The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, Ootober 2, 1957 at l:OO o'clock P. M. Present were Mayor Swanson, Commissioner
Erwin, Commissioner Berg, City Manager Henderson, Administrative Assistant Sales, City Attorney Lovelace,
City Engineer Liquin and the Clerk. The following prooeedings were hadl
Minutes of the regular session of September 25th, having been adjourned for lack of a quorum, the
minutes of the adjourned regular session of September 27th, and the minutes of the speoial session of
September 30, 1967 were read and it was moved by Commissioner Erwin, seconded by Commissioner Berg,
that the minutes be approved as read and the motion was carried by the following Aye and No votel
those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none.
Peti tion to Va.cate MacAdow Street
Petition requesting that MacAdow Avenue be vacated between Main and Babcock Streets was presented
along with petition of owners of property in Marwyn Addition stating they have no objections to the
street being vacated. These petitions were previously presented and considered but action was delayed
until all members of the Commission could be present.
It was moved by Commissioner Erwin, seconded by Commissioner Berg, that the City Attorney be
instructed to prepare a resolution of intention to vaoate said street, and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Erwin and Commissioner Bergl
those voting No, being Mayor Swanson.

Resolution No. 866 -- Weed Assessment 1957
Resolution No. 866, levying assessment for cutting weeds, in the amount of $190.96 was presented,
entitled:
A RESOLUTION OF THE; COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESS-
MENT OF TAXES UFON CERTAIN POOPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLAT IN, STATE OF
MONTANA, TO DEFRAY mE COST OF EXTERMINATION AND REMOVAL OF NOXIOUS WEEDS FOR THE YEAR 1957
PURSUANT TO THE PIDVISIONS nF nRDINANCE NO. 428 ENTITLEDl ".AN ORDINANCE DEFINING AND PROVID-
ING FOR THE PUNISHMENT AND ABATEMENT OF' CERTAIN NUISANCES."
It was moved by Commissioner Erwin, seoonded by Commissioner Berg, that the resolution be pro-
visionally adopted, and October 9th, 1967 be set as the date for the hearing of protests, and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Erwin and Commissioner Berg; those voting No, none.
Resolution No. 862 -- Parking Assessment - Final Adoption
This was the time and f~ce set for hearing protests to final adoption of the resolution levying
assessment for parking maintenance for the year 1957. The af'fidavi t of publication of notice was
presented. There was no one present to protest and no protests having been filed, Resolution No. 862
was presented, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESSING A SPECIAL ASSESS-
MENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICTS OF THE CITY OF BOZEMAN,

Resolution No. 863 -- Lighting Assessment - Final Adoption
This was the time and place set for hearing of protests to final adoption of resolution levying
the assessment for maintenance in the several ornamental lighting districts for the year 1957. The
affidavit of publication of the notice was presented. 'I'here was no one present to protest and, no
protests having been filed, Resolution No. 863 was presented, entitledl

It was moved by Commissioner Erwin, seconded by Commissioner Berg, that the resolution be finally
passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none.
Resolution No. 864 -- Sprinkling ABsessment - Final Adoption
This was the time and place set for hearing protests to the final adoption of resolution levying
assessment for street sprinkling for the year 1957. The affidavit of publication of the notice was
presented. There was no one present to protest and, no protests having been filed, Resolution No. 864
was presented, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESS-

It was moved by Commissioner Berg, seconded by Commissioner Erwin, that the resolution be finally
passed and adopted and the motion was carried by the following Aye and No vote: those v oting Aye
being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none.
Proposed Plat of Deaconess Hospital Property
Proposed replatting of the Western Union Addition, approximately 80 acres owned by the Deaconess
Hospital, was presented. The plat was referred to the Bozeman City-County Planning Board with the
recommendation that DeBoer & Co. be consulted before any action is taken.
Investment of Water System Improvement Funds
The Director of F'inance reported that, as of October 3, 1957, there was $100,000.00 in the Water
System Improvement Fund available for re-investment. It was moved by Commissioner Berg, seconded by
Commissioner Erwin, that the Director of Finance be authorized to purchase U. S. Treasury Bills in
the approximate amount of $100,000.00 to mature in ninety days, and the motion was carried by the
following Aye and No votel those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner
Berg; those voting No, none.

The Manager stated he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman and recommends that warrants be drawn for their payment. After examination
of the claims in detail and checking against the claim register, it was moved by Corrunissioner Erwin,

seconded by Commissioner Berg, that the claims be approved and warrants be issued for their payment,
and the motion was carried by the following Aye and No votel those voting Aye being Mayor Swanson,
Commissioner Erwin and Commissioner Berg; those voting No, none.
Bids S. I. D. No. 392
Carl Christopherson of Harold Hoskins & Associates appeared before the Commission to present bid
tabulation and his firm's recommendation on bids received on Special Improvement District No. 392,
storm drainage in the west part of the City. They recommend that the bid of Utility Builders, Inc.,
Great Falls, Montana in the amount of $97,923.99 be accepted, this being the low qualified bid
received.
It was moved by Commissioner Berg, seconded by Commissioner Erwin, that the bid of Utility
Builders, Inc., Great Falls, Montana be accepted and the Clerk of the Commission be authorized to return
the certified checks, posted as bid seourity, to all bidders except the three lowest. and the motion
was carried by the following Aye and No votel those voting Aye being Mayor Swanson, Commissioner
Erwin and Commissioner Berg; those voting No, none.
Bids for S. I. D. Nos. 386, 386, 389, 390, 391, 393, 394, 396, 397, 398
Bids received on September 30, 1957 on S}ecial Improvement District Nos. 386, 386, 389, 390, 391,
393, 394, 396, 397 and 398, all of which are paving districts, were discussed. Low bids on S. I. D.
Nos. 389 and 390 were received from Nilson-Smith Construotion Co., Great Falls, Montana; however,
these were conditional bids. The City Manager was instructed to contact this firm to see if they
would accept contracts for construction of these two districts only for the amounts bid. Since
nothing further can be done on awarding contracts for the paving districts until reply is reed ved
from Nilson-Smith Construction Co., the Mayor announced that contracts would not be aV'll. rded on this
day.

It was moved by Commissioner Erwin, seoonded by Conwissioner Berg, that this meeting be adjourned
until 2:00 o'clock P. M. on Thursday, Ootober 3, 1957 and the motion carried by the following Aye and
No votel those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting
No, none.
