M.. Present were Mayor Swanson. Commissioner Erwin. City Manager Henderson, Administrative Assistant Sales, City Attorney Lovelace and the Clerk. The following proceedings were had; Minutes of the last regular session were read and it was moved by Commissioner Erwin, seconded by Mayor Swanson, that the minutes be approved as read and the motion was oarried by the following Aye and No vote; those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Public Hearing -- S. I. D. No. 399 This was the time and p1aoe set for hearing protests to the creation of Special Improvement District No. 399, paving on North Eighth Avenue between Main and Mendenhall Street.. Protests have been filed by owners of aplroximate1y 58 percent of the property in the proposed distriot. It was moved by Commissioner Erwin, seconded by Mayor Swanson, that the protests be sustained and further proceedings to create the district cease, and the motion carried by the following Aye and No vote; those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Resolution No. 860 -- Creating S. I. D. No. 398 The Oi ty Attorney as instructed has prepared the resolution creating Special Improvement District No. 398, paving west of Eighth Avenue between Koch and Main Streets. Resolution No. 860 was presented, entitled; A RESOLUTION OF THE CITY COMMISSION OF' THE CITY OF' BOZEMAN CRE:ATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 398 OF' THE CITY OF' BOZEMAN FOR THE PURPOSE OF CONSTRUC TING AND INSTALLING A PAVEMENT PROJECT ON WEST CURT ISS STREET FROM SOUTH EIGHTH TO SOUTH TWELFTH AVENUE, ON WEST OLIVE STREET FROM SOUTH EIGHTH AVENUE TO SOUTH TENTH AVENUE, ON SOUTH NINTH AVENUE AND SOUTH TENTH AVENUE FROM WEST MAIN STREET TO WEST KOCH STREET, AND ON SOUTH ELEVENTH AVENUE AND SOUTH TWELFTH AVENUE FROM WEST CURTISS STREET TO WEST KOCH STREET, IN SAID CITY. It was moved by Commissioner Erwin, seconded by Mayor Swanson, that the resolution be passed and adopted~ and the motion carried by the following Aye and No vote; those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Ordinance No. 802 -- City-County Planning Board The City Attorney as instructed has prepared the ordinance establishing the City-County Planning Board. Ordinance No. 802 was presented~ entitledl AN ORDINANCE PROVIDING FOR THE CREATION IN CONJUNCTION WITH THE COUNTY OF' GALLATIN, MONTANA, OF A JOINT CITY-COUNTY PLANNING BOARD PURSUANT TO .AND UNDER THE PROVISIONS OF SECTIONS 11-3801 to 11-3858, INCLUSIVE, OF THE REVISED CODES OF MONTANA~ 1947, THE SAME BEING CHAPTER 38 OF THE SAID REVISED CODES OF' MONTANA, 1947, IN ORDER TO PROMOTE THE ORDERLY DEVELOPMENT OF THE CITY AND COUNTY .AND ITS ENVIRONS; TO IMPROVE THE PRESliET HEALTH, SAFETY~ CONVENIENCE AND WELFARE OF ITS CIT IZENS AND TO PLAN FOR THE FUTURE DEVELOPMENT OF THIS COMMUNITY TO THE END THAT THE HIGH- WAY SYSTEMS BE CAREFULLY PLANNED, THAT NEW COMMUNITY CENTERS GROW ONLY WITH AD~UATE HIGHWAY, UTILITY ~ HEALTH, EDUCATION, AND RECREATIONAL FACILITIES; THAT THE NEEDS OF AGRICULTURE, INDUSTRY AND BUSINESS BE RECOGNIZED IN FUTURE GROWTH, THAT RESIDEN'fIAL AREAS PROVIDE HEALTHY SURROUNDINGS FOR FAMILY LIFE; THAT THE GROWTH OF TEE COMMUNITY BE COMMENSURATE WITH AND PROMOTIVE OF' THE EFFICIENT AND ECONOMICAL USE OF PUBLIC FUNDS; TO DO ALL AND EVERYTHING THAT IS NECESSARY AND REQUIRED UNDER SECTIONS 11-3801 to 11-3858, INCLUSIVE, OF THE REVISED CODES OF OONTANA, 1947 ~ THE SAME BEING CHAPTER 38 OF THE SAID REVISED CODES OF MONTANA, 1947; AND REPEALING ORDINANCE NO. 780 OF' THE CITY OF BOZEMAN AND ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. It was moved by Mayor Swanson, seconded by Commissioner Erwin, that the ordinance be passed and adopted, and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No~ none. Water Improvement Project - Easement Discussed wi th Don Langohr, Jr. Don Langohr. Jr., representing Langohr property through which the new water transmission line will pass, apfeared before the Commission to discuss right-of-way easement. Mr. Langohr stated the relocation of the transmission line from Garfield Street Extended to Black Avenue Extended is more suitable across their property and damages should be considerably lessened, but that Langohrs will not sign easement for this or any location on their property until previous agreement with the City regarding water connections to the property has been settled. 1 1 . 1 Eleotrioal Contractors Bond -- V. H. Hodis :~l3 , Electrical Contractors Bond of Vinoent H. Hodis. approved by the City Attorney as to form, was presented. It was moved by Commissioner Erwin, seconded by Mayor Swanson, that the bond be approved and accepted, and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No~ none. Reports The f~llowing reports for the month of July~ 1957 were presented: Police Judge Cashier Cemetery Board It was moved by Mayor Swanson~ seconded by Commissioner Erwin, that the reports be aocepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No~ none. Funds for Street Improvement Planning -- Amendment to Application Proposed letter from Mayor Swanson to the Housing and Home Finance Agency was presented referring to the City's application of April 2, 1957, for preliminary planning funds for street improvements. The original letter requested advance for preliminary planning for three districts. Sinoe all work in two of these districts has been set up by establishment of Special Improvement Distriots~ advance is necessary for only the third distriot. The letter therefore requests that the original applioation be amended to apply only to Distriot No. 3 and the amount of advance for preliminary planning be reduced from $9,000.00 to $3,720.00. Letter further requests that completion date for this planning be extended to July l~ 1958. It was moved qy Commissioner Erwin, seoonded by M~or Swanson~ that the letter amendments to the applioation be approved and the Mayor be authorized to sign the application and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No~ none. Petition to Close MacAdow Street Petition of Mrs. Lillie Warwood to olose MacAdow Avenue from Babcock to Main Street was presented. In order to give it proper study and consideration~ the petition was tabled until the next regular meeting of the Commission. Primary Nominating Election Dispensed With The Manager stated the following candidates for City Commissioner have filed nominating petitions: H. C. Norwood Arnold M. Swanson City Attorney Lovelace stated that Section 11-3215 R. C. M. 1947, makes no provision for writing in names at the Primary Election and further that no names shall be placed upon the general ballot except those candidates nominated at a primary election. The City Attorney explained that two oandidates are to be nominated~ and only two persons have filed nominating petitions with the required signatures~ and only the names of the two candidates who have filed may be printed or appear on the offioial ballot at the general election, and that therefore the primary election would serve no useful or practical purpose, and a considerable sum of money can be saved by not holding a primary election. After consideration by the Commission, it was moved by Commdssioner Erwin, seconded by Mayor Swanson, that the notices published and posted of a Primary Nominating Election to be held August 27th, 1957 be and the same are hereby cancelled and voided; that the above named oandidates be deolared candidates and nominees for the offioe of Commissioner to be voted on at the General Eleotion November 5th, 1957; that the Clerk of the Commission be direoted to issue certificates of nomination to the said candidates and that he be further direoted to have the names of the aforesaid oandidates placed on the ballot at the General Election to be held November 5th, 1957~ and the motion was carried by the following Aye and No vote: those voting Aye being M~or Swanson and Commissioner Erwin; those voting No, none. 1 1 :11 () Water Improvement Project -- Claim Morrison-Maierle~ Inc. Claim No. 9024 of Morrison..Maierle, Ino., in the amount of $l6,623.38, for engineering services for the Water Improvement Project was presented. It was moved by Commissioner Erwin, seconded by Mayor Swanson~ that the claim be aPI-roved and a warrant issued for its payment, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Termination of Lease for Hogan Parking Lot -- Black & Mendenhall Letter was read from R. Earl Dawes~ Agent for the Hogan property at Black and Mendenhall~ request- ing that the lease for the City's parking lot at this location be terminated. There being no objection~ the lease shall terminate as of September l~ 1957. Water Improvement Project Mayor & Clerk to Sign Bonds in Chicago It is recommended by the purchasers of the Water Improvement Bonds that the Mayor and Clerk of Commission go to Chicago to sign the bonds, the trip to be made at the expense of the bond company. It was moved by Commissioner Erwin, seconded by Mayor Swanson, that the Mayor and Clerk of Commission be authorized to go to Chioago to sign the Water System Improvement Bonds, and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No~ none.
