The Commission of the City of Bozeman met in regular session in the Commission Room. City Hall
Building, Wednesday, March 5, 1958 at 1;00 o'clock P. M. Present were Mayor Erwin. Commissioner
Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelaoe and the Clerk. The
following proceedings were had;
I Minutes of the last regular session of February 26, 1958 were read and it was moved by
Commissioner Swanson, seconded by Commissioner Berg, that the minutes be approved as read and the
motion was carried by the following Aye and No vote; those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting No. none.
Hearing - Abandonment of Maintenanoe Distriot No. 50
Resolution No. 887 - Abandoning Maintenance Distriot No. 50
This was the time and place set for hearing protests to the abandonment of Parking Maintenance
Distriot No. 50, parking maintenanoe on Third Avenue from Story to Cleveland Street. Affidavit of pub-
lication of Notice to owners was presented. No protests had been filed and no one was present to
protest. Resolution No. 887. abandoning Parking Maintenance District No. 5~was presented. entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ABANDONING CITY OF
BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 50 AND ABANDONING THE MAINTENANCE OF STREET
PARKINGS THEREUNDER, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED, AND PUR-
SUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 882 AS PASSED AND ADOPTED BY
SAID CITY COMMISSION ON THE 13TH DAY OF FEBRUARY, A. D. 1958.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the resolution be passed
and adopted and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Maintenance of Bridge on Main Street
I A communication from State Highway Engineer Fred Quinnell was read stating the State Highway
Department will participate in the cost of repair of the stone-arch bridge which covers Bozeman Creek
where it crosses Main Street (U. S. Highway No. 10) between Rouse and Bozeman Avenues. Highway
Department partioipation will be limited to repair of that part of the bridge between street curb lines
and the City will be responsible for any repair of the bridge on eaoh side between curb line and
prope rty line.
Investment of W. S. I. Funds
There will be $75,000.00 available for re-investment from the Water System Improvement Fund as
of March 6th. 1958. It was moved by Commissioner Swanson, seconded by Commissioner Berg. that the
Director of Finance be authorized to invest this $75,000.00 in 90-day U. S. Treasury Bills. and the
motion was carried by the following Aye and No vote; those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting No, none.

The Manager stated that he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman and recommends that warrants be drawn for their payment. After examina-
tion of the claims in detail by the City Commission and checking against the Claim Register, it was
moved by Commissioner Swanson, secondEid by Commissioner Berg, that the Claims be approved and warrants
issued for their payment, and the motion was carried by the following Aye and No votea those voting
Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Transfer of Rental Agreement - Parking Lot at Bozeman and Babcock I
A communication was read from Security Building Incorporated stating they have purchased the
property used as a parking lot at the corner of Bozeman and Babcock Street from the Eagles Lodge. and
they will continue the rental of this property to the City of Bozeman at $100.00 per month on a
month to month basis.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that this rental transfer
be approved and accepted and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Bridge in Alley Across Bozeman Creek in Block C. Original Townsite
The matter of the construction of a bridge across Bozeman Creek at the proposed alley in Block
C, Original Townsite, was further considered. The City Manager was instructed to have the plans and
specifications for this bridge brought up to date.
Preliminary Street & Storm Drainage Plans by Hoskins
Mr. C. H. Christophersen of Harold Hoskins and Associates was present and reviewed the preliminary
report of his company on proposed drainage and street improvements for the north part of the City.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the report, having
been found to be in accordance with the agreement dated July lOth, 1958. be ordered filed and accepted I.
as fulfilling this agreement and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.

Bids for Backhoe
Need for a Backhoe or Trenching Machine for use in the Water, Sanitary Sewer and Cemetery
Departments was reviewed. A trenching machine not to exceed one-half yard capacity, tractor-mounted,
and rubber tired with a loading bucket would serve the needs of these departments. It was moved by
Commissioner Berg, seconded by Commissioner Swanson, that the Clerk of the Commission be authorized
to advertise for bids tor such a machine, and the motion was carried by the following Aye and No vote: I
those voting Aye being Mayor Erwin. Commissioner Swanson and Commissioner Berg; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Swanson, seconded by Commissioner Berg, that the meeting adjourn and the motion was
carried by the following Aye and No votel those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
