The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, May 28, 1958 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, City Manager Henderson, and the Clerk. The following proceedings were had:
Minutes of the last regular session of May 21. 1958 were read and it was moved by Commissioner
Berg, seconded by Commissioner Swanson, that the minutes be approved as read and the motion was carried I
by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those v oting No, none.
Bids for S. I. D. Nos. 401 and 403
This was the time and place set for opening bids for construction of Special Improvement Districts
Nos. 401 and 403. Affidavit of publica.tion of Notice to Bidders was presented. It was moved by
Commiss ioner Swenson, seconded by Commissioner Berg, that the bids be opened and read and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting No, none.

After these bids were tabulated and checked in detail by the consulting engineers, it was moved by
Commissioner Berg, seconded by Commissioner Swanson, that the bid of Kiely Construction Company for
construction Speciel Improvement District No. 401 be accepted and the motion was carried by the follow- I
ing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg;
those voting No, none.
It was moved by Commissioner Swanson. seconded by Commissioner Berg, that the contract for the
construction of Special Improvement District No. 403 be awarded to Kiely Construction Company, and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting No, none.
Electrical License Bond - Mannix Electric Company
The Electrical License Bond of the Mannix Electric Company was presented. It was moved by
Commissioner Swanson, seconded ~ Commissioner Berg, that the bond be approved and accepted, subject .
to approval by the City Attorney. and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Erwin, Commdssioner Swanson and Commissioner Berg; those voting No, none.

This was the time and place set for opening bids for construction and/or repair of miscellaneous
walks and curbs for 1958. Affidavit of publication of Notice to Bidders was presented. I t was moved

Water Line for Hyalite Sub-division '.' d
Installation of a 15" water main to serve the Hyalite Sub-division was considered. Afte r di s-
cussion, it was moved by Commissioner Swanson, seoonded by Commissioner Berg. that the Bozeman Deaconess
Hospital Board be informed that:
1- The Bozeman Deaconess Hospital Board. as owners and developers of this sub-division,
should have necessary plans and specifications of the proposed water main installa-
tions prepared. ttese plans and specifications to be subject to approval by the City
I Engineer.
2. The Hospital Board should advertise the project for bids and contract for the con-
struction or installation should be between them and the contractor whose bid they
aocept.
3. The City of Bozeman will furnish such engineering supervision as is needed for the
construction or installation of the project.
4. The City of Bozeman will enter into an agreement with the Hospital Board under which
owners of lands abutting the proposed supply line, which lands are not owned by the
Hospital Board, will be required to pay a connection charge to connect to and be
served with water from this line. such charge to be paid to the Hospital Board as
partial reimbursement for their investment in this line, details of such agreement
to be worked out between the Hospital Board and the City.
The motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner Swanson and Commissioner Berg; those voting No. none.
Hyalite Sub-division Approved by Plan Board
A communication from the Chairman of the City-County Plan Board was read stating that they
had examined a preliminary plan of Hyalite View Sub-division and recommended certain changes to be
made and that the plat of said Sub-division as presented to the City Commission on May 21, 1958
complies wi th the recommended changes and therefore should be considered as approved by their Boa rd.
Changes in Restrictive Covenants of Hyalite Sub-division
I A communication from J. H. Morrow, Attorney for the Bozeman Deaconess Hospital Board, was read
requesting changes to be made in the restrictive covenants of the Hyalite Sub-division as follows:
Restrictive Covenant No.5- Requirement for yard space on inside lot lines
be changed from ten feet to eight feet.
Restrictive Covenant No.6- Right-of-way on inside lot lines for public
utilities should be changed from ten feet to
eight feet..
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that these changes in the
covenants be approved and accepted and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Damsge to Gas Mains during Paving Construction
A communication was read from Kiely Construction Company stating that they are having considerable
difficulty with underground public utility lines which have been plaoed too near the surface and that
the lines should be lowered to conform with good construction practice. The communication stated
further that said Kiely Construction Company would not be responsible for any future damage or accident
the t might occur from damage to the gas me ins of' the Montana Power Company. A copy of the communication
. had been sent 'to the Montana Power Company. The letter was referred to the City Attorney for
examination and reply.
I Delegates to Municipal League Meeting
The Montana Municipal League will hold its annual meeting in Butte on June 5 to 7, 1958. It was
moved by Commissioner Swanson, seconded by Commissioner Berg. that attendanoe at this meeting be
authorized for the City Commissioners, City Manager, City Attorney and the Clerk of the Commission or
alternates and their expenses be paid from the General Fund and the motion was carried by the following
Aye and No vote: thoo e voting Aye being Mayor Erwin. Commissioner Swanson and Commissioner Berg;
those voting No, none.

Change Order for Street Grades - S. I. D. 385

A valve stem in the new 24" water main at the intersection of Black Avenue and College Street is
considerable higher than what will be the finished street grade. 1'0 correct this s i tUB ti on, the Ci ty
Engineer, after extensive investigation, recommends that the street grade be changed on South Black
Avenue in order to get the necessary rise to froperly cover the valve. After discussion, it was moved
by Commissioner Berg, seconded by Commissioner Swanson. that a change order be issued for Special
Improvement District No. 385 to raise the street grade on South Black Avenue and the additional cost.
including sidewalk and curb replaoement, necessitated by this change be paid from the Water System I
Improvement Fund and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Parks - Improvements to Playgrounds for Baseball Program
A proposed program for Junior Baseball for 1958, as recommended by a Citizens' Committee and by
A. Gleni~hite, Recreation Director, was presented and discussed. The program will include taking over
the former High School football practice field between Grand and Tracy Avenues on Tamarack Street and
setting up two baseball fields on it. Written authority has been given by Bozeman High School Board
for use of this ground. The plan includes improvements to and maintenance of four baseball fields in
other city parks. The estimated cost of the proposed improvements and ground maintenance for the 1958
season is apfroximately ~l.SOO.OO. (
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that, subject to concurrent
approval by the City Recreation Board, this recommended baseball program be and is hereby approved and
the motion was carried by the following A.ye and No vote: those voting Aye being Mayor Erwin,
Commissioner Swanson and Commissioner Berg; those voting No, none.
Chief of Police - Retirement of A.. N. Haas - Appointment of C. V. Saunders I
Announcement was made of the retirement of A. N. Haas, Chief of Police. to be effective July 1.
1958. City Manager Henderson also announced the appointment of Police Captain C. V. Saunders to
become Chief of Police effective July 1, 1958. Chief Haas has completed more than twenty years of
service in the Police Department and is therefore entitled to become a member of the Police Reserves
wi th full retirement benefits and his transfer to the Reserve Roll is at his written request.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Berg, seconded by Cormnissioner Swanson, that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
