The Commission of the City of Bozeman met in regular session in the Commission Room~ City Hall
Building, Wednesday, August 7, 1957 at l:OO o'clock F. M. Present were Mayor Swanson, Commissioner
Erwin~ Commissioner Lowe, City Manager Henderson~ Administrative Assistant Sales, City Attorney
Lovelace and the Clerk. The following proceedings were had:

Minutes of the last regular session of July 3l, 1957 and of the Special meeting held on August 2,
1957 were read and it was moved by Commissioner Lowe, seconded by Commissioner Erwin~ that the minutes be
apFroved as read and the motion was carried by the following Aye and No vote, those voting Aye being
Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Claims for the Month

The Manager stated that he has audited these claims and finds them to be true and lawful claims against

the City of Bozeman. He recommends that warrants be drawn for their payment. After eX9lIlina tion of the
claims in detail and checking against the Claim Register, it was moved by Commissioner Erwin, seconded
by Commissioner Lowe~ that the claims be approved and warrants drawn for their payment and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin
and Commissioner Lowe; those voting No~ none.
Resignation of Don Bennett from Airport Board
Letter was read from Don Bennett requesting that his resignation as a member of Gallatin Field Board
be accepted.
It was moved by Commissioner Lowe~ seconded qy Commissioner Erwin, that the resignation be accepted

Water Improvement Project - Bids for Pick-up Truck
Bids opened at the Commission meeting of July 31, 1957 on a pick-up truck for use by the Supervising
Engineer on the Water Improvement Project have been studied during the past week.
It was moved by Commissioner Lowe~ seconded by Commissioner Erwin~ that the bid of Owenhouse
Hardware Company for a S-lOO International in the amount of $1,549.00, being the low bid, be accepted
and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Erwin and Commissioner Lowe; those voting No, none.

Ordinance No. 801 -- Drunken Driving
Ordinance No. 801, driving within the municipality under the influence of liquor or drugs~
was presented~ entitled:

Lawe; those voting No, none.
Resolution No. 856 - Creating S. I. D. 394
The City Attorney as instructed has prepared the resolution creating Special Improvement District
No. 394, paving on Fourth Avenue from Garfield to Grant. Resolution No. 866 was presented, entitled:
A RESOLUTION OF' THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT
DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMEN'1' DISTRICT NUMBER 394 OF THE CITY OF BOZEMAN FOR
THE PURPOSE OF CONSTRUCTING .AND INSTALLING A PAVEMENT PROJECT ON SOUTH FOURTH AVENUEF'ROM

Resolution No. 856 .. Creating S. I. D. 395
The City Attorney as instructed has prepared the resolution creating Special Improvement District
No. 396, paving on Grant Street between Willson and Sixth Avenues. Resolution No. 856 was presented,
entitled:
A RESOLUTION OF THE CITY COMMISSION OF' THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT
DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 396 OF THE CITY OF BOZEMAN FOR
THE PURFOSE OF' CONSTRUCTING AND INSTALLlllG A PAVEMENT PROJECT ON WEST GRANT STREET FROM
SOUTH WILLSON AVENUE TO SOUTH SIXTH AVENUE IN SAID CITY.

The City Attorney as instructed has prepared the resolution creating Special Improvement District
No. 397 ~ paving on North Willson Avenue between Villard and Short Streets. Resolution No. 867 was
presented, entitled:

DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 397 Ot' THE CITY OF BOZEMAN FOR
THE PURPOSE OF CONSTRUCTING AND INSTAUING A PAVEMENT PROJECT ON NORTH WILLSON AVENUE FROM

Resolution No. 859 - Tax Levy for 1957
The resolution setting the tax levy for the year 1957 at 41.5 mills was presented, entitled:

FDR ALL PURFOSES, GENERAL AND SPECIAL, TO BE LEVIED AND ASSESSED ON TAXABLE PROFERTY IN THE

License -- Jaycee Carnival
Application was presented from the Bozeman Junior Chamber of Commerce for a carnival license for
five days at $100.00 per day beginning August 7th, 1957.
It was moved by Commissioner Erwin, seconded by Commissioner Lowe~ that the application be approved
and the license issued and the motion carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Agreement -- Salvaging Metal at City Dump -- Pacific Hide & Fur

The City Attorney as instructed has prepared the agreement between the City of Bozeman and Pacific
Hide and Fur Co. allowing them to salvage metal at the city dump.
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the Mayor and the Clerk of
the Commission be authorized to sign the agreement for the City of Bozeman and the motion carried by
the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner
Lowe; those voting No, none.
Water Irrll;rovement Project - Right-of-way Easements
The Commission was informed that several owners of property along the route of the new water supply
line have refused to grant easements unless they are allowed service connections to the line.

It was moved by Commissioner Lowe~ seconded by Commissioner Erwin, that the owners of property
who have not signed right-of-way easements be notified that, unless the easements are signed, the City
has no reoourse except to appeal to the courts, and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Swanson~ Commissioner Erwin and Commissioner Lowe; those voting No,
none.
Resignation of Commissioner Lowe
Letter was read from Commissioner Lowe informing the Commission of his intention to relocate in
another part of the country and, since he will be gone for the next several weeks with a good possi-
bility of his absence becoming permanent. Commissioner Lowe requests that his resignation from the City
Commission be accepted so that the office will not be indefinitely unattended.
It was moved by Mayor Swanson, seconded by Commissioner Erwin, that the resignation be aocepted
wi th regrets, and the motion carried by the following Aye and No vote: those voting Aye being Mayor
Swanson and Commissioner Erwin; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Erwin, seconded by Mayor Swanson~ that the meeting adjourn and the motion carried by
the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those
