Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Attorney Lovelace, Ci~ Engineer Liquin and the Clerk. The following prooeedings were had: Minutes of the last regular session of April 23, 1958 were read, and it was moved by Commissioner I Berg. seconded by Commissioner Swanson that the minutes be approved as read, and the motion was carried by the following Aye and No votea those voting ~e being Mayor Erwin, Commissioner Swanson and Co~ missioner Berg; those Toting No, none. Hearing - Abandonment of Parking Maintenanoe District No. 57 Resolution No. 895 - Abandoning Parking Maintenance District No. 57 This was the time and place set for hearjng protests to abandonment of parking Maintenance Distriot No. 57, Cleveland Street from Willson Avenue to Seventh Avenue. Affidavit of publioation of Notice was presented. No one was present to protest and no protests have been filed. Resolution No. 895, abandon- ing said maintenance district was presented, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ABANDONING CITY OF BOZEMAN SPEX:IAL IMPROVEMENT DISTRICT NO. 57 AND ABANDONING THE MAINTENANCE OF STREET PARK- INGS THEREUNDER, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED, AND PURSUANT TO AND D1 CONFORMITY WITH COMMISSION RESOLUTION NO. 893 AS PASSED AND ADOPTED BY SAID CITY COMMISSION ON THE 16TH DAY OF APRIL A.D. 1958. (Motion inadvertently omitted. See motion at bottom of this page) Hearing - Abandonment of Farking Maintenance District No. 114 Resolution No. 896 - Abandoning Parking Maintenance District No. 114 This was the time and place set for hearing protests to abandonment of Parking Maintenance Distriot No. 114, west side of Grand Avenue from College Street~ Arthur Street. Affidavit of publ ica tion 0 f the Notice was presented. No one was present to protest and no protests have been filed. Librarian & Assistant to Attend Library Meeting In Billings A written request from Margaret Hileman, Librarian, was read, requesting permission for Katherine Fisher, Assistant Librarian, and herself to attend the Montana Library Association meeting 1n Billings, May 2, 3, and 4. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the request be approved and their expenses be paid from the Library Fund and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting, llo, none. Plumber's License Bond - Geo Wellhouser Plumber's License Bond of George Wellhouser, in the amount of $500.00 was presented. The bond was I approved as to form by the City Attorney. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the bond be approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye being Kayar Erwin, Commissioner Swanson and Commissioner Berg; those vcting No, non.e. Motion - Adoption of Resolution No. 895. It was moved by Commissioner Swanson, seconded by Commissioner Berg that Resolution No. 895 be passed and adopted, and the motion was carried by the following Aye and No vote; those voting ~e being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. - 1')1 . . ,,---.- Platting of Virginia Sub-division Mr. Steve Doornbos and H. B. Landoe were present in the interest of the platting of the Virginia Subdivision, a tract of less than ten acres lying east of the Ci~. Discussion was had regarding dedi- cation of an area for park purposes. After disoussion, it was agreed, that an agreement signed by Steve Doornbos stating that the required area for park purposes for all the property would be dedicated when I the remaining portion of the property is platted and this said agreement would be subordinate to any mortgage on the property. Off Street Parking for New Women's Dormitory A communication from Martin Whalen. Physical Plant Superintendent, M.S.C., was read stating no pro- vision is being made for Off Street Parking in connection with the new dormitory to be constructed on Block 12, Ca,pi tol Hill Addition. The communication was Bccompanied with a ground plan of the new build- ing. After consideration, it was directed that Montana State !College be informed the. t oft-street parking should be provided at this new dormitory as provided in Ordinance No. 787. Aid for Traffio Signals at Seventh & Eighth at Main Street A communication from Fred Quinnell, Jr., State Highway Engineer, was read stating that the State will participate in cost by furnishing preliminary and construction engineering for the installation of traffic control signals at Seventh and Main Street and Eighth Avenue and Main Street provided that the City furnishes 43% of the total cost of the project. This project is contingent upon the approval of the Bureau of Public Roads. It was moved by Commissioner Swanson. seconded by Commissioner Berg, that the City Manager be author- ized to inform the State Highway Commission of their approval of this installation on the above plan and I the motion was carried by the following Aye and No vote; those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; thcs e voting No, none. Traffic Control Signals at DurstonRoad & North Seventh Avenue The matter of a traffic oontrol signal at Durston Road and North Seventh Avenue to be installed on a co-operative basis similar to the installation proposed at Seventh and Eighth Avenues with Main Street was discussed. It was thought that with improvements which are proposed to be made on North Seventh Avenue in the future and the relatively small amount of existing congestion, it is not advisable to make a traffic control installation at this time. Sidewalk Improvement on North Rouse Avenue The City Enginner reported that a petition from owners of property on North Rouse Avenue has been presented to the State Highway Department requesting them to make certain grade changes on that Avenue whioh will permit usable and desirable construction or reconstruction of sidewalks and driveways. If the requested grade change is made, these owners propose to install new walks and driveways at their expense} the.. sidewalks to be built with a curb faoe. Information is desired by the Highway Department 8S to whether or not, if the requested grade change is made Emd the petitioning property owners rebuild their sidewalks, the owners of the non-conforming sidewalks would be ordered by the City Commission to I replace such sidewalk. After oonsideration, it was moved by Commissioner Berg, seconded by Commissioner Swanson. that if grade changes are approved by the State Highway Department and the owners who have pre- sented the petition rebuild their sidewalks in accordance therewith, owners of remaining sidewalks in the same section of the street which do not oonform to the new grade will be ordered to replace such walks and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin. Resolution No. 897 - Intention to Create Special Improvement District No. 405 The City Attorney, as instructed, has prepared a resoltuion of intention to create Special Improve- ment District No. 405, paving Story, Dickerson, and Alderson Streets between Fourteenth and Hfteenth Avenues. Resolution No. 897 was presented. entitleda A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE '!HE INTENTION OF' THE CITY OF BOZEN..AN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IM- PROVEMENT DISTRICT NO. 405 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND IN- I STALLING A PAVEMENT PROJECT ON WEST ALDERSON STREET FROM SOUTH FOURTEENTH AVENUE TO SOUTH FIFTEENTH AVENUE, ON WEST DICKJ~~SON STREET FROM SOUTH FOURTEENTH AVENUE TO SOUTH FIFTEENTH AVENUE, AND ON WEST STORY STREET FROM SOUTB FOURTEENTH AVENUE TO SOUTH FIFTEENTH AVENUE, SAID PROJECT TO INCLUDE THE CONSTRUCTION AND INSTALLATION OF COMBINATION CONCRETE CURBS AND GUTTERS. Resolution No. 898 - Intention to Create S.1.D. No. 406 The City Attorney. as instruoted, has prepared a resolution of intention to create Special Improve- ment District No. 406, paving 520 feet on Dell Place from East Story Street south. Sub-contraoting by Kiely Construction Company A communication was read from Kiely Construction Company requesting permission be granted to sub- oontract certain specialized work in Special Improvement Districts 386, 386, 389, 390, 391 and 395 to , Andrew H. Anderson & Son Inc., of Great Falls, Montana. The City Engineer was instructed to communi- cate with Kiely Construotion Company oalling attention to Section 3.22 of the Contract Documents in these districts and informing them that the City has no objection to Andrew H. Anderson & Son. . Inc . , as a sub-contractor. Purchase of Cast Iron Pipe, Fittings & Fire Hydrants The Water Department has immediate need for two fire hydrants, 200 feet of 6" cast iron pipe and some cast iron fittings. the estimated cost of which is approximately $980.00. It was moved by Commis- sioner Swanson, seconded by Commissioner Berg, that the City Manager be authorized to purchase the needed materiels in an amount not to exceed $1,000.00, and the motion was carried by the following ~e and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; tl,ose I voting No, none. Application for Beer & Liquor License Applioations of the Bozeman Country Club for a renewal of their club licenses to sell beer and liquor in this City were presented. It was moved by Commissioner Berg, seconded by Commissioner Swanson that the applications be ~proved and the licenses issued, and the motion was carried by the following Awe and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. .1 ')'3 ' .'("'~ Car.nival Lioense for Jaycees A communioation from Bozeman Junior Chamber of Commerce was read, requesting a ci~ License for the Siebrand Brothers Carnival during the week beginning August 17th, 1958, and also requesting that no other carnival or cirous or similar show be permitted to have a lioense prior to this date. After discussion. it was moved by Commissioner Swanson, seconded by Commissioner Berg that a thirty (30) day protection be I given and a license tee for the Siebrand Brothers Show be set at the rate of $100.00 per day, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Street Light r~ Parking Lot at Bozeman Country Club A request from the Gallatin Valley Golfing Association to have an intersection light installed in the parking lot at the Bozeman Countr,y Club was read. They stated their association will reimburse the City for the monthly cost of the light. It was moved by Commissioner Berg, seconded by Commissioner Swanson that the request be approved as proposed and the City Manager be authorized to have the Montana Power Company install a light at this location, and the motion was carried by the following Aye and No votea those voting Aye be ing Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
