HomeMy WebLinkAbout1958-07-02 . .lt8 Bozeman, Montana July 2, 1958 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, July 2, 1958 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The follow- ing proceedings were had: Minutes of the last regular session of June 26, 1958 were read and it was moved by Commissioner I Swanson, seconded by Commissioner Berg, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Award of Contract for Construction of S. I. D. 404 Written approvals from owners of 53.6% of the property in Special Improvement District No. 404 on awarding contract at the bid price submitted at the meeting of June 25, 1958 were presented. After consideration, it was moved by Commissioner Berg. seconded by Commissioner Swanson. that the bid of Kiely Construction Company for the construction of Special Improvement District No. 404 be accepted and the motion was carried by the following Aye and No vote: those voting Aye being Ma.yor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Contra_ct for Construction of S. I. D. 406 Owners of less than twenty percent of property included in Srecial Improvement District No. 406 have indicated approval of accepting the bid which has been received for construction of this project. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that action on this bid be deferred until the next regular meeting and the mot ion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. I Bids for Garbage Truck This was the time and place set for opening bids on a truck with special closed garbage body for the Garbage Department. Affidavit of publication of Notice to Bidders was presented. I t was moved by Commissioner Swanson, seconded by Commissioner Berg, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No. none. Change Oreer for S. I. D. No. 397 Change order for Special ImFrovement District No. 397, authorizing refJlacement of a concrete walk along a curb at an estimated cost of $36.00 and recommended by Harold lioskins & Associates for approval, wes presented. It was mJved by Commissioner Berg. seconded by Commissioner Swanson. that the change I order be approved end the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Water Improvement froject - Payment to Statewide Plumbing & Heating; Co. Claim of Statewide Plumbing & Heating Company. in the amount of $70,776.50, covering Engineer's EEtimate No. 10. and including all except 1% of the 10% retained reserve on their entire contract. was presented. 1be claim also included Change Oreers 13, 14 and 15 which had not yet been approved. John Morrison, Fresident of Morrison-Maierle. Inc.. was present to eXFla in these change orders and to recom- mend that the requested payment of retained reserve be made. After extended discussion. it was - moved by Commissioner Swanson. seconded by Commissioner Berg. that payment on 1rtgineer's Estimate .119 No. 10, to Statewide Plumbing &-. Heating Co. be deferred until the following concii tions are complied with in full: 1. Proof is furnished that all claims for labor and material furnished or used on the project have been paid. 2. Letter is received from Morrison-Maierle. Inc.. certifying that the work has been completed and is acceptable. I 3. All reject pipe left on the project has been removed from private and public properties. 4. The bonding company of Statewide Plumbing and Heating Company has been notified of the status of the work and the proposed payment. 5. All change orders included in this estimate have been approved. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Water Improvement Project - Change Order No. 14 Change Order No. 14 provides add~tional payment of $450.00 for lowering the water line grade to cross an irrigation ditch which was thought to be abandoned. It was moved by Comrndssioner Berg. seconded by Comnissioner Swanson, that Change Order No. 14 be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Water Improvement Project - Change Order No. 13 Change Order No. 13 provides for additional payment of $495.00 due to required extra depth of trench crossing the F'ord Brown property. It was moved by Commissioner Swanson, seconded by Commissioner Berg. that the change order be I approved and the motion was carried by the fOllOWing Aye and No vote: those voting Aye being Mayor Erwin. Commissioner Swanson and Commissioner Berg; those voting No. none. Water Improvement Project - Change Order No. 15 Change Order No. 15 provides for additional payment of $1,400.00 for f'urchase and installation of gravel used to provide necessary bedding for the sUPfly line between the pre-sedimentation basin and the diversion dam in Hyalite Creek where that line crossed excessively soft ground. It was moved by Commissioner Swanson. seconded by Commissioner Berg, that the change order be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. S. . . 799.93 Pol ice Reserve . 86.15 TOT A L - - - i69.460.77 The Manager stated that he has audited these claims and finds them to be true and lawful claims against the City of 'Bozeman and recommends that warrants be issued for their payment. After examination of the cla ims and checking against the Olaim Register. it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the claims be approved and warrants issued for their payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin. Purchase of Irrigation Pipe for Park Department It has been recommended by the Park Superintendent that additional pipe for irrigation purposes be purchased for his department. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City Manager be authorized to purchase additional irrigating pipe for the Park Department not to exceed $900.00 and the motion waS carried by the following Aye and No vote; those voting Aye I being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Reports The following reports for the month of June, 1958 were presented: Chief of Police Librarian Fire Chief Police Judge It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Request for Exhibit of "Atoms for Peace" A request was read from the Junior Chamber of Commerce to use two metered stalls on Main Street for an Atom Engineering Exhibit advertising "Atoms for Peace" on July 8th and 9th. It was moved by Commissioner Swanson. seconded by Commissioner Berg, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Appointments in police Department On recommendation of Chief of Police C. V. Saunders, the City Manager announced the following promotions and appointment in the police Department effective July 1, 1958: I, Bennie G. Davis promoted from Sergeant to Captain Ron Cutting promoted from Patrolman to Sergeant Earl G. Smiley, Jr., re-apfointed as Patrolman, he having previously been so employed from March, 1948 to October, 1952. Confirmation of John McCrosson, Jr. as Regular Fireman A letter from Fire Chief Penttila was read stating that John McCrosson, Jr. has successfully completed six-months probation period as a fireman and recommending that he be confirmed as a regular member of the Fire Department. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that John McCrosson, Jr. be confirmed as a regular member of the Fire Department and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Traffic _ Perking Boats & Trailer Houses on Streets Hazards and problems arising from a growing practice of parking boat trailers and trailer houses on city streets was discussed. Reports are that increasing numbers of such vehicles are parked on streets regularly and for long periods of time. Review of the traffic ordinance shows that such park- ing is prohibited and the Manager was instructed to direct the police Department to make special check of such illegal parking and see that it is discontinued.
