from both
departments stated that such a letter would be acceptable to their departments but delegates from the
Police Department returned later to this meeting and stated that their Police Protective Association
I did not oonsider a letter as proposed in this matter to be sufficient and that they wanted an agreement
signed in the form which they had proposed. Since this agreement, as presented, was not applicable
to a city operating under the Commission-Manager form, the delegation was instructed to have the
agreement re-written and re-submitted to the Commission for their consideration.
Bond of Commissioner Swanson
A communication from Judge W. W. Lessley was read stating he has approved the official bond of
Commissioner A. M. Swanson as City Commissioner for a period of January 1, 1958 to January 1, 1962.
Manager to Attend Meeting of Northwest City Managers' ~soeiation
A meeting of the Northwest City Managers' Association is to be held in Pendleton, Oregon.

February 17th to 19th, 1958. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that
the City Manager be authorized to attend this meeting and that his expenses be paid from the General
Fund and the motion was carried by the following Aye and No votel those voting Aye being Mayor Erwin,
Commissioner Swanson and Commissioner Berg; those voting No, none.
Request of Lion's Club Denied
Don Nobis, representing the Lion's Club, was present to request that members of that organization
be permi tted to fine "jay-walkers" on Main Street and turn money so collected over to the "March of I
Dimes". The City Attorney advised that this Organization would have no authority to establish or
collect fines and it would be an unlawful delegation of authority.
Plan Board -- Secretary to Keep Commissioners Infonned
A proposed letter from the City Manager to the City-County Plan Board was discussed. The letter
referred to appointment of a Secretary to the Board, to establishing a place of business for regular
conduct of business of the Board and to procedures recommended for the Board to keep the owners of
affected properties, the City and the County informed on hearingsto be held and action taken on
proposed plats of land or similar matters which may oome before the Board.
It was moved by Commissioner Swanson, seoonded by Commissioner Berg, that, when this proposed letter
is approved by the County Commissioners of Gallatin County, the City Manager be authorized to send it
to the City-County Plan Board and the motion was carried by the following Aye and No vote; those
voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Four-way Stop -- Mendenhall & Tracy
The matter of a 4-Way Stop at the intersection of Traoy Avenue and Mendenhall Street was discussed.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Manager, as Director
of Public Safety, be instructed to issue a temporary order to make this interseotion a 4-Way Stop and I
the motion was carried by the following Aye and No votel those voting Aye being Mayor Erwin,
Commissioner Swanson and Commissioner Berg; those voting No, none.
Purchase of Lot - Northwest Corner of Rouse & Peach Street
Inquiry has been made as to the interest of the City in purchasing the property at the northwest
corner of Peach Street and Rouse AVenue for $5,600.00. Purchase of this property would permit partial
correction of the "jog" or irregularity in prop8r~ lines at this intersection. It was considered that
the quoted price would make the cost of change at this intersection entirely out of proportion to any
benefits which could be gained.
Water Improvement Project -- Repairing Damage and Replacing of Top Soil by Contractor
City Attorney Lovelace reported on a complaint he had received from Mrs. Melva Morris across
whose land, near the mou,th of Hyalite Canyon, the Statewide Plumbing & Heating Co. is now installing
the new supply line under their contract in the water expansion project. Basis of the complaint was
that this contractor has failed to confine his operations to the right-of-way granted to the City and
has not segregated and replaoed top 80il in trenohing done aoross this property, and was thus damaging
the property in excess of the terms of the easement agreement. The City Manager was instructed to make
immediate inspeotion of this property, to notify the contraotor and the supervising engineers of any I
work or procedure which is not being carried out in accordance with the contract and to take such
action as might be found necessary to proteot the interests of the City of Bozeman and of owners of
properties concerned.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Swanson, seoondedby Commissioner Berg, that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
