M. Present were Mayor Swanson, Commissioner Erwin, Commissioner Lowe, City Manager Henderson. Administrative Assistant Sales, City Attorney Lovelace and the Clerk. The following proceedings were had: 1 Minutes of the last regular session were read and it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the minutes be a:p:proved as read and the motion was carried by the following: Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting: No, none. Requests for Jaycee Rodeo Dean L. Nelson, President of the Bozeman Junior Chamber of Commerce, appeared before the Commission to ask consideration of the following events and activities relative to the Bozeman Jaycee Roundup to be held August 9, 10 and 11: 1. Permission to string a banner across Main Street; such permission granted frovided the banner is properly constructed and hung. 2. Permission to conduct Kangaroo Court on the afternoon of .July 27, 1957 a10ng Main Street; permission granted provided activity restricted to sidewalk area. 3. Street Dance and Kangaroo Court on the night of August 3~ 1957; granted provided it is held on a side street and not deter traffic on Highway #lO. 4. Parade on the morning of August 10, 1957; permission granted. 5. Watermelon feed proposed on Main Street after parade on August 10, 1957; the Commission suggested other locations such as parking lots or parks be considered. Resolution of Intention to Create S. I. Schmitz. steadily em}loyed on the Bozeman Fire Del-artment since .Alril 16, 1937, requesting that he be placed on the inactive Hst of the Fire Department Relief Association as of August 1. 1957. It was moved by Commissioner Lowe, seconded by Commissioner Erwin. tha t the req U8st be recommended for e.}prova1 and a letter of thanks and commendation be sent Fireman Schmitz. and the motion was carried 1 by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Wa ter Improvement Project - Bond & Contract - Long Construction Company The bond and contract of Long Construction Co. for Schedule I of Phase II of the Water Improvement Project, construction of the dam on Hyalite Creek~ approved as to form by the City Attorney, was presented. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the Mayor and the Clerk of The Commission be authorized to sign the contra.ct for the City of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. 2~J,l Resolution for Purchase of Road Oil A Resolution authorizing the City Manager to Furchase up to 25,000 gallons of rO!3d oil during; the year 1957 for use in street repair and maintenance from the State Highway Department for the Street Department, was presented, as follows: RES 0 L UTI 0 N WHF..REAS the City of Bozeman will have need during; the fiscal year July 1, 1957 - ~Tune 30, 1958 for road oils for use in repairing streets and for sealing; certain sections of exist- ing; pavement within the City, and WHEREAS the City of Bozeman does not have proper facilities for handling and storing the needed quantities of such oils, and WHEREAS the Montana State Highway Department does have storage facilities and normally does have quantities of the required types of oils stored in Bozeman from which it can supply the quantities needed by the City of Bozeman, NOW, TH~EFQRE. BE IT RESOLVED: That an emergency does exist relative to the procurement of road oils by the City of Bozeman and the City Manager is hereby authorized to :purchase from the Montane State Highway Department, from its stocks in storag;e :in Bozeman, approximately twenty five thousand (25,000) gallons of road oil, this to be purchased from time to time during the fiscal year, July l~ 1957 - June 30, 1958, as needed b;y the City of Bozeman for repair and sealing of existing pavements, and these quantities of road oils to be purchased at cost flus normal handling charges. Manager Authorized to Purchase Gravel and Chips The City Manager requested he be authorized to purchase up to 350 yards of chips and 375 yards of crushed gravel to be used to improve and maintain parking lots and streets. It was moved by Commissioner Erwin, seconded by Corrunissioner Lowe, that the request be granted~ and the motion was carried by the following Aye and No vote: those voting Aye be.ing Meyor Swanson, Commissioner Ervfin and Conunissioner Lowe; those voting No, none. Reports 'I'he following reports for the month of June, 1957 were presented: Cbief of Police Folice Judge Cemetery Board Cashier and also the State Boa rd of Health's report on the Water Works Inspec tion. It was moved by Commissioner Lowe, seconded by Commissioner Erwin. that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye beine; Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Proposed Platting of Marguerite Kirk Property A proposed l-len for platting apFoximately 18 acres of land, owned by Miss Margueri te Kirk. which land lies between Babcock Street extended and Huffine Lane, and which is within one-half mile of the 1 1 1 west city limits, was presented. Miss Kirk, together with her attorney, H. A. Bolanger, Jr., and her brother-in-law, Herbert Kirk, who had prepared the proposed plat, were present. Also present were the County Commissioners of Gallatin County who, because of land under consideration in Gallatin County but outside the city limits of Bozeman, would have interest in this platting. The proposed plan was discussed in detail and the following; points were brought out regarding it: 1 1. Street widths between curbs on Koch Street should be pia tted 64 ft. wide and such widths between curbs on all other streets and avenues should be 40 ft. wide between curbs. 2. The plat shows one block along its east side which would be more than 1400 ft. in length and it should be divided by a street somewhere near its center which street would connect 19th Avenue and 20th Avenue and would give access to certain lots shown on the plan as not abutting on a street. 3. Contract should be made jointly by Miss Kirk, Gallatin County and the City of Bozeman to constitute a lien against the tract so that not less than one-njnth of the entire area, exclusive of areas dedicated for streets and alleys, will be dedicated for Park and Playground purposes. 4. Easements should be platted for location of utilities. Water Improvement Project ~ Purchase of 1/2 - Ton Truck The City Engineer recommends theta i- Ton Pick-up be purchased 1'0 r use of SUf'ervis ing Engineer on the Water Improvement Project. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the Clerk of the Commission be authorized to advertise for bids for a ~-Ton Pick-up truck, and the motion was carried by the following Aye and No vote: those votine Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Fire Insurance SChedule for Vehicles Approved A new schedule of values for fire insurance coverage of vehicles was presented with valvp.s 1 decreased an average of ten percent from val ues used in the preceding poli cy year. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the schedule of values as set be approved, and the motion carried by the following Aye and No vote: those voting Aye beine Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Water Improvement Project - Sale of Bonds The Clerk of the Commission presented a proposed form of notice of sale of $1,200,000 Water System Revenue Bonds, calling for oral bids for the purchase of such bonds to be submitted to the City Commission at a special meeting to be held August 2,1957, at 3:00 o'clock P. M. Said form of notice was examined and found satisfactory and upon motion made by Commissioner Lowe, seconded by Commissioner Erwin, that the Clerk of the Commission be directed to publish the same forthwith in the Bozeman Daily Chronicle, at Bozeman, Montana, and in the Bond Buyer, at New York City, New York, the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Building - Steel Garage 418 E. Mendenhall Letter from Leo Benolken was read requesting permission to construct a steel garage along side 1 and alley property lines at 418 E. Mendenhall on a temporary basis and agreeing to move such building to a proper location if any buildine; is proposed within 20 feet of the garage. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the request be granted in accordance with the conditions of the letter, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Co:mnissirmer Lowe; those voting No, none. Water Works Improvement - Payment of Easements & Da.mages Since contractors are starting work on the Water Works Improvement, it is necessary that easements across lands to be crossed by the new water lines be secured with the least rossible delay. The matter was taken under advisement and a counter proposal was presented by the City butl as recorded in the City Commission meetinG of July 3, 1957, it was turned down by the owners of the properties. It was moved by Commissioner Erwin, seconded by Commissioner Lowe. that representatives of the C1 ty be and are hereb;r' authorized to make agreements for easements and prepayments for damages, subject to final approva.l by the City Commission in accordance with the proposal made at the City Commission meeting on June 26. 1957 by representatives of owners of affected properties and the motion was carried by the following Aye and No vote; those voting; .Aye being Mayor Swansonl Commissioner Erwin and Commissioner Lowe; those voting No, none. Water Improvement Froject - Manager to Negotiate for Booster Pumping Station Site The consul tine; engineers for the water improvement project have recommended the t the Ci ty obtain Lots 29. 30 and part of 28 in Block 97 of the Northern Fac'Uic Addition as the site for the booster }ump station. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Manager be authorized to negotiate for purchase of this site, payment not to exceed $500.00 and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting; No, none. Harold Hoskins & Associates to do Engineering for S. I. D. Mr. W. f. Parker and Mr. Carl Christopherson, representing Harold Hoskins and Associates, were present to discuss a proposal which had previously been presented by their company for doing enEineer- ing work on street improvement projects under consideration by this city. Mayor Swanson declared the meeting in recess for 30 minutes. The meeting was called to order by Mayor Swanson after 30 minutes recess. The matter of hi.ring; consul tinE engineers to prepare plans and specifications for street construc- tion and for engineering supervision of such construction in this City was opened for discussion. Harold Hoskins and Associates havine; presented a proposal, dated September 26~ 1956. and a revision of such proposal, dated June 6, 1957, for doing the required engineering work, and it being considered that acceptance of their proposal was in the best interests of the City and of the owners of properties affected by street improvements to be mede. it was moved by Commissioner Lowe, seconded by ComroissiOIler Erwin, that this proposal be accepted and that a fOrInal contract be entered into between the City of Bozeman and Harold Hoskins and Associates in accordance therewith and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
