April 23, 1958 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson. Ci~ Manager Henderson, City Attorney Lovelace and the Clerk. The following proceedings were had: I Minutes of the last regular session of April 16, 1958 were read and it was moved by Commissioner Swanson. seconded by Mayor Erwin. the t the minutes be approved as reed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No. none. Communication - Construction of Women's Dormitory A communication from Martin Whalen, Superintendent of Physical Plant. Montana State College. was read stating that location of the proposed new Women's Dormitory at Montana State College will be on Block 12 of Capitol Hill Addition. After discussion. the City Manager was instructed to ask for a ground plat of this building location and to secure information as to what Frovisions. if any. are planned for off-street parking. Petition for Paving Story Street from 14th to 15th A peti tion representing 76% of the property in a proposed special improvement district to pave Story Street between Fourteenth and Fifteenth Avenues was presented. It was moved by Mayor Erwin, seconded by Commissioner Swanson. that the streets of Alderson, Dickerson and Story between Fourteenth and Fifteenth be included in one special improvement District and that the City Attorney be instructed to prepare a resolution of intention to create this district I and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No. none. Commissioner Berg entered and was noted Present Petition to Pave on Dell Place A peti tion representing 78% of the property. requesting that a special improvement district be created to pave Dell Place from East Story Street. south 520 feet, was presented. It was moved by Commissioner Swanson, seconded by Commissioner Berg. that the Ci ty Engineer prepare the necessary data and, based on this data, the City Attorney be instructed to prepare a resolution of intention to create the district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Hearing Abandoning of Parking Maintenance District 189 Resolution No. 891 - Abandoning Parking Maintenance District No. 189 this was the time and place set for hearing protests on abandoning Parking Maintenance District No. 189. east side of Grand Avenue from College Street to Arthur Street. The affidavit of publication of the Notice was presented. No one was present to protest, and no protests have been filed. Resolution No. 891, abandoning said Maintenance District No. 189, was presented, entitled: I A RESOLUTION OF' THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ABANDONING CITY OF BOZEMAl\ SPECIAL IMPROVEMENT DISTRICT NO. 189 AND ABANDONlNG THE MAINTENANCE OF' STREET PARKINGS THEREUNDER, PURSUANT TO THE STATUTES IN SUCH CASES NiADE AND FROVIDED, AND PUR- SUANT TO .AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 889 AS PASSED AND ADOPTED BY SAID CITY COMMISSION ON THE 2ND DAY OF APRIL, A. D. 1958. It was moved by Commissioner Berg. secanded by Commissioner Swanson. tha t the resol ution be passed and adopted. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Temporary Use of Alley - Block 3, North Seventh Addition Afproved Plans for a Trailer Court, and temporary use of the east-west alley in Block 3, Nortt Seventh Addition. as requested by Ott Tschache at the meeting of April 16th. 1958, were reviewed. After ,118 discussion. it was moved by Commissioner Swanson, seconded by Commissioner Berg, that temporary use of the alley be permitted with the following provisions: 1. That no permanent structure be placed on the alley. 2. That underground installations may at any time be required to be discontinued upon notice from the City, end the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. I Requirements for Park Purposes Neces~ary in Virginia Sub-division 2 miles A proposed plat of an area approximately/east of the City, to be known as the Virginia Sub- division, was presented. There was no property set aside or dedicated for park purposes. This proposed addition is within the boundaries of the area of the Master Plan for the City as recommended bJ the City-County Plennin~ Board. The City Commission, after consideration of the flat. stated that all platting within the Master Plan area should be required to set aside the required area for park purposes and the City Manager was instructed not to approve this plat as now presented. Water Line to Serve Sub-division West of City Hal Bolinger, Attorney. representing Marguerite Kirk. owner of the Kirk Sub-di vision. appeared before the Commission to ask if there is a possibility that the City Commission would change its policy regarding furnishing city water to sub-divisions outside the City. He stated that, unless City water can be furnished to the Kirk Sub-division. a private water system to serve the area will have to be installed. He also asked that if a water main was installed to serve this sub-division that an agreement be entered into providing that properties connecting with the water main in the future would have to pay their proportionate share of the cost of the water main installation. Mr. Bolinger further requested that a plan be worke:loutso that, if and when this property and other Kirk property I came into the city, the land along the highway be designated as a business zone. Mr. Bol inger wes informed that, i.f the Kirk property together with other properties in this area was brought into the City, water could be furnished under the present policy and that it will be necessary to have an engineering study made to determine the size of water main and laterals to serve the area and this study would be made. Mr. Bolinger was also informed that the Commission favored controlled zoning of the area. Coounission Swanson asked to be Excused and Permission waS Granted Plumber's & Gas Fitter's Bonds The Master Plumber's and Gas Fitter's bonds of James S. Croxton were presented. The bonds were approved as to form by the City Attorney. It was moved by Commissioner Berg, seconded by Mayor Erwin, that the bonds be au-,roved and accepted and the motion was carried b;y the following Aye and No vote: those voting Aye being Mev or Erwin and Commissioner Berg; those voting No, none. Connecting 14-inch Water Main at Black & College Original plans of Morrison-Maierle. Inc. showed that both the new, 24" water supply line and the existing 14" extension of the existing IS" supply line woule. be connected to the City's distribu- I ti.on system at Black Avenue and College Street. Subsequent change in those plans, which had never been officially HPIroved by the City, showed that the existing 14" line would be connected to the new 24" line at a point apFroximately 600' north of the line of Garfield Street and thet the 14" line between that connection and College Street, a distance of aH-roximately 900 feet, would be abandoned. Review of this revised flen shows that the 14" line was cut ofi and dead-ended at College Street last fall when the 24" line was installed and that, since that time and until water is actually brought in throut;h the 24" line. all the water coming into the City from the south side is what is fed into the 12" 1 ine on Gerfiel d Street. It further indicates that the 14" line should be re-connected to .ll!} the distribution system at College Street. John Morrison was present to discuss this situat:ion. It was moved by Co~~issioner Berg, seconded by Meyor ~rwin. that the City Manager issue authoriza- tion to the Entineers to have the contractor make this cormection with the least possible delay and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Berg; thos e voting No, none. I Policemen to Attend Attorney General's Conference A. N. Haas, Chief of Police, was present and recommended that one member of the Police Department be authorized to attend the Attorney General's Conference in Helena on May 1, 2 and 3, 1958. It was moved by Commissioner Berg. seconded by Mayor Erwin, that attendance by a Folice Officer at this conference be authorized and his expenses be paid from the General Fund and that selection of the officer be on recommendation of Chief Haas and subject to approval of the City Manager and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Berg; those voting No, none. Relair to Building at ll2 West Main Disapproved The small building at 112 W. Main Street, occupied by Gillespie's Shoe ReraiI' Shop. was damaged by fire on April 18, 1958. Investigation shows that the amount of damage is more than 50% of the value of the buildinG and it cannot be repaired to meet construction requirements for fire protection at this location. It was moved by Commissioner Berg, seconded by Mayor Erwin, that any applications for ref-air, reconstruction or re-wiring of this building be denied and that the owners of the building be notified of this action and the motion was carried by the following Aye and No vote: those voting Aye being I Mayor Erwin and Commissioner Berg; those voting No. none.
