HomeMy WebLinkAbout1958-06-25 Bozeman, Montana .145 June 25, 1958 The Commission of the City of Bozeman met in regular session in the Commission Room. City Hall Building, Wednesday, June 25, 1958 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson. Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The follow- ing proceedings were had: I Minutes of the last regular session of June 18, 1958 were read and it was moved by Commissioner Berg, seconded by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin. Commissioner Swanson and Commissioner Berg; those voting No, none. Rea ring S. I. D. No. 407 - Drainage of Area "B" This was the time and place set in Resolution No. 907 for considering protests to creation of Special Improvement District No. 407, drainage in Area 'IB". Affidavit of publication of the Notice and the Clerk's Mailing Certificate were presented to show that all owners have been notified. Written protests representing 57.5% of the proper~ in the district were presented. It was moved by Commissioner Swanson, seconded by Commissioner Berg. that the protests be sustained as sufficient and that further proceedings to create the district cease and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No. none. Report Report of the Director of Finance for the month of May, 1958 was presented. It was moved by Commissioner Swanson. seconded by Commissioner Berg, that the report be accepted and ordered filed and I the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Lease at City Dump Vernon L. Koelzer, of the Pacific Hide & fur Depot, was present to inquire regarding the lease on the City Dump between his company and the City of Bozeman which expires August 6, 1958. His company has been informed the t the lease will not be renewed and he was informed that these salvage rights have been leased to another party. He stated he would be interested in leasing the dump in another year. Bids for S. I. D. Nos. 404, 405 & 406 This was the time and place set for opening of bids for construction of Special Improvement Districts Nos. 404, 405 and 406. Affidavit of publication of Notice to Bidders was presented. It was moved by Commissioner Swanson, seconded by Commissioner Berg. that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. D. 404 was approximately 24% above the estimated cost, the low bid for S. T. D. 406 was approximately 17% above the estimated cost, and the low bid for S. I. D. 405 was just slightly above the estimate. I t was moved by Commissioner Swanson. seconded by Commissioner Berg, that Kiely Construction Company be awarded the contract for the construction of Special Improvement District No. 405, with completion date of October 15, 1958, and action on the bids for S. I. D. Nos. 404 and 406 be deferred until the matter of increased cost can be taken up with the property owners in these two districts and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner \ .l16 Berg; those voting No, none. Bond & Contract for S. I. D. 401 Bond and contract of Kiely Construction Co., for construction of Special Improvement District No. 401 were presented. The bond and contract were approved as to fonn by the City Attorney. It wa s moved by Commissioner Berg, seconded by Commissioner Swanson. that the bond and contract be accepted and approved, the Mayor and Clerk of the Corrmission be authorized to sign the contract for the City of Bozeman, and the bid securities be returned to all bidders and the motion was carried by the follow- I ing Aye and No vote: those voting; Aye being; Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Bond and Contract for S. I. D. 403 Bond and contract of Kiely Construction Co.. for construction of Special Improvement District No. 403 were presented. The bond and contract were approved as to form by the City Attorney. It was moved by Commissioner Swanson. seconded by Commissioner Berg;, that the bond and oontract be acoepted and approved, the Mayor and Clerk of the Commission be authorized to sign the contrect for the City of Bozeman. and the bid securities be returned to all bidders, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin. Commissioner Swanson and Commissioner Berg; those voting No, none. 1!:xamination of De}ository Bonds & Securities 'lhe Commission proceeded to examine receipts for Depository Securities to cover city funds in the various city banks. After examination, it was moved by Commissioner Berg, seconded by Commissioner Swanson. that the security receipts be approved and set forth full in the minutes and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Jr. Commiss ioner Dated June 25th, 1958 - I .lt7 Water Main to Serve Property Outside City Limits Mr. Neal Weaver. ap~eared before the Commission to inquire about a water main to serve his property outside the city limits. He was informed that. after extended investigation. the Commission finds no adequate reason to extend water service or other services to areas outside the city limits and therefore deems it inadvisable to make an exception in this case by permitting Mr. Weaver's I property to be connected to the City's water system until that property is brought into the city limits. Tractor for Land Fill Method of Garbage Disposal Mr. Lyle Swinton. representing Nash-Davis Machinery Co.. was present and ex~lained the Caterpillar tractor sold by his firm which they recommend to be used for the land- fill method of garbage disposal. Adjournment There being no further business to come before the Commission at this time. it was moved by Commissioner Berg. seconded by Commissioner Swanson, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin.
