HomeMy WebLinkAbout1958-01-29 :~81 Bozeman, Montana January 29, 1958 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, January 29, 1958 at 1:00 o'olock P. M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The following proceedings were hada I Minutes of the last regular session of January 22. 1958 were read and it was moved by Commissioner Berg. seoonded by Commissioner Swanson, that the minutes be approved as read and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No. none. Wages for Police & Firemen - Longevi~ Pay - Waiving Statute of Limitations Delegates from the Police and Fire Departments appeared before the Commission in regard to longevity pay previously discussed at other meetings. Tabulation of a questionnaire mailed to all cities of the first and second class in Montana was presented. Answers received from eight cities showed that longevity pay was being paid by all of them except Glendive. From information reoeived by City Attorney Lovelace on the case recently tried in Billings. appeal of that case will soon be heard before the Supreme Court of Montana but the question to be settled conoerns the amount of salary on which longevity will be paid and will not concern the question of the starting date on which the longevity pay shall be based. It is the later question which is in dispute in Bozeman and it was pointed out that, unless the present policy of this City under which the longevity pay is effective from and after July 1, 1957 is changed, the only way to get answer to the contention of policemen and firemen that suoh pay should be based on the beginning date of employment I would be through court aotion filed against this City. An agreement, approved by the City Attorney, to waive the statute of limitations, for the Police Department was presented. It was moved by Commissioner Swanson. seconded by Commissioner Berg, that the agreement be approved and the Mayor and the Clerk of the Commission be authorized to sign the agreement for the Ci ~ of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Water Works Improvement Project John Morrison, President of Morrison-Maierle, Inc., was present to report on the status of work being done on the Waterworks Improvement Project. He stated that he had made personal investigation of complaints from land-owners regarding pipe laying work being done at this time by the Statewide Plumbing & Heating Co. and that, in his opinion, those complaints were not of serious nature and have been straightened out. He pointed out that, because of depth to which the ground is frozen, it is not possible at this time to segregate top soH when excavating trenches and to replace it on top of the baok-fill. He further stated that he considers it advantageous to the land-owners, to the City and to the contractor to have permitted the pipeleying to be continued and that his firm, as supervising engineers, will no~ approve the job for final settlement until topsoil has been replaced by the con- I tractor in the spring and all land across which trenching has been done is restored as nearly as is possible to its original condition. Parking on One Side of Streets A communication was read from DeBoer & Company stating they were in agreement with the City to limiting parking on one side of the following Streetsa East Story from Church to Tracy Avenue Black Avenue from Olive street to College Street Koch Street from Third Avenue to Eighth Avenue College Street from Black Avenue to Eighth Avenue Garfield Street from Willson to Sixth Avenue. The City Commission instructed the City Manager to procure the necessary signs to limit parking to one 'JS") t ( f..w side on these streets and to put such parking restrictions into effect at the earliest practicable date. Water Works Project -- Claim for Damages . Ford Brown A claim from F'ord Brown was presented in which he claimed damages in the amount of $5,000.00 to the 1957 hay crop and to his land and water rights by reason of interference with the irrigating ditch carrying water to his land where that ditch crosses land owned by the City of Bozeman at the site where Haggerty-Messmer Co. are constructing a new water reservoir for this City. The claim was I referred to Morrison-Maierle, Inc., Supervising Engineers on this water works project, and to Haggerty- Messmer Co. for their comment and recommendations. Renewal of Blanket Bond - City Employees The blanket bond covering all employees of the City of Bozeman. except those who have an individual bond, is up for renewal. The premium for one year is $135.00 and for three years is $337.50. The Manager was instructed to have the bond renewed on a three year basis. Water Works Improvement - Investment of Funds Of U. S. Treasury bills owned by the Water System Improvement Fund and maturing as of January 30, 1968, there will be approximately $80,000.00 more than is required to meet outstanding indebtedness of that fund at this time and such amount will therefore be available fur re-investm.ent. It was moved by Commissioner Swanson, seoonded by Commissioner Erw.i. n, that the Director of Finance be authorized to invest approximately $60.000.00 in 90-day U. S. Treasury Bills, due April 24. 1958, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Abandoning Parking Maintenance District No. 301 This was the time and place set for hearing protests to abandoning Parking Maintenance District I No. 301. Affidavit of Publioation of Notice was presented. There was no one present to protest and no protests having been filed, Resolution No. 880. abandoning said Maintenance District was presented, entitled: A RESOLUTIO:N OF' THE CITY COMMISSION OF' THE CITY 01<' BOZEMAN, MONTANA, ABANDONING CITY OF' BOZEl/.AN SPECIAL IMPROVEMENT DISTRICT NO. 301 AND ABANDONING THE MAINTENANCE OF STREET PARKINGS THEREUNDER, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED. AND puRSUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 879 AS PASSED AND AOOPl'ED BY SAID CITY COMMISSION ON THE 15TH DAY OF JANUARY, A. D. 1958. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting ~e being Mayor Erwin. Commissioner Swanson and Commissioner Berg; those voting No, none. Resolution No. 881 _ Intention to Abandon Meintena,nce District No. 117 The City Attorney, as instructed. has prepared a resolution of intention to abandon Parking Maintenance District No. 117, Tracy Avenue from Dickerson Street to College Street. Resolution No. 881 was presented. entitledt A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF' BOZEMAN, MONTANA. DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO ABANDON CITY OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 117 AND TO ABANDON THE MAINTENANCE OF STREET FARKINGS THEREUNDER. AND DIRECTING THE CLERK I OF THE CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION. ALL PURSUANT TO TEE STATUTES IN SUCH CASES MADE AND PROVIDED. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the resolution be passed and adopted, and February 19, 1958 be set as the date for the hearing of protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Report .
