M. Present were Mayor Erwin, Commissioner ; . Swanson, Commissioner Berg, City Manager Henderson, Ci~ Attorney Lovelace and the Clerk. The , following proceedings were had: . Minutes of the last regular session of April 2, 1958 were read and it was moved by Commissioner I Berg, seoonded by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye"being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. . Widening South Willson Avenue An estimate of cost and amount of work which would be involved in widening South Willson Avenue from Cleveland Street to Garfield Street. as prepared by the City Engineer. was presented. It was eXl-lained that a portion of this work could be done by the City on "force account" as a safety and maintenance measure. After consideration, the City Manager was authorized to negotiate with owners of property along this part of South Willson Avenue to work out a proposal under which this widening project can be undertaken as a joint ~roject of the proper~ owners and the City. Ordinance No. 804 To Vacate McAdow Ave., Main to Babcock Upon petition of Lillie Warwood and others, the City Commission, on October 9, 1957, adopted Resolution No. 869 declaring its intention to vacate McAdow Avenue between Main Street and Babcock Street and setting October 16, 1957 as the date for hearing on that resolution. At the hearing on this matter, held on October 16, 1957, a letter was presented from the Bozeman City-County Planning Board recommending that action in this matter be deferred pending further development of the master I plan for this city then being prepared by S. H. DeBoer & Co. The matter has again been brought up because of new paving on Babcock Street which is to be started very soon and which would be affected at the intersection of McAdow Avenue. MrS. Lillie Warwood, owner of the property on both sides of the section of McAdow in question, was present and reviewed reasons for vaoating this street. The Bozeman City-County Planning Board. at their meeting on April 7, 1958, again recommended against the fro- posed closing. A telegram from S. R. DeBoer also recommended against the proposal unless, at the same time. a 90 foot right-of-way is secured to the east of McAdow Street for an arterial street to extend south from Main Street. Having considered all phases of this proposal, Ordinance No. 804 was presented, the title of which ordinance is as follows: AN ORDINANCE OF' THE CITY OF BOZEMAN. MONTANA VACATINC A PORTION OF' McADOW AVENUE IN SAID CITY OF BOZEMAN. MONTANA. It was moved by Commissioner Berg, seconded by Mayor Erwin, that this ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and COlrunissioner Berg and those voting No. Commissioner Swanson. Rel-orts I The following reports for the month of March, 1958 were presented: police Judge police Chief Cemetery Board It waS moved by Commissioner Swanson, seconded by Commissioner Berg, that the reports be accepted and ordered filed. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Resolution A~proving Street Planning by Hoskins & Associates The following proposed Resolution approving report submitted by Harold Hoskins and Associates on March 5. 1958 as preliminary planning and estimates of cost of street improvements in areas of this .111 - City north of Main Street was read: "Whereas, The City of Bozeman, Montana accepted an offer from the United States Government for an advance for preparation of planning documents pertaining to a public work described as Proposed construction of street improvements ,in said City of Bozeman as described in detail in application, as modified, accepted by Housing and Home Finance Agency June 10, 1957; and Whereas, Harold Hoskins and Associates were engaged to prepare the planning documents for the aforesaid public work, wnd said architect and/or engineer has completed the documents . and submitted them for approval; and I Whereas, the completed planning documents have been carefully studied and are considered to comprise adequate planning of the public.work essential to the community and within the financial ability of The City of Bozeman, Montana to construct; Now, therefore, be it resolved by The City Commission, the governing body of said applicant, tha t the planning documents submitted by Harold Hoskins and Associates as the basis for preliminary planning of the Street Improvements in The City of Bozeman, M9ntana dated March 5, 1958, in connection with Housing and Home Finance Agency Project No. Montana 24-P-30l0 be and the same are hereby approved; and that certified copies of this resolution be filed with the Housing and Home Finance Agency." . It was moved by Commissioner Berg, seconded by Commissioner Swanson. that this resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye bein,; Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Contract for Engineering Servioes - Morrison & Maierle, Inc. An agreement between the City of Bozeman, Bozeman Deaconess Hospital Board and Morrison-Maierle, Inc., whereby said engineering firm would be employed to prepare a report for furnishing water to an area owned by the Bozeman Deaconess Hospital Board in the southeast part of the City. the actual cost of report not to exceed $500.00. was presented. The Agreement was approved es to form by the City Attorney. It was moved by Commissioner Swanson, seconded by Commissioner Berg. that the agreement be approved and the Mayor and the Clerk of the Commission be authorized to sign it for the City of Bozeman I and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No. none. Report of Morrison-Maierle, Inc. -- Water Line to Serve Hospital Tract John Morrison and Harvey Taylor of Morrison-Maierle, Inc. and Ed. Stephenson and W. G. Wal ter, representing the Bozeman Deaconess Hospital Board, were present to discuss the proposal for the installation of a water main to serve the area in the southeast part oi' the City now owned by Bozeman Deaconess Hospital. A map showing proposed general layout of water mains and estimated pressures was presented and explained. Estimates of cost were given as follows: Installation of a l4-inch water main from the City's main sUPfly line to the southwest corner of the tract . . . . . . . . . . . $41.600.00 Installation of water mains as proposed in the tract including the above 14-inch header . . . . . . . . . . . . . . . $178,000.00 Peti tion to Abandon Parking Maintenance District No. 57 A petition of property owners requesting that Parking Ma intenance District No. 57, Cleveland Street between Willson Avenue and Seventh Avenue, be abandoned was presented. It was moved by Commissioner Swanson. seconded by Commissioner Berg, that the City Attorney be instructed to prepare a resolution of intention to abandon said district, and the motion was carried by the following Aye and I No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Petition to Abandon Parking Maintenance Distriot Ko. 114 A petition of property owners requesting that Parking Maintenance District No. 114. west side of Grand Avenue from College Street to Arthur Street, be abandoned was presented. It was moved by Commiss ioner Berg, seconded b Commissioner Swanson. that the City Attorney be instructed to prepare a resolution of intention to abandon said district, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. ,112 Petition for S. I. D. on South ~~urth A petition representing 81.9% of the property requesting that a special improvement district be established for paving South Fourth Avenue from Grant Street to Lincoln was presented. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Engineer prepare the necessary data and the City Attorney be instructed to prepare a resolution of intention to create this proposed district, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. D. on West Alderson A petition representing 66.7% of the property requesting that a special improvement district be established for paving; West Alderson Street from Fourteenth to Fifteenth Avenue was presented. It was m)ved by Commissioner Berg, seconded by Commissioner Swanson, that the City Engineer prepare the necessary data and the City Attorney be instructed to prepare a resolution of intention to create this proposed district and the motion was carried by the following Aye and No vote: thos e vot ing Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Resolution No. 890 - Creating S. I. D. No. 401 The City Attorney, as instructed, has prepared the resolution creating Special Improvement District No. 401, paving on Arthur Street from Willson to Grand Avenue. Resolution No. 890 was presented, entitled: A RESOLUTION OF THE CITY COMlv'iISSION OF TEE CITY OF BOZEMAN CREATING A SPECIAL IMFROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 401 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF' CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON WEST ARTHUR STREET FROM SOUTH WILLSON TO SOUTH GRAND AVENUE IN SAID CITY. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye I being Mayor Erwin, Commissioner Swanson and Conunissioner Berg; those voting No, none. Hoskins to Prepare Specifications for S. I. D. #401 It was moved by Comm.iss ioner Swanson, seconded by Commiss ioner Berg, that the City Manager be authorized to engage Harold Hoskins & Associates to prepare the plans and specifications for Special Improvement District No. 401, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Hearing - S. I. D. #402 Public hearing on proposed creation of Special Improvement District No. 402. adjourned until this date, was re-opened. Viri tten protests have been filed by owners of 49.15% of the property in this proposed district. It was moved by Commissioner Swanson, seconded by Mayor Erwin, that the protests be sustained and declared sufficient and that further action in the matter cease and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Co~.issioner Swanson; those voting No, Commissioner Berg. Change Order _ Special Improvement District No. 390 A communication was read from Harold Hoskins and Associates recommending that a change order be I issued for Special Improvement District No. 390 to eliminate excavation and base gravel fill on Cypress Avenue from Main Street to Babcock Street. This street section has previously been excavated and filled with base gravel. It was moved by Commissioner Berg, seconded by Commissioner Swanson. that such a change order be issued and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Bids for Tractor Mounted Backhoe and Loader The City Engineer re~orted on his investigation of bids for a tractor mounted backhoe and loader .11a received on April 2, 1958. He recommended that action on these bids be deferred until the next regular meeting to permit further investigation. Folice Officer to FBI School Discussed The matter of attendance of a Police Officer at the National FBI Academy has been discussed at two previous Commission meetings. I Chief Haas was then directed to make definite recommendation as to whether or not to send a Policeman to this school and, if he did recommend sending one, then his recommendation should name the officer he would propose to send. His letter of'recommendation dated April 9, 1958 was taken up with the Commission on this date. Expense of sending Captain Saunders to this school in 1952 was $1,531.49. It is estima. ted that. because of increase in salary rates and other increased costs, to send a man there now would cost somewhere between $2,000.00 and $2,500.00. After these 3 different discussion of the matter, the City Commission decided that, until it was possible to replace the lost man-hours brought about by legislation which became effective July 1, 1957, which legislation gave extra pay and shorter hours to policemen, it would be unwise to make this approximate iz,ooo.OO expenditure. It was, therefore. decided that this City will not send a man to the FBI school during the current fiscal year. Police Schools Announcement was made of the following Police Schools to be held in the near future: Traffic School in Spokane, Washington in June, 1958 Law Enforcement Conference in Helena, Montana in May, 1958. Decision to send a delegate to either of these schools was postponed until a later date.
