HomeMy WebLinkAbout1957-08-14 Bozeman, Montana August 14, 1957 The Commission of the Ci~ of Bozeman met in regular session in the Commission Room~ City Hall Building, Wednesday~ August 14, 1957 at 1.00 o'clock P. M. Present were Mayor Swanson, Commissioner Erwin~ Administrative Assistant Sales~ City Attorney Lovelace and the Clerk. The following proceed- ings were had: 1 Minutes of the last regular session were read and it was moved by Commissioner Erwin, seconded by Mayor Swanson, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Water Improvement Project - Tire Specification on Truok Specifications for'bid on pick-up truck for use ~ the Project Engineer on the Water Improvement Project called for heavy duty tires. The International Pick-up accepted by the Commission at their meeting August 7~ 1957 is equipped with 4-ply tires. Jake Jensen of Owenhouse Hardware appeared before the Commission to explain that although the tire is 4-ply its construction qualifies it as a heavy duty tire. The Commission agreed to accept the tire as qualifying under the specifications for bid as written. Fire Protection Agreement with Montana State College Letter was read from Martin Whalen~ M. S. C. Physical Plant Engineer~ asking that previous request for written agreement for fire protection on M. S. C. Campus be withdrawn. Traffic - Restricted Parking on Garfield Street Letter was read from R. R. Renne~ President of Montana State College~ requesting parking be prohibited on the south side of Garfield Street between Fifth and Sixth Avenues in an effort to ease 1 traffic congestion in this block. It was moved by Commissioner Erwin. seconded by Mayor Swanson, that the request be granted and the City Manager be authorized to include the south side of Garfield Street between Fifth and Sixth Avenues in Schedule VII~ Ordinance No. 768, where parking,is prohibited, and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Public Hearing S. I. D. No. 398 This was the time and place set for hearing protests to creating Special Improvement District No. 398, paving west of Eighth Avenue between Main and Koch Streets. Written protest of Maude Hogan has been filed and she was present at the Commission meeting. No other protests have been filed and no one else was present to protest. It was moved by Commissioner Erwin~ seconded by Mayor Swanson, tilat the protests be overruled as insufficient and the City Attorney be instructed to prepare the resolution creating the district~ and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Final Passage Appropriation Ordinance No. 799 1 Ordinance No. 799, the Appropriation Ordinance for the Fisoal Year ending June 30, 1958, having been provisionally adopted on July 24~ 1957 and having be~n given a public hearing on July 31, 1957 after due and proper notice, and it now being past the second Monday in August which is the time set by Montana statute when such ordinance can be finally passed and adopted, it was presented for final consideration. There having been no protests, reoommendations, or suggestions filed regarding the ordinanoe, it was moved by Commissioner Erwin~ seconded by Mayor Swanson~ that Ordinance No. 799, entitled: .AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED NECESSARY .AND IN ACCORDANCE WITH BUDGETARY REQUIREMENTS FOR MAINTENANCE ETC., OF 1'HE MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEAR ENDING JUNE 30th~ 1958. :Jll :l12 be finally passed and adopted~ and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Reports The following reports for the month of July, 1957 were presented: Sanitary Inspector Gas & Plumbing Inspector Electrical Inspector Building Inspector It was moved by Mayor Swanson, seconded by Commissioner Erwin, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Water Improvement Project -- Right-of-way Easements The following right-of-way easements for the water improvement project were presented for execu- tiom 15th Ave. (Extended) (Ralph & Dorothy Kenck and WID. & Anna Sutter (Vivian Canfield Transmission Line, from Hyalite Canyon Melva G. Morse Robert & Mardella A. Jordan Walter & Merretta Kraft Earl C. & Melva Mae Kraft Marguerite Kirk Emery L. & Helen Mae Clark Murray A. & Effie Nash Martha L. Hawksworth & Bernice Lamb Charles R. & Doris M. Soha H. G. & Louise M. Klemme Roland R. & Mary W. Renne It was moved by Commissioner Erwin, seoonded by Mayor Swanson, that the easements be apFroved and the Mayor and the Clerk of Commission be authorized to sign the Easements for the City of Bozeman~ and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Water Improvement Project -- Change Order on Transmission Line It is recommended by Project Engineer La Plante, City Engineer Liquin, and Right-of~way Agent Cutting that the new 24-inch supply line from the south be brought in along Black Avenue extended to the intersection of Black and College rather than on Garfield Street extended as stated in the specifica- tions, it being their advice that such relocation should net oonsiderable savings in both construction and right-of-way costs. Letter was read from Morrison-Maierle~ Ino. stating the relocation would have little or no effeot on the hydraulics of the water system. It was moved by Mayor Swanson, seconded by Commissioner Erwin, that a Change Order be issued to bring the transmission line into the City on Black Avenue extended instead of on Garfield Street extended as stated in the specifications, and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Water Improvement Project -.. Condemnation Proceeding Authorized Right-of-way Agent Cutting informed the Commission that six parcels of land are still not signed for right-of-way easements for the new water supply line and that owners of these parcels have been notified that the City would have to begin condemnation proceedings on property where easements are as yet unsigned. It was moved by Mayor SW8nson~ seconded by Commissioner Erwin, that the City Attorney be instructed to proceed with condemnation on these unsigned properties, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Water Improvement Project -- Application for Special Use Permit Application for Special Use Permit from the U. S. Forest Service to use their access road and a borrow pit on their land near the site of the dam to be built on Hyalite Creek was presented. It was moved by Commissioner Erwin~ seconded by Mayor Swanson, that the Mayor be authorized to 1 1 1 sign the application for the City of Bozeman, and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson end Commissioner Erwin; those voting No, none.
