HomeMy WebLinkAbout1958-05-14 ,\28 Bozeman, Montana May 14, 1958 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, May 14, 1958 at 1:00 o'clock P. M. Present were Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Acting Clerk. The following proceedings were hada Minutes of the last regular session of May 7, 1958 were read and it was moved by Commissioner I Berg, seconded by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the following Aye and No votea those voting Aye being Commissioner Swanson and Commissioner Berg; those voting No, none. Acting Mayor and Acting Clerk Mayor Erwin and L. G. Shadoan, C~rk of the Commission, were out of the City and it was therefore moved by Commissioner Berg, seconded by Commissioner Swanson, that, for this meeting, Commissioner Swanson be designated as Acting Mayor and that Osoar E. Cutting be designated as Acting Clerk and the motion was carried by the following Aye and No votel those voting Aye being Commissioner Swanson and Commissioner Berg; those voting No, none. Public Hearing - Special Improvement District No. 404 Public hearing on establishing Special Improvement Distriot No. 404 as proposed in Commission Resolution No. 892, which had been adjourned until this date, was reopened. The wri tten wi thdrawal of protest representing 10% of the property in the proposed di~triot was presented. Protests in this district now total 32.4% of the property. It was moved by Commissioner Berg, seoonded by Acting Mayor Swanson, that the protests be overruled as insufficient, and the City Attorney be instructed to prepare ~. - I a resolution to create said district and the motion was carried by the following Aye and No votea those voting Aye being Acting Mayor Swanson and Commissioner Berg} those voting No, none. Easement and Right-of-way Agreement for Utilities on Vacated McAdow Avenue .An agreement between Lillie M. Warwood and the City granting an easement and right-or-way for water and sewer lines now in place and for any other public utilities now installed or that may be installed in that portion of McAdow Avenue lying between Main and Babcock Streets vacated by Ordinanoe No. 804 was presented. The agreement was approved as to form by the City Attorney. It was moved by Aoting Mayor Swanson, seconded by Commissioner Berg, that the agreement be approved and that the Mayor and Clerk of the Commission be authorized to sign the agreement for the City of Bozeman, and the motion was oarried by the following Aye and No votel those voting Aye being Acting Mayor Swanson and Commissioner Berg; those voting No, none. Water Lines to Serve Suburban Developments Following a continued discussion of changing city policy to permit serving water consumers in proposed suburban developments outside of the oity limits. representatives of the consultant engineer- ing firm of Msrrisan-Maierle. Inc. were instructed to obtain from the Montana Publio Service Commission a ruling on what restrictions might be set on supplying water users outside of the City Limits as to distanoe and as to areas served. The City Attorney was instructed to provide the Commission with an I opinion as to what agreement could be made with property owners outside of the city limits that would be binding upon the owners and their successors. in order to make the granting of water service to the property contingent upon the owners bringing that property into the City under certain oonditions. FUrther consideration of this matter was postponed pending -receipt of this additional information. Proposed New Route for Road to Mystic Lake Based on continued studies of the possibility of construoting a road to Mystic Lake Dam. Mr. Howard D. Halpin, District Forest Ranger, has suggested a ~outing that would utilize the present Hyalite Creek Road, a logging road on Moser Creek and thenoe into the Bozeman Creek watershed. <I From studies of aerial map it is apparent this proposed routing would have a number of advantages .12!J over routes previously considered. Mr. Halpin has agreed to a joint ground reconnaissance of this proposed routing as soon as snow conditions jn the higher elevations permit. Purchase of Copper Pipe Due to the necessity of installing a large number of water service connection renewals and stubs ahead of street pavement construction presently in progress, the Water Department has immediate need for I additional copper pipe the estimated oost of which is apFroximately $950.00. It was moved by Acting Mayor Swanson, seconded by Commissioner Berg, that the City Manager be authorized to purchase this needed material in an amount not to exceed $1.000.00, and the motion was carried by the following Aye and No vote; those voting Aye being Aoting Mayor Swanson and Commissioner Berg; those voting No, none. Purchase of a Bass Clarinet for the Bozeman Municipal Band The Board of Direotors of the Bozeman Municipal Band, in accordance with a continuing policy of building up the band, has reoommended the purchase of a bass clarinet for the band. It was moved by Commissioner Berg, seconded by Acting Mayor Swanson, that the City Manager be authorized to purchase a bass clarinet as recommended in detail by the Band Director and at an approximate cost of $500.00 and the motion was carried by the following Aye and No vote: those voting Aye being Acting Mayor Swanson and Commissioner Berg; those voting No, none. Selection of a Director for the Bozeman Municipal Band At the annual May meeting of the Board of Directors of the Bozeman Municipal Band, Mr. E. P. Sedivy was elected as Band Direotor for the 1958 season. On the recommendation of the City Manager, it was moved by Acting Mayor Swanson, seconded by Commissioner Berg. that the appointment of Mr. Sedivy as I .. Director of the Bozeman Munioipal Band for the 1958 season be approved and the motion was carried by the following Aye and No votea those votlng Aye being Acting Mayor Swanson and Commissioner Berg; those voting No, none. Increase of Charges"for Water Service Conneotions A review of water service connection installations made during the past year has disclosed that the fixed fee currently charged for that section of such installations between the water main and the property line is wholly inadequate. It was moved by Commissioner Berg, seconded by Acting Mayor Swanson, that, for a normal street of 60 feet width. the fixed fee for that part of a water service connection between the water main and the property line be increased to $75.00 to more nearly meet present day costs and that a new schedule of charges for water service oonnections be established on that basis and the motion was carried by the following Aye and No votea those voting Aye being Acting Mayor Swanson and Commissioner Berg; those voting No, none. Special Improvement Distriot No. 394 - Change Order No. 2 Change Order No. 2, involving an additional oost of '342.60 on Special Improvement District No. 394 for a concrete valley gutter to be built across South Fourth Avenue on the south side of Garfield Street to provide adequate drainage at that interseotion and recommended by engineering consultants Harold Hoskins & I Associates. was presented. It was moved by Acting M~or Swanson, seconded by Commissioner Berg. that Change Order No. 2 on S. I. D. 394 be approved and the motion was carried by the following Aye and No votea those voting Aye being Acting Mayor Swanson and Commissioner Berg; those voting No, none. Re-appointment of Police Commissioner Gay City Manager Henderson reported that the term of Polioe Commissioner Henry M. Gay had expired on 30 April 1958. and that, in accordance with Montana stetute, he had reappointed Mr. Gay as a member of the Bozeman City Police Commission for the 3-yeer term ending 30 April 1961. It was moved by Commissioner Berg, seconded by Acting Mayor Swanson, that the reappointment of Mr. Henry M. Gay as a member of the ---- .\~30 Police Commission be approved and the motion was carried by the following Aye and No votea those voting Aye being Acting Mayor Swanson and Commissioner Berg; those voting No, none. Report of the Water Collector " The report of the Water Collector for the month of April, 1958 was presented. It was moved by Acting Mayor Swanson, seoonded by Commissioner Berg, that this report be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Acting Mayor Swanson and Commissioner Berg; those voting No, none.
