The Commission of the City of Bozeman met in regular seasion in the Commission Room, City Hall
Building, Wednesday, April 2. 1958 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The
following proceedings were had:
Minutes of the last regular session of March 26, 1958 were read and it was moved by Commissioner I
Swanson, seconded by Commissioner Berg, that the minutes be approved as read and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Bids for Back-hoe
This was the time and p~ce set for opening bids for a Tractor mounted Back-hoe and Front-end
Loader to be used in various city departments. Affidavit of publication of Notice to Bidders was
presented. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the bids be
opened and read and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.

The bids were referred to the City Engineer and the Water Superintendent for tabulation and
recommendations.
Codifying City Ordinances
Mr. E. S. Midd1emist, of Sterling Codifiers, Weisner, Idaho, was present and explained their
codifYing proposal on ordinances of the City of Bozeman. He estimated the cost to be $4,602.68 and an I
annual charge of 10% of the cost of codifying to keep the codes up-to-date.
Hearing - Special Improvement District No. 401
PubliC hearing on establishing Special Improvement District No. 401, as proposed in Commission
Resolution No. 884, which had been adjourned until this date, was re-opened. The written withdrawal
of protest representing 8.33% of the property in the proposed district was presented. Protests in th is
district now total 33.33% of the property. It was moved by Commissioner Berg, seconded by Commissioner
Swanson, that the protests be overruled as insufficient. and the City Attorney be instructed to prepare
a resolution to create said district and the motion was carried by the following Aye and No vote: those

voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Hearing - Special Improvement District No. 402
Public hearing on establishing Special Improvement District No. 402 as proposed in Commission
Resolution No. 885, which had been adjourned until this date, was re-opened. It was deemed advisable by
the City Commission to further adjourn this hearing, whereupon, it was moved by Commissioner Swanson,
seconded by Commissioner Berg, that the hearing be adjourned until April 9. 1958. and the motion was
I carried by the following Alfe and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Resolution No. 889 -- Intention to Abandon Parking Maintenance No. 189
The City Attorney as instructed has prepared a resolution of intention to abandon Parking
Maintenance District No. 189, east side of Grand Avenue from College Street to Arthur Street.

A RESOLUTION OF' THE CITY COMMISSION OF THE CITY OF BOZEMAN. MONTANA, DECLARING IT TO BE THE
INTENTION OF' SAID COMMISSION TO ABANDON CITY OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 189
AND TO ABANDON THE MAINTENANCE OF STREET PARKINGS THEREUNDER, AND DIRECTING THE CIERK OF THE
CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION, ALL PURSUANT 10 THE STATUTES IN SUCH CASES
MADE AND PROVIDED.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the resolution be passed
and adopted, and April 23rd, 1958 be set as the date for hearing protests and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none.
Bids for Fluorine
This was the time and place set for opening of bids on a 40,000 lb. carload of sodium silico
Fluoride for the Water Department. Affidavit of publication of the Notice was presented. No bids have
I been received or filed. It was moved by Commissioner Berg, seconded by Commiss ioner Swanson, that the
City Manager be authorized to negotiate for purchase of this material on the open market from producers
or wholesalers and, subject to approval of the City Commission, to make such purchase at the best quoted
price and the mo-tion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner Swanson and Commissioner Berg; those voting No, none.

The Manager stated that he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman and reoommends that warrants be issued for their payment. After examination
of the claims in detail by the City Commission, and checking against the claim register, it was moved
by Commissioner Swanson, seconded by Commissioner Berg, that the claims be approved and warrants issued
for their payment. and the motion was carried by the following Aye and No vote: those voting Aye beine;
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.

Examination of Depository Bonds
The City Commission proceeded to check the Custodian Receipts of Depository Securities held by
the Director of Finance to cover the City's deposits in the various city banks. It was moved by I
Commissioner Swanson, seconded by Commissioner Berg, that the list be approved and accepted, and set
forth in full in the minutes of this meeting, and the motion was carried by the following Aye and No

Widening of South Willson Avenue
The widening of South Willson Avenue from Cleveland Street to Garfield Street was considered.
The City Engineer was instructed to prepare estimates of costs for this proposed improvement. I
Master Plumber's Bond - A. Stapleton
Master Plumber's Bond of A. Stapleton in the amount of $500.00 was presented. The bond was
approved as to form by the C1 ty Attorney. It was moved by Commissioner Berg, seoonded by Commissioner
Swanson, that the bond be approved and aocepted and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor ErwinJ Commissioner Swanson and Commissioner Berg; those voting
NOJ none.
Investment of Cemetery Permanent Care Funds
There is approximately $40,000.00 of Cemetery Permanent Care funds available for investment or

re- investment. Sreda! Improvement District Bonds of the City of Bozeman are available for purchase
at this time. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the Director
of Finance be authorized to invest approximately $40.000.00 of Cemetery Permanent Care funds in Special
Improvement District Bonds of this City and the motion was carried by the fbllowing Aye and No vote:

Recreation Direotor~hite to Attend Conference in Portland
I A meeting of the Northwest District Health and Physical Education Association will be held in
Portland. Oregon, April 20th to 27th. School District No. 7 has approved the attendance of A. Glen
White, Recreational Director, at this meeting and will pay one-half or $75.00 of his expenses. It
was moved by Commissioner Berg, seconded by Commissioner Swanson, that the Recreational Director, A.
Glen White, be authorized to attend this meeting and one-half of his expenses, not to exoeed $75.00,
be paid by the City of Bozeman from the Park Fund and the motion was carried ~ the following Aye and
No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting
No, none.
Meeting of Property Owners in Area "Cft
Interested owners of property in the area between Mendenhall and Peach Streets and between Grand
and Rouse Avenues. described as Area tIC" in the Hoskins' report of March 5, 1958, have requested to
meet with City officials to discuss possible street improvements in this area. It is proposed to hold
this meeting in the court roam of the City Hall at 7,30 P. M. on Tuesday, Afril 8, 1958.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Berg, seoonded by Commissioner Swanson, that the meeting adjourn and the motion was
