The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, February 19, 1958 at laOO o'clook P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, Oscar Cutting. City Attorney Lovelace and the Clerk. The following pro-
ceedings were had:
I Minutes of the last regular session of February 13, 1958 were read and it was moved by Commissioner
Berg, seconded by Commissioner Swanson, that the minutes be approved as read and the motion was carried
by the following Aye and No vote: those voting ~e being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Proposal to Create S. I. D. For Paving South Bozeman & Koch Street
City Engineer Liquin presented infonnation on an inquiry which had been sent to owners of properties
abutting on South Bozeman Avenue, between Koch and Story Streets, and on Koch Street, between Lindley
Place and Bozeman Avenue, as to their desires regarding paving these two blocks. From information
received from this inquiry, he proposed that these two blocks be set up as a single district and that
necessary steps be taken to establish a Special Improvement District to provide for paving these two
blocks.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City Engineer be
directed to prepare the necessary data and, based on this information, the City Attorney be instructed
to prepare a resolution of intention to create this district, and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg;
those voting No, none.
I Proposal to Create'S. I. D. For Paving West Arthur Street
Information was also presented regarding an inquiry which had been sent to owners of properties
abutting on West Arthur Street, between Willson and Third Avenues. From that information, City Engineer
Liquin recommended that two Special Improvement Districts be established, one to provide for paving on
West Arthur Street from Willson Avenue to Grand Avenue and one to provide for paving West Arthur Street
from Grand Avenue to Third Avenue, so that, if they deem it advisable, the City Commission may exercise
the prerogative.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City Engineer be
instructed to prepare the necessary data for these two districts, and based on this information, the
Ci~ Attorney be instructed to prepare a resolution of intention to create a special improvement district
to pave Arthur Street from Willson Avenue to Grand Avenue and a resolution of intention to create a

carried by the following Aye and. No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Reports
The following reports for the month of January, 1958 were presented:

It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the reports be accepted
and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Hearing - AbandorllUent of Parking Maintenance District No. 117
Resolution ~o. 883 - Abandoning Parking Maintenance District No. 117
This was the time and I-1ece set for the hearing of protests to the abandonment of Parking
Maintenance District No. 117, South Tracy Avenue from Dickerson to College Street. The affidavit of
publication of the Notice was presented. No one was present to protest and no protests have been filed.

Resolution No. 883 abandoning said district was presented, entitled;
A RESOLUTION OF THE CITY COMMISSION OF' THE CITY OF BOZEMAN, MONTANA. ABANDONING CITY OF
BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 117 AND ABANDONING THE MAINTENANCE OF' STREET
PARKINGS THEREUNDER, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED, AND PUR-
SUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 881 AS PASSED AND ADOPTED BY
SAID CITY COMMISSION ON THE 29TB DAY OF JANUARY, A. D. 1958.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the resolution be passed and
adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. I
National Guard to Display Equipment on Main Street
Major Frank Walcott and Captain Harold Fryslie of local units of the Montana National Guard were
present to request permission to display National Guard equipment on a portion of Main Street between
Tracy and Willson Avenue on F'ebruary 22nd. This display is to be in oonnection with celebrating
"Muster Day". The Commission approved this use of a portion of Main Street on February 22nd.
Recommendations of Planning Board
A letter from the Bozeman City-County Planning Board was read in whioh recommendations were made
regarding the following proposed sub-divisions, all of which are located outside but within three miles
of the city limits of Bozeman.
Lewis Addition. Steffanson Sub-division No.1 and No.2; Virginia Sub-division; Bridger Road
Sub-division Nos. 1, 2, 3 and 4.
No action was taken on these recommendations pending receipt of further information.
Water Improvement Project - Re: Communication to Haggerty-Messmer Co.
Claim of Ford Brown
The City Attorney, as instructed at the meeting of February 13th, 1958, presented and read a
proposed letter to Haggerty-Messmer Company regarding a claim submitted to the City by Ford Brown for I
damages to his land and crops allegedly caused by interference with an irrigating di toh serving that
property during construction of the new city reservoir. The letter was approved for signature by the
Mayor.
Lease and Contract to Purchase Standard Construction Company Yards
A lease agreement and contract for sale of real prolerty, described as all of Block 29 except
Lots 11 and 12 and all Block 30 of Imes Addition to Bozeman, between the Standard Construction Comfany
and The City of Bozeman was presented. The agreement was approved by the City Attorney.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the agreement be apfroved,
and the Mayor and the Clerk of the Commission be authorized to sign the agreement for the City of
Bozeman, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor
Erwin. Commissioner Swanson and Commissioner Berg; those voting No, none.
Water Improvement Project - Change Order Nos. 4, 5, 6, 7, 9, 10, 11 and 12
Change Orders Nos. 4, 5, 6, 7, 9. 10, 11 and 12. as recommended by the Consulting Engineers,
Morrison-Maierle, Inc. for work done by the Statewide PluIl.lbing & Heating Co., Inc. on the Water
Improvement P~ojeot. were presented. Action on these change orders was postponed pending further
investigation. I
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Berg, seconded by Commissioner Swanson, that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
