The Commission of the City of Bozeman met in regular session in the Commission Room. City Hall
Building. Wednesday. March 12, 1958 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the C~rk. The
following prooeedings were had:
I Minutes of the last regular session of March 5, 1958 were read and it was m::>ved by Commissioner
Berg, seconded by Commissioner Swanson, that the minutes be approved as read and the motion was carried
by the following Aye and No votea those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Bids for Fluorine
Supply of sodium silicofluoride in the Water Department is running low and should be replenished.
It was moved by Commissioner Swanson, seconded by Commissioner Berg. that the Clerk of the Commission
be authorized to advertise for bids on a oarload of this material, and the motion was carried by the
following Aye and No vote: those Toting Aye being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none.
Request to Remove Curb for Parking
A oommunication from the Evangelical United Brethren Churoh. 909 West Olive, was read, requesting
that, when the streets in that area are paved this summer, there will be no ourbs built along their
property and that the street be paved up to the present sidewalk line so that this spaoe can be used
for diagonal parking. After consideration of traffic hazards that would be created by such construction
and the relatively small amount of parking space that would be gained, the City Manager was instructed
. .1 to advise them that the request is denied.
Request to Park Jet Plane on Main Street
A request from the Air Force Recruiting Service to use space on Main Street, May 1st, 1958, for
an informational display of a "Jet Plane" was reported. It was moved by Commissioner Swanson, seconded
by Commissioner Berg, that the request be granted, and the motion was oarried by the following Awe
and No vote: those voting ~e being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those
voting No, none.
Eleotrical Bonds - James McDonald & George B. Anderton
'Ihe electrical bonds of James McDonald and George B. Anderton were presented. The bonds were
approved as to form by the City Attorney. It was moved by Commissioner Berg, seconded by Commissioner
Swanson, that the bonds be approved and aocepted, and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting
No, none.
Lease of Lot - Mendenhall & Tracy - from Esgar Real Estate
A communication from Waite & Company proposing to lease the lot owned by Esgar Real Estate at the
corner of Mendenhall and Traoy Avenue to the City of Bozeman as a parking lot was read. A four year
I lease with payments of $26.00 per month is proposed.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the proposal be acceFted
and the City enter into an agreement covering suoh a proposed lease, and the motion was carried by the
following Ave and No votea those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none.
Request for Tire Business - Don Lock
Don Lock, distributor of B. F'. Goodrich tires. appeared before the Commission to solicit part of the
city tire business. He was informed that, at any time when the city plans to purchase any quantity of
tires, he will be given an oPFortunity to submit a bid price.

Cleveland Sub-Division Approved
A plat of the Cleveland Subdivision west of the City, adjoining the new Gallatin High Sohool tract,
was presented. The plat has been approved by the City.County Planning Board and was accompanied by
a deed to the Ci ty of Bozeman of Lot 12 of said subdivision. The deed to Lot 12 complies with the
requirements for park purposes.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the deed be accepted
and that the Direotor of Public Service be authorized to sign the plat and the motion was carried I
by the following Aye and No vote, those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Plat of Lewis Subdivision
A plat of the Lewis Subdivision southeast of the City, submitted by Dr. R. R.Renne, was presented.
After examination of the plat, it was decided that the plat was not acoeptable in its present form.
Airport Board to Negotiate for Purchase of Land
Mr. Tom Haggerty, representing Gallatin Field Board, was present to discuss long range planning
for Gallatin Field to include probable need for extending present runways. Gallatin Field Board
reoommends that the 160 aores of land which adjoins Gallatin Field on the north and whioh is owned by
the State of Montana be purchased. Mr. Haggerty asked approval for the Gallatin Field Board to
negotiate with the State Land Board for the purchase of this land.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that, subject to the con-
currence in such negotiations by the County Commissioners, Gallatin Field Board be and is hereby
authorized to proceed with these negotiations, and the motion was oarried by the following Aye and
No votea those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those
voting No, none. I

It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the reports be accepted
and ordered filed, end the motion was carried by the following qe and No votea those voting Aye
being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Order from Court Re: Clyde Latta Cae.
Ci ty Manager Henderson advised the Commiss ion that the District Court of the Eighteenth Judicial
District had, under date of March 5, 1958, rendered judgment in the Clyde Latta case and had in said
Judgment ordered that the Citu of Bozeman, acting by and through its Board of City Commissioners,
place on the Police Reserve List of the City of Bozeman, as of May 28, 1957, the name of Clyde M.
Latta.
City Manager Henderson further advised the City Commission that if Latta's name was not placed
upon the Police Reserve List as of the day following that on which he was last paid by the City, which
was January 25, 1957, his retirement pay under the statute would be considerably reduced. City I
Attorney Lovelace stated that he was sure that it was the intention of the Court's Judgment that Latta
receive full benefits under the Retirement Act, and he suggested that the action taken by the
Commission be to place Latta on the Reserve List as of the day following that on which he last drew
pay as an active police officer.
WHEREUPON, it was regularly moved by Commissioner Swanson and seconded by Commissioner Berg
that the name of Clyde M. Latta be placed upon the Police Reserve List of the City of' Bozeman, Montana,
as of January 26, 1967.
The motion was oarried, those voting "aye" being Mayor Erwin, Commissioner Swanson and

Adjournment
There being no furtler business to come before the Commission at this time, it was moved by
Commissioner Berg, seconded by Commissioner Swanson, that the meeting adjourn and the motion was
carried by the following Aye and No votea those voting Aye being Mayor Erwin, Commissioner Swanson
I and Commissioner Berg; those voting No, none.
