ROW Purchase from Gallatin County for Regional Park Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Rick Hixson, City Engineer SUBJECT: Right-of-Way Purchase for Construction of Improvements to Oak Street and Ferguson Road - Regional Park Parcel AGENDA ITEM TYPE: Consent MEETING DATE: May 22, 2017 RECOMMENDATION: Authorize the Acting City Manager to sign the Memorandum of Agreement, Public Use Easement, and Certificates of Acceptance needed for the City to install improvements to Oak Street and Ferguson Road. BACKGROUND: By adopting the City of Bozeman Capital Improvement Plan the City Commission has directed staff to install improvements to Oak Street between New Holland Drive and Ferguson Avenue and to Ferguson Avenue between Oak Street and Baxter Lane. These sections of road are in fact part of the major west side street construction project (megabuild) scheduled for this summer. In order to carry out that direction it is necessary to acquire the Right-of-Way described herein. The attached documents, which have been executed by the County Commission, are the result of those efforts and are necessary to the completion of that project. The valuations used for these acquisitions was performed under the direction of DOWL Engineering, the city's professional consultant for this project. UNRESOLVED ISSUES: None. FISCAL EFFECTS: The total cost of these acquisitions is $161,606.00 which will be paid for using the Street Impact Fee Fund. ALTERNATIVES: As suggested by the City Commission.
