The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, May 21, 1958 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The follow-
ing proceedings were had:
I Minutes of the last regular session of May 14, 1958 were read and it was moved by Commissioner
Swanson, seoonded by Commissioner Berg, that the minutes be approved as read and the motion was oarried
by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Resolution No. 904 - Creating S. I. D~ 404
The City Attorney, as instructed, has prepared a resolution creating Special Improvement Distriot
No. 404, paving on South Fourth Avenue from Grant to Lincoln Street. Resolution No. 904 was presented,

This is the time and place set in Commission Resolution No. 897 for hearing protests to creation

and Fifteenth Avenues. Affidavit of publioation of Notice was presented together with the Clerk's

Public Hearing - Special Improvement District No. 406
Resolution No. 906 - Creating S. I. D. No. 406
This is the time and place set in Commission Resolution No. 898 for hearing protests to creation of
Special Improvement District No. 406, paving Dell Place from Story Street for 520 feet south. AffidavU
of publication of Notice was presented together with the Clerk's Mailing Certificate that all property
I owners have been notified. No written protests have been filed. P. C. White, Assistant Engineer.
Milwaukee R8ilroad, was present and entered a verbal protest for his company. It was moved by
Commissioner Berg, seconded by Commissioner Swanson, that, since the verbal protest has no legal stand-
ing, a resolution creating the district be presented, and th~ motion was carried by the following Aye
and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those
voting No, none.

Resolution No. 907 _ Intention to Create Special Improvement District No. 407 I
The City Attorney, as instructed, has prepared a resolution of intention to create Special
Improvement District No. 407, Drainage or Storm Sewer System in "Area Bft, as described in Harold
Hoskins & Associates report of March 5th, 1958, an area between Main Street and Durston Road, and
between Grand Avenue and North Seventh Avenue. Co~issionResolution No. 907 was presented, entitled:

It was moved by Commissioner Swanson, seconded qy Commissioner Berg, that the resolution be passed
and adopted and June 25th, 1958, be set as the date for hearing protests and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Purchase of Crushed Gravel
The City has need for crushed gravel from time to time for use in mixing patching material for
pavement patching and for other street repairs. The City Manager recommended that a quantity of this
material be purchased to be stockpiled in the City yard. I
It wes moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Manager be
authorized to purchase 500 yards of crushed gravel at an estimated cost of not to exceed $1,000.00
and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner Swanson and Commissioner Berg; those voting No, none.
Moving Buildingsto New City Yards
Moving shop and storage buildings from the present City yards at Rouse and Lamme to the yards at
Rouse and Tamarack. recently acquired from the Standard Construction Co., was discussed. A proposal
has been received from E. W. Hioks, 101 No. 10th Avenue, to move the four buildings whioh are 24' X
60' in size on a cost basis at an estimated oost of $400.00 each.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City Manager be and
is hereby authorized to enter into an agreement for the City to have one of these buildings moved in
accordance with Mr. Hicks' proposal at a oost of not to exceed $400.00 and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Bonding Water Services on 12th, 13th, 14th, & 15th Avenues I

W. R. Border, Water Superintendent, recommends that all water services on Twelfth, Thirteenth,
Fourteenth and Fifteenth Avenues be bonded before paving is installed on these streets. Water mains
in these streets are of "Transite" pipe, a non-conductor of electricity, which creates a special
problem in event of frozen water services and the bonding recommended would make electrical connec-

tion possible at the joint where each house service is connected to the "Transite"main. This would
make it possible to thaw a frozen house service electrically and eliminate necessity to cut new
pavement and dig down to the house service water main connection in event of such freeze-up. Estimated
cost of this bonding is aprroximately $3,000.00.

It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City Manager
be and is hereby authorized to have this work done by Water Department personnel in accordance with
Mr. Border's recommendations and the motion was carried by the following .Aye and No votea those voting

Reports

Cemetery Board Director of Finance
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the reports be accepted
and ordered filed and the motion was oarried by the following Aye and No vote: those voting .Aye being
Mayor Erwin. Commissioner Swanson and Commissioner Berg; those voting No, none.
Final Payment for S. I. D. No. 392
Cl~im No. 1430 of the Utility Builders, Ino.. in the amount of $9,499.79, was presented. This
claim is to cover final payment in full under their contract for construction of Special Improvement
District No. 392 and is recommended for payment by Harold Hoskins and Associates, supervising engineers,
and by the City Manager.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the claim be approved
and a warrant issued for its payment and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Plat of Hyalite View Sub-division
A plat of an area to be known as Hyalite View Sub-division, a re-arrangement of a portion of
Western Union Addition to the City of Bozeman, was presented ~ J. H. MorroW, attorney for the Bozeman
I Deaconess Hospital, for approval. C. V. Henderson, Secretary of the Bozeman Deaconess Hospital Board,
was present. The area platted includes a strip along its west side, 42.1' wide at its south end and
25.06' wide at its north end, which is not an actual part of Western Union Addition and whiCh, in
effect, extends the city limits to include it. The plat was accompanied by a letter from the Bozeman
Deaconess Hospital stating that '~uiet Title" proceedings on this strip are in process. Wri tten
opinion was also furnished by the City Attorney to the effect that the Bozeman Deaconess Hospital
is the owner in fee simple of the lends included on the pla t and recommending aplroval of the plat.
It was moved by Cormnissioner Berg, seconded by Commissioner Swanson, that, subject to written
recommendation for its approval being furnished by the Bozeman City-County Plan Board, the plat be
apf'roved and that the City Manager, acting ex-officio as the Director of Public Service, and the Meyor
and City Commissioners be end are hereby authorized to sign certificates of apfroval on said plat and
the motion was carried by the following .Aye and No vote: those voting .Aye being Mayor Erwin.

Adjournment
There being no further business to come before the Commission at this time. it was moved by
Commissioner Swanson, seconded by Commissioner Berg, that the meeting adjourn and the motion was
