The Commission of'the City of Bozeman met in regular session in the Commission Room, Ci~ Hall
Build ing, Thursday, February 13, 1958 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The follow-
ing prooeedings were had:
I Minutes of the last regular sesskn of February 5, 1958 were read and it was moved by Commissioner
Swanson, seoonded by Commissioner Berg, that the minutes be approved as read and the motion was carried
by the following Aye and No vote; those voting Aye being Mayor Erwin, Commissioner SWanson and
Commissioner Berg; those voting No, none.
Street Light -- Story Street between Tracy and Willson
A communication from Jaok E. Haynes, 501 South Tracy Avenue. was read, requesting that a street
light be plaoed on Story Street, at the alley between Willson Avenue and Tre.oy Avenue. He stated he
will reimburse the City for the oost of this light. It was moved by Commissioner Berg, seconded by
Commissioner Swanson, that the City Manager be authorized to have the Montana Power Company install a
light at this looation and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Erwin. Commissioner Swanson and Commissioner Berg; those voting No, none.
Reports
The following reports for the month of January, 1958 were presented:
Cemetery Board Water Colleotor
It was moved by Commissioner Swanson, seconded by Commissioner Berg. that the reports be accepted
and ordered filed, and the motion was oarried by the following Aye and No vote: those voting Aye
I being Mayor Erwin, Commissioner Swanson and Commissioner Eerg; those voting No, none.
Sale of Specia.l Improvement Bonds of Distriots 385, 386, 389, 390, 391, 393, 394, 395, 397 and 396
In order to have funds on hand from whioh to pay the Contractor for construotion as it progresses
as soon as weather oonditions permit in the spring. it is neoessary, in accordance with contracts which
have been made, to sell special improvement bonds for the following districts in the amount shown
opposite the number of each district:
Special Improvement District No. 385 - $ 5,000.00
" " " " 386 - 22,000.00
" " " " 389 - 42,000.00
" " II " 390 - 29,000.00
II " " " 391 - 33,000.00
II " " " 393 - 293,000 .00
II " " " 394 - 12,000.00
" " II II 395 - 34,000.00
" " " " 397 - 9,000.00
" " " " 398 - 103,000.00
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the Clerk of the
Commission be authorized to advertise bonds for sale as stated above, bids to be read and heard on
March 19, 1958. and the motion was carried by the following Aye and No vote: those voting Aye being
Ma.yor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Agreement to Sublet Special Improvement District Contraots
I A copy of 8 contract between McLaughlin, Inc. and Kiely Construction Company, under which McLaughlin,
Inc. sub-contracts to Kiely Construction Company the contracts awarded to McLaughlin. Inc. for construc-
tion in Special Improvement Districts Nos. 385, 386, 389, 390, 391 and 395. was presented.
The contract
was approved as to form by the Ci ~ Attorney. It was moved by Commissioner Berg, seconded by
Commissioner Swanson, that this contract be approved and that the Ci~ Manager be instructed to notify
the contracting parties of such approval and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Erwin, CommiSSioner Swanson and Commissioner Eerg; those voting No, none.
Resolution of Intention to Abandon Parking Maintenance District No. 50
The City Attorney, as instructed, has prepared a resolution of intention to abandon Parking

Maintenance District No. 50, Third Avenue from story Street to Cleveland street. Resolution No. 882
was presented entitled:
A RESOLUTION OF THE CITY COMMISSION OF' THE CITY OF' BOZEMAN, MONTANA, DECLARING IT TO BE THE
INTENTION OF SAID COMMISSION TO ABANDON CITY OF' BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 50
AND TO ABANDON THE MAINTENANCE OF STREET PARKINGS THEREUNDER, AND DIRECTING THE CLERK OF THE
CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION, ALL PURSUANT TO THE STATUTES IN SUCH
CASES MADE AND FROVIDED.
It ~as moved by Commissioner Swanson, seconded by Commissioner Berg, that the resolution be passed
and adopted and the 5th day of March, 1958 be set as the date for hearing protests, and the motion was I
carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Water Improvement Projeot - Claim of Ford Brown
A communication from Haggerty-Messmer Company, contractor on the Water Improvement Project, was
read stating they have received a copy of the claim of Ford Brown, filed with the City of Bozeman on
January 27th, 1958. The City Attorney was instructed to prepare a letter to Haggerty-Messmer Company
for the signature of the Mayor and the Clerk of the Commission citing the specifications and general
stipulations covering this matter and asking them to advise the City what action they desire the city
to take on the olaim of Ford Brown.
Doctor and Hospital Bill for Injury of Rampy Child
Doctor and hospital bills, in the amount of $92.35, resulting from injury to a child of R. L.
Rampy in Lindley Park, as presented by R. L. Rampy. were brought to the attention of the City
Commission.
The City Manager was instructed to forward these bills to the Claims Department of the General
Casual ty Company of America, the City's insurer on its blanket liability policy, f<?r further investiga-
tion and necessary action. I
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Swanson, seconded by Commissioner Berg, that the meeting adjourn and the motion was
carried by the following Aye and No vote; those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
