M. Present were Mayor Erwin, Commissioner Swanson. Commissioner Berg, City Manager Henderson, City Attorney Lovelaoe and the Clerk. The following proceed- ings were had: I Minutes of the last regular session of May 28, 1958 were read and it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Memento Structure in Parking Strip on South 8th Avenue Martin Whalen, Superintendent of Physical Plant, Montana State College, appeared before the Commission to present a scale model of a proposed monument to be erected in the center parking strip on Eighth Avenue between College and Harrison Streets as a memorial to the Class of 1958 of M. S. C. Afte r discussion, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that permission be granted to erect this structure as proposed provided that written request is presented by M. S. C. and conditioned on agreement by M. S. C. that, at any time it becomes necessary in connection with repair or reconstruction of the street or of utilities now installed or to be installed in that block of South Eighth Avenue in which this monument is construoted, M. S. C. will remove the monument and its base at their expense and that M. S. C. will be entirely responsible for all necessary maintenance or expense of repair or renovation of the monument and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No. none. I Reports The following reports for the month of May, 1958 were presentedl Sewage Plant Operator Police Judge Cashier Chief of Polio e Fire Chief Librarian It was moved by Commissioner Swanson. seconded by Commissioner Berg, that the reports be accepted . and ordered filed and the motion was carried by the following Aye and No votel those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Investment of S. D. S. Revenue ~und8 S. D. S. Revenue FUnds invested in U. S. Treasury Notes, in the amount of $26,OOO~00, will mature June 15, 1958. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the Director of Finance be authorized to re-invest these funds in U. S. Treasury bonds due February 15, 1965, and the motion was carried by the following Aye and No vote; thcs e voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those v oting No, none. Water Improvement froject - Change Order - Sump in Reservoir Change Order No.8, on Phase I, Schedule IV, Water Supply System Improvements, under the contract of Haggerty-Messmer Company. was presented. The change order provides for construction of a sump in the , bottom of the existing Lyman Creek reservoir. It is recommended by W. R. Border, Water Superintendent, I and Morrison-Maierle, Inc., consulting and supervising engineers on the project. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the change order be approved and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Barbecue Pit in Bogert's Grove A letter request was presented from the Junior Chamber of Commerce requesting permission to use Bogert's Grove for a Chuck Wagon Barbeoue and to dig a barbecue pit, this event to be held in connection with the Jaycee Rodeo August 7th and 8th. It was moved by Commissioner Swanson, seconded by Commissioner .1:l8 Berg, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Purchase of Sewer Rodding Equipment and Tools Purchase of tools and equipment for the City's sewer rodding machine. to cost approximately $750.00, is recommended by W. R. Border, Water Superintendent, and the recommendation is concurred in by the City Manager. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Manager be I authorized to make this purchase, and the motion was oarried by the following Aye and No vote, those voting Jwe being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Bids for Garbage Disposal Unit Proposed specifications for a garbage collection unit to replace one of the units now in use were presented and read. It was moved by Commissioner Berg, seconded by Commissioner Swanson. that the Clerk of the Commission be authorized to advertise for bids for a unit as specified and the motion was carried by the following Aye and No votea those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Bond e.nd Contract - W. D. Howells - W & C 1958 Bond and contract of W. D. Howells for construction and/or repair of Mjscellaneous Walks and Curbs in 1958 were presented. The contract and bond were approved as to form by the City Attorney. It was moved by Commissioner Swanson. seconded by Commissioner Berg, that the bond and contract be accepted and approved and the Mayor and the Clerk of the Commission be authorized to sign the contract for the City of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Claims for Month I Claims Nos. 1430 to 1705 inclusive were presented on the various funds as follows: Airport -~ 500.00 - - - Band - - - - 60. 71 General - - - - 16,608.86 Street - - - - 4,748.64 Wa te r - - - - 10.563.75 s. S. - - - - 733.43 Cemetery Permanent Care - - 20.000.00 TOT A L ------ $174,100.78 The Manager stated that he has audited these claims and finds them to be true and lawful claims against the City of Bozeman and recommends that warrants be issued for their payment. After examination of the claims in detail and checking against the Claim Register, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that the claims be approved and warrants issued for their payment, and the motion was carried by the following Aye and No votea those voting Aye being I Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Longevity Pay for Chief of Folice The matter of longevity pay for policemen and firemen and for the Chief of Police having been pre- viously discussed and considered by the Commission on February 5, 1958. the matter of the longevity pay to be paid the Chief of police again came before the Commission in connection with the proposed retirement of Chief A. N. Haas. At the February 5, 1958 meeting of the Commission, the Commission had been advised by the City Attorney that his interpretation of the law was that longevity pay should .tlfJ only be paid to the Chief of Police for that period he had served as Chief of Police and not for the period he had served the Department as an officer prior to becoming Chief. Upon reconsideration of' this matter, it was decided by the Commission that the longevity pay for the Chief of Police should be given for the entire number of years of service both as a regular officer and 8S Chief of Police for services up to but not exceeding twenty (20) years rather than basing his longevity pay upon the years he served for Police Chief only. I Whereupon. it was mOTed by Commissioner Swanson and seconded by Comrrlissioner Berg, that the records show as 0f this date that Section 11-1815, R. C. M. 1947. shall be interpreted to grant to the Chief of Police longevity pay based upon his total number of years of service as a member of the Police Department up to but not exceeding twenty (20) years of service. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin. Commissioner Swanson and Commissioner Berg; those voting No. none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
