M. Present were Mayor Swanson, Commissioner Erwin, Commissioner Berg, City Manager Henderson, Administrative Assistant Sales, CIt,y Attorn~ Lovelace and the Clerk. The following proceedings were had: Minutes of the regular session of October 2, 1967 and of the adjourned regular session of Ootober 3, 1957 were read and it was moved by Commissioner Erwin, seoonded by Commissioner Berg, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Resolution No. 867 -- Garbage Assessment -- 1967 Resolution No. 867, levying assessment for garbage removal in the emount of $39,193.74 for the year 1957, was presented, entitled: A RESOLUTION OF' THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL RF.AL PROPERTY IN THE CITY' OF BOZEaWI, COUliTY 0)/' GALLATIN, STATE OF MONTANA, SERVICED AND FROM MilCH GARBAGE WAS COLLECTED AND RDOVEDDUllING THE ~UR 1957, TO DEF'RAY THE COST AND EXPENSE OF COllECTING AND DISPOSING 07 GARBAGE UNDER THEFROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN. It was moved by CommIssioner Berg, seconded by Commissioner Erwin, that the resolution be pro- visionally passed and Ootober 16th, 1967 be set as the date for hearing protests, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwi n and Commissioner Berg; those voting No, none. ResolutIon No. 868 -- W & C 1967 Assessment Resolution No. 868, levying the assessment for oonstruotion and/or repair of Misoellaneous Walks and Curbs for 1967 in the amount of $2,771.84, was presented, entitledl A RESOLUTION OF THE COMMISSION OF THE CITY OF' BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZ~, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF' CONSTRUCTING AND INSTAU..ING AND/OR REPAIRING MISCELLANmUS SIDEWALKS AND CURBS DURING THE YBAR 1957. It was moved by Commissioner Erwin, seconded by Commissioner Berg, that the resolution be provision- ally passed and October l6th, 1957 be set as the date for hearing protests and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Resolution No. 866 - Weed Assessment - Final Passage This was the time and place set for hearing protests to the resolution levying assessment for cutting weeds for 1967. Affidavit of publication of the Notice was presented. No one was present to protest and no protests have been filed. Resolution No. 866 was presented, entitled. A RESOLUTION OF THE COMMISSION OF THE CITY OF' BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESS- MENT OF' TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF EXTERMINATION AND REMOVAL OF NOXIOUS WEEDS FOR THE YlUR 1967 PURSUANT TO THE PROVISIONS OP' ORDINANCE NO. 428 ENTITLEDl "AN ORDINANCE DEFINING AND PROVID- ING FOR THE PUNISHMENT AND ABATEMENT OF CERTAIN NUISANCES." It was moved by Commissioner Berg, seconded by Commissioner Erwin, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No votel those voting Aye. being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Resolution No. 869 -- Intention to Vacate Portion of McAdow Street The City Attorney as instructed has prepared a resolution of intention to vacate MoAdow Avenue between Main Street and Babcock Street. Resolution No. 869 was presented, entitledl A RESOLUTION OF THE COMMISSION OF' THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTEN- TION OF SAID COMMISSION TO VACATE A FORTION OF MoADOW AVENUE IN SAlD C-.ITY OF BOZEMAN. It was moved by Commissioner Erwin, seconded by Commissioner Berg, that the resolution be passed and adopted, and October 16th, 1957 be set as the date for public hearing, and the motion was carried by the following Aye and No votel those votIng Aye being Commissioner Erwin and Commissioner Berg; .I I I I I I I : ~ ~]7 those voting No, being Mayor Swanson. Inquiry on City Bus System Tom Adamson, Dale Moore, R. R. Hardgrove and Leslie Egger appeared before the Commission represent- ing the Lions Club. Their Club is concerned over the fact that many students must walk over a mile to reach the Bozeman Senior High School at its new location and this group has been appointed by the Lions to make inquiry into possible means of providing bus service for these students. Although i~ appears the problem i8 essentially one on which the High School Board should take action, the possibility of a City operated bus system was disoussed along with a City subsidized private system or a private bus system operating under City franchise. The need for bus service between the downtown area and Montana State College was also discussed. The group was informed that the Montana Railroad Commission should be contacted as they are the State appointed body who would regulate such a system. In the meantime the City Manager agrees to make inquiry to Missoula on the operation of bus service there, as conditions in Missoula are quite similar to those in Bozeman. Request for Street Light on Lamme between 5th & 7th A request for a street light on Lamme Street between Fifth Avenue and Seventh Avenue was reported. It was moved by Commissioner Berg, seconded by Commissioner Erwin~ that the City Manager be authorized to have the Montana Power Company install a street light at this location, and the motion was carried by the following Aye and No votel those voting Aye being MSfor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Offer to Sell Standard Construction Co. Yards An offer from Standard Construction Co. to sell to the City all of Blook 30 and all of Blook 29 except Lots 11 and 12 in the Imes Addition was presented and reviewed. The offer sets a total price of $36,000.00 on the property with the condition that the City may rent the property at $240.00 per month with all rental, exclusive of taxes, insurance and 4% interest, to apply on the purchase price with 20 years to pay and pre-payment without penalty authorized. It was moved by Commissioner Erwin, seconded by Commissioner Berg, that the proposal be accepted and the City Attorney be instruoted to prepare a contract to purchase to be presented to the attorneys of the Standard Construction Company for review, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Reports The following reports for the month of September, 1967 were presentedl Building Inspector Electrical Inspector Plumbing & Gas Inspector Sanitary Inspector Water Collector and the report of the Director of Finance for August, 1967. It was moved by Commissioner Berg, seconded by Commissioner Erwin, that the reports be acoepted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Purchase of Copper Pipe for Water Department The City Manager re!,orts an offer to sell to the City for use by the Water Department 2700 feet of copper service connection pipe. 3&i cents per foot, total cost approximately $986.60, and recom- mends this pipe be purchased. It was moved by Commissioner Erwin, seconded by Commissioner Berg, that the City Manager be authorized to make this purchase, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Swenson, Commissioner Erwin and Commissioner Berg; those voting No, none. Irrigation Water Rate for Users Outside City Communioation was read from the Public Servioe Commission regarding water servioe rate charged :rl8 Sidney H. Davis at 701 E. Oak Street which is just north of the oi ty 11mi ts. It has been the polioy of the City to charge all water used through service connections outside the city at the straight residential rate with no consideration for irrigation usage. The Public Servioe Commission directs that water users outside the city limits be charged the same rates as users wi thin the City, thus giving Mr. Davis the benefit of irrigation rates. It was moved by Commissioner Berg, seoonded by Commissioner Erwin, that the City Manager be instructed to adjust the water charge on irrigation for users outside the city according to the communica- tion from the Public Service Commission dated Ootober 3, 1957, the effective date to be fixed by said Commission, and the motion was carried by the following Aye and No votel those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those v oting No, none. Bond &: Contract - S. I. D. No. 392 The bond and contract of the Utility Builders, Inc., for the construction of Special Improvement District No. 392 was presented. The bond and contract were E!?proved as to form by the City Attorney. It was moved by Commissioner Erwin, seconded by Commissioner Berg, that the Mayor and the Clerk of the Commission be authorized to sign the contract for the City of Bozeman, and the motion was carried by the following Aye and No votel those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Certified Checks for Bids of S. I. D. No. 392 to be Returned Since the bond and contract have been signed for construction of Speoial Improvement District No. 392, it is no longer necessary to retain the certified checks submitted by bidders on this district. It was moved by Commissioner Berg, seconded by Commissioner Erwin, that the certified checks sub- mitted by all bidders for Special Improvement District No. 392 be returned, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Red Heart Tag Day Request from the Women of the Moose to have Saturda.y, October 19th, 1967 as Red Heart Tag Day and to sell tags on the streets was reported. It was moved by Commissioner Berg, seconded by Commissioner Erwin, that the request be granted, and the motion was carried by the following Aye and No votel those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Investment of Permanent Care F'unds Direotor of Finance L. G. Shadoan advises tha,t approximately $16,000.00 of Cemetery Permanent Care fUnds be invested in the purohase of registered warrants of the City of Bozeman. It was moved by Commissioner Erwin, seoonded by Commissioner Berg, that the Direotor of Finance be authorized to purchase approximately $16,000.00 of registered warrants of the City of Bozeman, as investment for Cemetery Permanent Care funds, and the motion was carried by the following Aye and No vote: those voting Aye being M~or Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Work Schedule for Fire Department Assistant Fire Chief WIn. Penttila appeared before the Commission to discuss proposed work schedul e for the Fire Department which would require 48 hours of duty per week from firemen on a 24 hours on, 48 off, 24 on, 72 off basis. Since this would be an increase in work hours of 8-hours per week per man, Penttila requests the, firemen be given additional sick leave benefits. Mayor Swanson directed the City Attorney to review law oontrolling this proposal and report to the Commission at the next regular meeting when the proposal will be further considered.
