The Commission of the City of Bozeman met in regular session in the Commission Room. City Hall
Building, Wednesday, April 16, 1958 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson. City Manager Henderson, City Attorney Lovelace and the Clerk. The following prooeedings
were had:
Minutes of the lest regular session of April 9, 1958 were read and it was moved by Commissioner I
Swanson, seconded by Mayor Erwin, that the minutes be approved as read and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those
voting No, none.
Plan for Tourist Court
iLr. Ott Tschache presented a plan for a trailer court which he proposes to locate on Lots 6 to
15 in Block 3 of North Seventh Addition. This block has a T-shaped alley and he asked permiss ion to
park trailers acrosS that part of the alley that runs east and west. The plan was left with the
Ci ty for study.
Cleaning Streets in Business District
Mr. Ott Tschache, as chairman of the Retail Merchants Committee of the Chamber of Commerce,
requested a schedule of cleaning streets in the business district which could be sent to members of
this organization and thereby eliminate phone calls and confusion regarding street cleaning. It
was explained that a rigid schedule would be impossible to follow because of weather conditions but
that procedure explained and agreed upon with a committee from the Chamber of Commerce, representing
Main Street business men and recorded in the minutes of the meeting of the City Commission held on
November 13, 1957 is being followed as closely as practical. I

American Legion/Poppy Day
Auxiliary
A written request from the American Legion/to sell poppies on the streets Saturday, May 24,
1958, was presented. It was moved by Commissioner Swanson, seconded by Mayor Erwin, that this request
be granted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor
Erwin and Commissioner Swanson; those voting No, none.
Bids for Tractor-mounted Backhoe and .F'ront-end Loader
Recommendations from the City Engineer, Water Superintendent and his assistant for the acceptance
of the bid for a Backhoe received on April 2, 1958 were as follows a
That Bid #3 of the Owenhouse Hardware Company for an International, Model 330
Tractor, with a No. 185 Davis Backhoe at $4,948.50 but with substitution of a
No. 210 Davis Backhoe for the No. 185 and a 24" bucket for the 20" bucket as
bid at an additional cost of not to exceed $601.00 and including hydraulio
power steering on the tractor at an additional cost of not to exceed ~245.00,
to make the total cost of the unit as recommended to be $5,794.50, is the best
of bids received.
It W8.S moved by Mayor Erwin, seconded by Commissioner Swanson, that this recommendation be
accepted and that the bid be awarded to the Owenhouse Hardware Company in accordance therewith and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and
Commissioner Swanson; those voting No, none. I
Amendments to Hoskins' Refort for Street Improvements North of Main Street
A letter from H. Hoskins and Associates was presented which proposed certain amendments to their
report of March 5, 1958 relative to possible improvements of streets north of Main Street. These
amendments would make some changes in boundaries of Drainage Areas "B" and "e" as shown in the March
5th retort and of the storm sewer to be installed in each area. After detailed explanation of the
proposed amendments, it was moved by Commissioner Swanson, seconded by Mayor Erwin, tta t, insofar as
it applied to Drainage Area "B", the amendment be apfNved and that, insofar as it applied to Drainage
Area "C". action on the amendment be deferred pending further study and the motion was carried by the

Resolution Creating S. I. D. No. 404
The City Attorney, as instructed, has prepared the resolution of intention to create Special
Improvement District No. 404, paving of South F'ourth Avenue from Grant to Lincoln Street. Resolution
No. 892 was presented, entitled:

adopted and May 7, 1958 be set as the date for hearing protests and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those
voting No, none.
Resolution No. 893 - Intention to Abandon Maintenance District 57
The City Attorney as instructed has prepared the resolution of intention to abandon Parking
Maintenance District No. 57, Cleveland Street from Willson Avenue to Seventh Avenue. Resolution No.
893 was presented, entitled:

Rel-ort of City-County Plan Board Meeting
Recommendations from the City-County Plan Board meeting of April 7, 1958 were read relative to
the following proposed sub-divisions I

Action on the subdivisions was delayed until after another meeting of the Plan Board to be held
on April 21, 1956.
Commissioner Berg Entered and Was Noted Present
~etition to Abandon Maintenanoe District No. 48
A peti tion representing 47% of the property in Parking; Maintenance Distriot No. 48, South Eighth
Avenue from Main Street to Koch Street. requesting that said district be abandoned was presented.
Because clean-up work for the 1956 season has started in this district and South Eighth Avenue is I
comprised of three separate districts. action on the petition was deferred until after the 1956 season.
Mayor Erwin Asked to be Excused and Permission was Granted
Clearing Title - Cleveland Sub-Division
Ci ty Attorney Lovelace reported that title to land recently platted '6.# Olev~land Sub-division,
abutting Gallatin High School ground west of the City, has been found to be deficient. Miss Vivian
Canfield, who had this ground platted, deeded Lot No. 12 of the tract to the City for pe.rk purposes.
She now proposes to bring action to quiet title to the tract and it would be practical to include Lot
12 in that action. In order to accomplish this, it would be necessary to deed this lot back to Miss
Canfield and have her redeed it to the City when the quiet title action is completed.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that, conditioned on Miss
Canfield executing a new deed to the above described lot to the City of Bozeman, which deed will be
held in escrow until the quiet title action is completed, the Mayor and Clerk of the Commission be and
are hereby authorized to sign a deed to Miss Canfield for the said Lot 12 of Cl.evel'and Sub-division
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Swanson and Commissioner Berg; those voting No, none.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Berg. seconded by Commissioner Swanson, that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Swanson and Commissioner
