HomeMy WebLinkAbout1957-10-16 Bozeman, Montana Ootober 16, 1957 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, October 16, 1957 at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner Erwin, City Manager Henderson, Administrative Assistant Sales and the Clerk. The follawin& proceed- ings were had: I Minutes of the last regular session of October 9, 1957 were read and it was moved by Commissioner Erwin, seconded by Mayor Swanson, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Resolution No. 867 - Final Passage - Garbage Assessment This was the time and place set for hearing protests to final adoption of resolution levying assessments for garbage collection for the year 1957. The affidavit of publication of Notice was presented. No protests have been filed and, there being no one present to protest, Resolution No. 867 was presented, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYIliIG AND ASSESSING A SPECIAL ASSESSMENT O}f' TAXES UPON ALL REAL PROPERTY IN mE CITY OF BOZEMAN, COUNTY OF' GALLATIN, STATE OF' MONTANA, SERVICED AND FROM WEICH GARBAGE WAS COLLECTED AND REMOVED DURING THE YEAR 1957, TO DEFRAY THE COST AND EXPENSE OF' COLLECTING AND DISPOSING OF GARBAGE UNDER THE PIDVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN. It was moved by Mayor Swanson, seconded by Commissioner Erwin, that the resolution be finally passed and adopted and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those votf.ng No, none. Resolution No. 868 - Final Passage - W & C 1957 Assessment I This was the time and place set for hearing protests to adoption of the resolution levying assessments for construction of W & C 1957. The affidavit of publication of the Notice was presented. There being no protests filed and no one present to protest, Resolution No. 868 was presented, entitledl A RESOLUTION OF' THE COMMISSION OF THE CITY OF' BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF' T.AXr.;S UPON CERTAIN FROPRRTIES IN THE CITY Or' BOZEMAN, COUNTY OF GALLATIN, STJ..TE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING .AND INSTALLING AND/OR REPAIRING MISCELLANEOUS SIDEWALKS JlND CURBS DURING THE YEAR 1957. It was moved by Commissioner Erwin, seconded by Mayor Swanson, that the resolution be finally passed and adopted and the motion carried by the following 4e and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Resolution No. 869 - Public Hearing - Vacating Portion of McAdow Avenue This was the time and place set for hearing protests to Resolution No. 869 vacating McAdow Avenue between Main and Babcock Streets. Affidavit of publication and acknowledgement of service of the Notice were presented. Letter was read from H. D. Kors1und, President of the Bozeman City-County Planning Board, requesting that action be deferred until suoh time as DeBoer and Co. submit a master plan. It was agreed that the request be approved and that a record of full procedure regarding the proposed street vacation be referred to the Planning Board for their consideration. Bonds and Contracts - McLaughlin Incorporated - S. I. D.'s 389, 390, 391 and 395 I The bonds and contracts of McLaughlin InoorIorated for the cons truction of Special Improvement Districts No. 389, 390, 391 and 395 were presented. Bonds and contracts were approved as to form by the City Attorney. It was moved by Mayor Swanson, seconded by Commissioner Erwin, that the bonds and contracts be accepted and approved-and the Mayor and Clerk of the Commission be authorized to sign the contracts for the City of Bozeman, and the certified checks of unsuocessful bidders be returned, and the motion was carried by the following Aye and No votel ihose voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. .... : r J!J :llO Bonds and Contrects - MoLaughlin Incorporsted - S. I. D.'s 385 and 386 '!he bonds and contracts of McLaughlin Incorporated for the construction of Special Improvement Districts No. 385 and 386 were presented. The bonds and oontracts were approved as to form by the Ci ty Attorney. It was moved by Commissioner Erwin, seconded by Mayor Swanson, that the bonds and contraots be accepted end a.pproved and the Mayor and Clerk of the Commission be authorized to sign for the City of Bozeman and certified checks of unsuooessful bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin; those voting No, none. Bonds and Contract - Kiely Construction Co. - S. I. D. No. 397 The bond and contract of Kiely Construction Co. for the construction of Special Improvement Distriot No. 397 were presented. The bond and contract were approved as to form by the City Attorney. It was moved by Mayor Swanson, seconded by Commissi oner Erwin, the. t the bond and oontract be aocepted and approved and the Mayor and Clerk of the Commission be authorized to sign for the City of Bozeman and certified checks of unsuccessful bidders be returned, and the motion was carried by the following Aye and No votel those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Employment of Additional Policeman Info:nnation has been received from the Treasurer of Gallatin County that he has received for the City of Bozeman the sum of $1,56l.46 as its share of tax collected during the first quarter of 1967-68 on liquor sales. Since this tax money is to be used for law enforcement, the City Manager informed the Commission of his intention to immediately hire one additional policeman to partially rep1aoe the man-days of police duty lost by the five-day work week for policemen required by Montana statute to be put into effect on July 1, 1957. Reports The following reports for the month of September, 1957 were presented: Cashier Cemetery Board It was moved by Commissioner Erwin, seoonded by Mayor Swanson, that the reports be acoepted and ordered filed and the motion was carried by the following Aye and No votel those voting Aye being - Mayor Swanson and Commissioner Erwin; those voting No, none. Bids for Truck for Cemetery Need for a new vehiole to replace the "Jeep" now in use in the cemetery was discussed. It was recommended that a vehicle of not less than 1/2-ton capacity with four-wheel drive and pick-up type dump body be purchased for this use. It was moved by Mayor Swanson, seconded by Commissioner Erwin, that the Clerk of the Commission be authorized to advertise for bids on such a vehicle, bids to be opened November 6, 1957, and the motion was oarried by the following Aye a.nd No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, non.. Wa.ter Improvement Projeot - Communication from Statewide Letter was read from Max L. Burdick, President of Statewide Plumbing & Heating Co., Inc., stat- ing his company reached the end of available right-of-way at 2130 P. M. October 7, 1957, and, due to hold-up of right-of-way, it was necessary to shut down one crew and its equipment. The letter indicated that they will expect to be reimbursed by the City for all oosts incurred due to the shut down. Mayor Swanson instructed that receipt of the letter be acknowledged but that no commdtment be made as to acceptance of any liability. I I I " I I I Water Improvement Project - Right-of-way Easements atl Right-of-way easements for transmission line in the Water Improvement Project were I-resented signed by the following propertw owners I Clarence A. & Luoil1e L. Bruce Shirley Roy Johnson Harvey & Graoe Svensrud It was moved by Commissioner Erwin, seconded by Mayor Swanson, that the easements be accepted and approved and the Mayor and Clerk of the Commission be authorized to sign the easements for the Ci~ of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Claims for Easements Claims Nos. 9563 to 9565 inclusive for right-of-ways were presented as follows: Clarence A. & Lucille L. Bruce - Shirley Hoy Johnson Harvey & Grace Svensrud $219.00 327.68 764.78 It was moved by Mayor Swanson, seoonded by Commissioner Erwin, that the claims be approved and warrants drawn for their payment and the moti on was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Application to Break Curb - 23 North Tracy Request has been received from Kilbride & Sullivan to break curb and construct a driveway approach into their property at 23 North Tracy Avenue to be used as a private parking lot. It was moved by Mayor Swanson, seoonded by Commissioner Erwin, that the request be approved, conditioned on the strict understanding that cars shall not be allowed to back out of the parking lot onto Tracy Avenue, and the moti on was oarried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Work Schedule for Fire Department Fire Chief McCrosson and Assistant Chief Penttila appeared before the Commission to further discuss a duty schedule for firemen, proposed by members of the Fire Department, where firemen would be on duty tor a 24-hour continuous shift, then off for 48-hours, then on duty for 24-hours, then off for 72-hours, the Fire Chief to be on duty for 8-hour shifts for three successive days, then be on a 24-hour shift for one day and then off for 72-hours. It was pointed out that this schedule would pe rmi t having three men on duty on all shifts and four men on du ty on some shifts. It 'WOuld involve extra duty time for firemen over and above the 8-hour shift, 5-day week now provided ~ statute. In return for this extra duty the firemen propose that they be given additional vacation time and additional allowable accrued sick-leave. The Chief and Assistant Chief propose that this schedule be set up on a six (6) week trial period. It was moved by Commissioner Erwin, seconded by Mayor Swanson, that this 6-weeks trial schedule be authorized but that it not include additional siok-leave benefits during the trial period end that the proposal be confirmed in writing, signed by all the individual members of the Fire Department, and the motion was carried by the following Aye and No votel those vOting Aye being Mayor Swanson and Commissioner Erwin; those voting No, none. Adjournment It was moved by Commissioner Erwin, seconded by Mayor Swanson, that the meeting adjourn until Thursday, Ootober 17, 1957 at 2100 o'clock P.
