M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The following proceedings were had: Minutes of the last regular session of March 12, 1958 were read and it was moved by Commissioner I Berg, seoonded by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the following Aye and No votea those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Sale of Special Improvement Distriot Bonds The Mayor announced that this was the time and place set for sale of bonds of ten Special Improve- ment Districts. numbered 393, 398, 389, 395, 391, 390, 386, 394, 397, and 386. Affidavits of publica- tion of separate notice of sale of the bonds of each of the above numbered distriots were presented. It was explained that the bonds could not be sold at less than par and that the bidding must therefore be on the rate of interest at which the bonds would be purchased and might include an amount of premium which would be paid on the entire issue of bonds for anyone distriot. Cassidy Self Miss Bertha Clow Self Each of the bidders present qualified himself or herself by depositing bid securi~ with the Clerk of the Commission as required in the notices of sale of the bonds. No wri tten bids had been filed for any of the bonds to be sold. Mayor Erwin therefore announced that the Commission was ready to receive oral bids for the bonds of Special Improvement District No. ~ and three bidders prooeeded to bid. Mayor Erwin then announced that the Commission was ready to receive oral bids on bonds of Special Improvement District No. ~ end four bidders proceeded to bid. Mayor Erwin then announced that the Commission was ready to reoeive oral bids on bonds of Special Improvement District No. ~ and two bidders proceeded to bid. Mayor Erwin then announced that the Commission was ready to receive oral bids on bonds of Special Improvement District No. ~ and three bidders proceeded to bid. Report The report of the Director of Finance for the month of February, 1958 was presented. It was moved by Commissioner Swanson, seconded by Commdssioner Berg, that the report be accepted and ordered .101 filed, and the motion was carried by the following k.fe and No votea those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Request for Transfer of Beer License A request was presented from the V. F. W. Club to transfer their club license for sale of beer and liquor from 126 West Mendenhall to 240 East Main Street. It was moved by Commissioner Berg, I seconded by Commissioner Swanson. that, subject to approval of the Montana Liquor Control Board, the transfer be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. V. F. W. Poppy Day A request from the V. F. W. to sell "Buddy Poppies" on the street, May 17,1958, was reported. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the request be granted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Approval of Lewis Subdivision A plat of property owned by R. R. Renne, located southeast of the City, to be known as Lewis Subdivision was presented. The plat was accompanied by a deed to Gallatin County of Lot 9 for road purposes, and an agreement between R. R. and Mary Renne that, at such time as the balance of the forty acres is platted, sufficient area to comply with the requirement for park purposes will be deeded to the City. It was moved by Commissioner Swanson, seoonded by Commissioner Berg, that the plat be approved, and the Director of Public Service be authorized to sign the plat and the Mayor and the Clerk of the Commission be authorized to sign the agreement for the City of Bozeman, and the motion WaS I carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. The City Manager was instructed to inform the County Commissioners that it is the definite reoommendation of the City Commission that, when a road is established to extend west from the present end of Kagy Lane on the south line of Section 18, sufficient ground for right of way should be secured from the Valley View Golf Club so that the interseotion of that new road and the Sour Dough road will be at right angles. Public Hearing S. I. D. 403 Resolution No. 888 - Creating S. I. D. No. 403 This was the time and plaoe set for hearing protests to the creation of Special Improvement District No. 403, paving on Kooh Street and Bozeman Avenue. The affidavit of publication of the Notice was presented together with the Clerk's Mailing Certificate that all property owners have been notified. There was no one present to protest and, no protests having been filed, Resolution No. 888, oreating Special Improvement District No. 403, was presented, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMA!'l CREATING A SPECIAL IMFROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 403 OF THE CITY OF' BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON SOUTH BOZEMAN AVENUE FROM EACH KOCH STREET TO EAST STORY STREET AND ON EAST KOCH STREET FROM SOUTH BOZEMAN AVENUE TO I LINDLEY PLACE IN SAID CITY. It was moved by Commissioner Swanson, seoonded by Commissioner Berg, that the resolution be passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Public Hearing S. I. D. 401 This was the time and place set for public hearing on the creation of Special Improvement District No. 401, paving of Arthur Street from Willson to Grand Avenue. The affidavit of publication of the Notice was presented, together with the Clerk's Mailing Certificate that all propertlf owners have been notified. Written protests were presented representing owners of 41.66% of the property in the proposed district. ,\02 The Montana Statute relative to overruling the protests and establishing a district was reviewed by the City Attorney. After discussion, it was moved by Commissioner Berg, seconded by Commissioner Swanson, the the hearing be continued until the next regular meeting of the City Commission, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin. Commissioner Swanson and Commissioner Berg; those voting No, none. Public Hearing S. I. D. 402 I This was the time and place set for public hearing on the creation of Special Improvement District No. 402, paving of Arthur Street from Grand Avenue to Third Avenue. The affidavit of publica- tion of the Notice was presented, together with the Clerk's Mailing Certificate that all property owners have been notified. Written protests were presented representing owners of 49.15% of the property in the proposed district. It was moved by Commissioner Swanson, seconded by Comnissioner Berg, that the hearing be continued until the next regular meeting of the City Commission and the motion was carried by the following Aye and No vote: those voting ~e being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
