The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building;, Wednesday~ September 4~ 1957 at 1:00 o'clock P. M. Present were Commissioner Erwin~
Commissioner Berg, City Manager Henderson, Administrative Assistant Sales, and City Attorney Lovelace.
The following proceedings were had:
Due to the absence of Mayor Swanson and Clerk of Commission L. G. Shadoan, it was moved by
Commissioner Berg, seconded by Commissioner Erwin, that Commissioner Erwin be and is hereby appointed
Acting Mayor during the absence of Mayor Swanson, and Administrative Assistant Sales be and is hereby
appointed as Acting Clerk of the City Commission during the absence of Clerk of the City Commission
Shadoan~ and the motion carried by the following Aye and No vote: those voting Aye being Acting
Mayor Erwin and Commissioner Berg; those voting No, none.
Minutes of the last regular session were read and it was moved by Commissioner Berg, seconded by
Acting Mayor Erwin. that the minutes be approved as read an d the motion wa.s carried by the following
Aye and No vote: those voting Aye beint: Acting Mayor Erwin and Commissioner Berg; those voting No, none.
Appointments to City-County Planning Board
The following appointments to the City-County Planning Board were announced:
Appointments by City Commission - Charles Liquin, term to expire September 4, 1961
B. C. Cheever, term to expire SeI:-tember 4. 1960
Appointments by Ma.yor Swanson - - Frank Messmer, term to e)pire September 4, 1959
Carroll V. Henderson,
term to exp i re September 4, 1958
It was moved by Acting Mayor Erwin, seconded by Commissioner Berg. that the appointments be
approved and the motion carried by the followine; Aye and No vote:
those voting Aye being Acting Mayor
Erwin and Commissioner Berg; those votine; No, none.
Communication - Police Protective Association
Letter was read from the Police Protective Association for the City of Bozeman objecting and
protesting the salaries paid each individual officer of the Association for the fiscal year commenc-
-tng July 1. 1957 ~ such protest being filed on the basis that present salaries are not being paid pur-
suant to Section 1l-1832, Revised Codes of Montana~ 1947, as amended.

The Manager stated that he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman. He recommends that warrants be drawn for their payment. After examination
of the claims in detail and checking against the Claim Register, it was moved by Acting Mayor Erwin~
seconded by Commissioner Berg. that the claims be approved and warrants dra,wn for thei r payment and the
motion was carried by the followinE Aye and No vote: those voting Aye being Acting Mayor Erwin Bnd

Request to Block Main Street - Eagles
Letter from W. W. Lessley was read requesting permiss ion to use a section of Main Street for
drill team exhibitions by the Montana State Aerie for Eagles during their State Convention in Bozeman,
July 9th through 12th, 1958.
It was moved by Acting Mayor Erwin~ seconded by Commissioner Berg, that the Eagles be notified tha.t,
beca,use Main Street is a part of U. S. Highway #lO~ it is general policy not to close it for such
purposes but Rouse Avenue in either the block north or the block south of Main Street can be blocked
off for their use, and further, the Eagles should check with this office sometime near the date of the
convention, should there be change in policy that might benefit their organization, and the motion
carried by the following Aye and No vote: those voting Aye being Acting Mayor Erwin and Commissioner
Berg; those voting No, none.
Agreement - S. R. DeBoer & Co., City of Bozeman, and Montana State Pla.nning Board
Agreement was presented between S. R. DeBoer and Company, the City of Bozeman, and the State
Planning Board of the State of Montana setting terms of contract for engaging; S. R. DeBoer and Co.
to develop and implement a master plan for the City of Bozeman, such undertaking to be partially

financed under Section 701 of the Housing Act of 1954 (83rd Congress, 2nd Session). Agreement was
approved as to form by the City Attorney.
It was moved by Commissioner Berg, seconded by Acting Mayor Erwin, that the Mayor and Clerk of
Commission be authorized to sign the agreement for the City of Bozeman and the motion carried by the
following Aye and No vote: those voting Aye being Acting Mayor Erwin and Commissioner Berg; those
voting No, none.
Resolution No. 861 -- Water Line Right-of-way Condemnation
The City Attorney has prepared a resolution authorizing h:im to procure necessary rights-or-way
for transmission line in the Water System Improvement Project by condemnation proceedings. Resolution
No. 861 was presented, entitled:
A RESOL1JTION OF' THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AUTHORIZING THE TAKING
OF PRIVATE PROPERTY FOR THE PURPOSE OF CONSTR1JCTING A WATF.R FIPELINE TO CON DUCT WATER FROM
HYALITE RESERVOIR TO THE CITY OF BOZEMAN FOR THE USE OF THE INHABITANTS OF' SAID CI'IY OF
BOZEMAN, MONTANA, DECLARING THE NECESSITY OF SUCH TAKING, AND DIRECTING, AUTHORIZING AND
EMPOWERING THE CITY ATTORNEY OF THE CITY OF BOZEMAN, MONTANA, TO PROCURE THE NECESSARY RIGHTS-
OF-WAY FOR SAID WATER PIPELINE BY CONDEMNATION PROCEEDINGS.
It was moved by Acting Mayor Erwin, seconded by Commissioner Berg, that the resolution be passed
and adopted and the motion carried by the following Aye and No vote: those voting Aye being Acting

Adjournment
There being no further business to come before the Commission at this time, it was moved by
Acting Mayor Erwin, seconded by Commissioner Berg, that the meeting adjourn and the motion was carried
by the following Aye and No vote: those voting Aye being Acting Mayor Erwin and Cormnissioner Berg;;
those voting No~ none.
