The Commission of the City of Bozeman met in regular session in the Commission Room, Ci~ Hall
Building, Wednesday~ July 3l. 1967 at 1.00 o'clook P. M. Present were Mayor Swanson~ Commissioner
Erwin, Commissioner Lowe~ City Manager Henderson~ Administrative Assistant Sales~ City Attorney
Lovelace and the Clerk. The following proceedings were had.

Minutes of the last regular session were read and it was moved by Commissioner Lowe, seconded by
Commissioner Erwin, that the minutes be approved as read and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those
voting No~ none.

Water System Improvement - Bids for Pick-up Truck
This was the time and place set for opening bids on a pick-up truck for use of the Supervising
Engineer on the Water Improvement Projec~. Affidavit of publication of Notice to Bidders was presented.
It was moved by Commissioner Lowe. seconded by Commissioner Erwin, that the bids be opened and read~
and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Erwin and Commissioner Lowe, those voting No, none.

Request of Band Re; Playing for Jaycee Rodeo Parade
Ed Sedivy, Band Director, appeared before the Commission and presented the following requests

from the City Band.
(1) That the Band be allowed to play in the Jaycee Roundup Parade on August 10, 1957 in
lieu of their regularly scheduled band concert of August l3. 1967.
(2) That permission be granted for the MOntana State College Summer Invitational Band to
playa ooncert at Bogert Grover on August l3, 1957.
It was moved by Commissioner Lowe~ seconded by Commissioner Erwin, that the requests be granted~
and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Erwin and Commissioner Lowe; those voting No, none.
Public Hearing ~ S. I. D. No. 394 - 4th Avenue Garfield to Grant
This was the time and place set for hearing protests to the creation of Speoial Improvement
DilStrict No. 394, paving on }i'ourth Avenue from Garfield Street to Grant Street. Affidavit of publioa-
tion of notice and Clerk's Certificate of mailing were presented. No protests have been filed and no
one was present to protest.
It was moved by Commissioner Erwin, seconded by Commissioner Lowe~ that the City Attorney prepare

Publio Hearing .. S. I. D. No. 395 - Grant from Willson to Sixth
No. 395, paving on Grant Street from Willson to Sixth. Affidevit of publication of notice and Crerk's
mailing certificate that all owners have been notified were presented. Written protest representing
1.63% of property in the district was presented.
It was moved by Commissioner Lowe~ seconded by Commissioner Erwin~ that the protests be overruled
as insufficient and the City Attorney prepare the resolution to create the distriot, and the motion
carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin
and Commissioner Lowe; those voting No, none.

Public Hearing - S. I. D. No. 396 - Arthur from Willson to Grand
This was the time and pla ce set for hearing protests to the creation of Special Improvement District
No. 396, paving of Arthur Street between Willson and Grand Avenues. Affidavit of publication of notioe
and Clerk's mailing certificate that all owners of propert.1 have been notified were presented. Written
protest representing 41.7% of the property in the district was presented.
It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the protests be sustained
and that further proceedings in establishment of this district cease, and the motion oarried by the
following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner
Lowe; those voting No~ none.
Public Hearing - S. I. D. No. 397 -Willson from Villard to Short
This was the time and place set for hearing protest to the creation of Special Improvement Distriot
No. 397, paving on North Willson Avenue between Villard and Short Streets. Affidavit of publication of
notice and Clerk's mailing certificate that all property owners have been notified were presented. No
protests have been filed and no one was present to protest.
It was moved by Commissioner Lowe. seconded by Commissioner Erwin~ that the City Attorney prepare
the resolution to create the district, and the motion carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Public Hearing.. Budget for Year Ending June 30, 1958
This was the time and place set for public hearing on the proposed budget for the fiscal year end-
ing June 30, 1968. Affidavit of publication of the notice of hearing was presented. Joe Gary, Attorney
representing men of the Police andF'ire Departments~ appeared before the Commission to inquire as to
provisions in the budget tor pay for Police and Firemen. Mr. Gary made no protests. no protests were
tiled, and no one was present to protest, and the budget was ordered published as provided by law.
Ordinance No. 798 - Salary Ordinance
Ordinance No. 798 setting the monthly salaries and bonds of the heads of departments and employees
of the City Commission tor the fiscal year ending June 30, 1958 was presented, entitled;
AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, FIXING TEE MONTHLY SALARY AND OFFICIAL BOND OF THE
CITY MANAGER, THE HEADS OF DEPARTMENTS, AND THE EMPLOYEES OF THE CITY COMMISSION AS REQUIRED BY
LAW.
It was moved by Commissioner Erwin~ seconded by Commissioner L~we, that the ordinance be passed and
adopted and the motion carried by the following Aye and No vote; those voting Aye being Mayor Swanson,
Commissioner Erwin and Commissioner Lowe; those voting No. none.
Bonds of Henderson, Moore & Morrison
'I'he following surety bonds for city officials were presented:

Resignation of Mrs. W. W. Spain.. Board of Adjustment
Mrs. W. W. Spain has requested that her resignation be aocepted as a member of the Board of
Adjustment.
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the resignation be accepted
and a letter of thanks be sent Mrs. Spain for her services on the Board, and the motion carried by the
following Aye and No vote: those voting Aye being Mayor Swanson~ Commissioner Erwin and Commissioner
Lowe; those voting No, none.

Misc. W & C 1957 - Bond & Contract
The bond and contract of Mecklenburg & Gower, approved as to form by the City Attorney, for the
construction of Misc. W & C 1957 were presented.
It was moved by Commissioner Erwin~ seconded by Commissioner Lowe, that the bond and contract be
approved and accepted, and the Mayor and Clerk of Commission be authorized to sign the contract for the

City of Bozeman, and the motion carried by the following Aye and No vote: those voting Aye being
Mayor Swanson~ Commissioner Erwin and Commissioner Lowe; those voting No, none.
Water System Improvement.. Work Order for Joint Seal at Reservoir
Letter was read from Morrison-Maierle, Inc. recommending a work order be issued to change the joint
seal from a plastic to a rubber dumb-bell stop at the joints in the new reservoir. Change would require
an additional expense of $640.60.
It was moved by Commissioner Erwin~ seconded by Commissioner Lowe, that the work order be issued
and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Erwin and Commissioner Lowe; those voting No~ none.
Contract.. Pacific Hide & FUr to Selvage Metal in City Dump
Proposal has been made by Pacific Hide & Fur to remove scrap metal at the City Dump on a year to
year basis at the rate of $10.00 per year to the City.
It was moved by Commissioner Erw1n~ seconded by Commissioner Lowe, that the City Attorney be
instructed to prepare a contract for consideration, and the motion carried by the following Aye and No
vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting
No, none.

Platting ~ Bridger Road Sub-division No.1, 2, 3 & 4
Plats of four sub-divisions were presented of propert:.y along Bridger Road owned by David Vogel,
ap~roximately one mile northeast of the city limits, and designated as Bridger Road Sub-division Nos.
1, 2~ 3 and 4.
It was moved by Commissioner Lowe~ seconded by Commissioner Erwin~ that the Director of Public
Service be authorized to approve the plats. and the motion carried by the following Afe and No votel
those voting Aye being Mayor Swanson~ Commissioner Erwin and Commissioner Lowe; those voting No. none.
Easement to MOntana Power Co. to Construct Valve Box on Sewage Plant Ground
Request has been received from the Montana Power Co. ror an easement for a valve box on their 10"
gas transmission line. the valve box to be located on the west side of the sewage plant grounds.
It was moved by Commissioner Lowe~ seconded by Commissioner Erwin~ that the request be granted
provided that the Montana Power Co. agrees to place the box underground should it become necessar,y in
future expansion of sewage ,disposal racilities, and the motion carried by the following Aye and No
vote; those voting Aye being Mayor Swanson~ Commissioner Erwin and Commissioner Lowe; those voting
No, none.
Resolution No. 864 - Intention to Create S. I. D. No. 399

The City Attorney as instruoted has prepared the resolution of intention to oreate Special
Improvement Distriot No. 399~ paving on NOrth Eighth Avenue between Main and Mendenhall Streets.
Resolution No. 854 was presented, entitled:
A RESOLUTION OF THE CITY COMMISSION OF' THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION
OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL
IMPHOVEMENT DISTRICT NO. 399 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND
INSTALLING A PAVEMlmT PROJECT ON THAT PORTION OF NORTH EIGHTH AVENUE LYING BETWEEN WEST
MAIN STREET AND WEST Ml~mENHALL STREET, SAID PROJreT 'ill INCLUDE THE CONSTRUCTION AND
INSTALLATION OF' COMBINATION CURBS AND GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION
COURSE, BITUMINOUS SURFACE COURSE, AND OTHm WORK INCIDEN1AL THERETO.
It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the resolution be passed
and adopted and August 21, 1957 be set as the date for hearing protests, and the motion carried by
