Canfield City of Bozeman Community Development PO Box 1230, Bozeman, MT 59771-1230 ATTN: Danielle Garber Subject: Conditional Use Permit Application #17114 The proposed project requires a Conditional Use Permit because it includes an Accessory Dwelling Unit (ADU) above a detached garage. Such ADUs are not allowed in the Bon Ton Historic District's Fairview Addition subdivision, because it was platted prior to January 1, 1997 (UDC Sec. 38.22.030.A.4). This ordinance applies whether or not the owner of record actually physically occupies the associated principal dwelling as a principal residence, which is a red herring that distracts from the important issue. Approval as a conditional use depends on existing and proposed uses and how they would work together. UDC Sec. 38.19.110.E.2 requires that the proposed use would have no material adverse effect upon abutting property. However, the subject proposed use would have an obvious adverse effect on this neighborhood, as follows: • The zoning is R-1. UDC Sec. 38.08.010.A.2 - The intent of the R-1 residential single-household low density district is to provide for primarily single-household residential development and related uses within the city at urban densities, and to provide for such community facilities and services as will serve the area's residents while respecting the residential character and quality of the area. • The proposed use would have a material adverse effect on the residential single- family character of the neighborhood. Signatures on the enclosed petition show that 68% of the residents of the owner-occupied adjacent parcels listed by the City want to preserve the single-family residential character of the neighborhood. The existing character of this neighborhood is at a tipping point; more than 50% of the occupants of the contiguous block of Grand Avenue between College and Alderson spanning the proposed project are not single families. The addition of the occupants of this ADU would have a material adverse effect on the single- family character of the neighborhood. • The proposed use would have a material adverse effect on the quality of this area, by worsening an existing parking problem that affects many nearby parcels in the neighborhood. The parcel immediately south of the proposed ADU has two grandfathered houses containing five apartments, which are rented by an absentee landlord to ten persons who have ten cars. Only two on-site paved parking spots are provided on that parcel. The other eight cars park on the street or park illegally on the sidewalk or in the alley (see enclosed photos), leading to dangerous safety problems. The additional on-street parking required for the proposed ADU will have a material adverse effect on this already severe problem. For these reasons, this historic neighborhood is at risk of decaying into a rental district, one parcel at a time. This proposed use would have a material adverse effect on single-family character and quality. Please deny this application. Richard C.
