"Courtesy ar g Tickets" MEETING DATE: May 11, 2017 AGENDA ITEM TYPE: Action RECOMMENDATION: On January 12, 2011, the Bozeman Parking Commission, by unanimous vote, adopted PC Policy 2011-01 regarding the issuance of Courtesy Parking Tickets (`Warning'). The Parking Program Manager recommends that the Parking Commission rescind PC Policy 2011-01, and discontinue the mandatory issuance of warning tickets to first time Overtime violators in the downtown parking area. BACKGROUND: It is my understanding that the current `Courtesy' ticket policy was the result of smoothing the transition of the downtown parking enforcement function from the Police Department to the Parking Commission. In addition, there was an interest in using the `Courtesy' ticket program as a method for encouraging downtown business activity, during the economic difficulties of that time. Since that time, the public image of downtown parking enforcement has improved significantly. However, the `Courtesy' ticket is a misunderstood expectation in many parts of the community. Citizens often relate their expectation of an `annual warning' for citations they receive, ranging from overtime to restricted zones to the residential districts. Although incorrect, this perception complicates both the enforcement and appeals processes. In addition, the `Courtesy' ticket program represents a sizable amount of forgone revenue for the Parking Services Division (PSD), equal to approximately 56% (FTE w/Fringe) of an enforcement officer. A brief summary of the Courtesy ticket programs in other, nearby, communities is provided for the Parking Commission's consideration. FISCAL EFFECTS: During calendar year 2016, the PSD issued 1,386 warning tickets for Overtime violations in the downtown parking area (includes the parking lots); representing $27,720.00 in potential revenue. Although the enforcement staff will still have the discretion to issue warning tickets, it is expected that Overtime citation revenue would increase significantly as a result of this action. 0 © 0 TDD: 406-582-2301 THE MOST LIVABLE PLACE. December was an expensive month for the BPC between having to do snow removal,purchasing two new gate arms and getting the software support system for the ticket writing data base. 7:55—8:00—Courtesy ticket policy, final approval Pam asked for a motion to accept the courtesy ticket policy. Chris P motioned to approve,Ben L seconded and the motioned carried unanimously. It was suggested that the businesses downtown be notified that courtesy tickets are being issued. 8:00— 8:10— Solar panels discussion, Ben Bennett Ben B discussed with the BPC an interest in installing a solar panel at his office. Paul met with Sara from IPS and talked about solar panel placement and he gave her drawings of the garage. There will be further discussion at a future meeting. 8:10—8:25— Strategic Planning Committee—Policy Guidelines review Tammy,Chris N, Chris P and Paul are members of the Strategic Planning Committee. Paul presented the draft of the Policy Guidelines to the BPC. A discussion ensued about changes to be made to the policy guidelines. Another version will be presented in February. The guidelines are for the BPC to help identify their goals and objectives and will be provided to new BPC members as they come aboard. 8:25—8:45—BPC Bylaws Review I Paul presented bylaws to the BPC. A discussion ensued about the changes to be made to the bylaws that need to be made. Whenever possible,courtesy(warning)tickets will be issued to first-time violators of the downtown overtime parking municipal ordinance(10.32.250). 2. If a citation is issued in error to a vehicle that had not previously received a courtesy ticket,that citation will remain valid. 3. This policy is limited to only the downtown(B-2 and B-3 zoning districts),timed parking areas,including the four public surface lots are nwiapd by the Pwting Commission. 4. Courtesy tickets will be issued to any overtime violator; o has not been issued a citation or a warning within 12 months. 5. Vehicles that do not move after receiving a courtesy ticket are eligible for an overtime citation if not removed within two hours of the issuahoo-,,of the courtesy ticket. 6.
