The Commission of the City of Bozeman met in regular session in the Commission Room, City HaU
Building, Wednesday, Ootober 23, 1957 at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner
Erwin, Commissioner Berg, City Manager Henderson, Administrative Assistant Sales, City Attorney
Lovelaoe and the Cle rk. The following proceedings were hadl
Minutes of the last regular session of October 16th and of the adjourned regular session of
Ootober 17, 1957 were read and it was moved by Commissioner Erwin, seconded by Commissioner Berg, that
the minutes be approved as read and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none.
Bond & Contract - S. I. D. No. 393, 394, 398 - Kiely Construction Co.
The bond and oontract of Kiely Construction Co. for the construotion of Special Improvement
Districts No. 393, 394 and 398 were presented. The bond and contract were approved as to form by the
City Attorney.
It was moved by Commissioner Berg, seoonded by Commissioner Erwin, that the bond and contract be
aocepted and approved and the Mayor and Clerk of the Commission be authorized to sign for the City of
Bozeman, and the motion was carried by the following Aye and No vote I those voting Aye being Mayor
Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none.
Report - Police Judge
Report of the Polioe Judge for the month of September, 1957 was presented. It was moved by
Commissioner Erwin, seoonded by Commissioner Berg, that the report be approved and accepted, subject to
accounting for the shortage as shown on the report, and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commiss ioner Berg; those
voting No, none.
Water Improvement Projeot - Right-of-way Easement Across Ford Brown Property
Report was made on the status of the case of the City of Bozeman versus Ford Brown to secure
right-of-way across his property for installation of the main supply line in the Waterworks Improvement
Projeot. The City Attorney had, on October 18, 1957, petitioned the court to recess the case for an
indefinite time because it was indioated that a compromise settlement of the matter could be worked
out with Mr. Brown. The matter is still at a standstill awaiting oomp1etion of survey and specific
recommendations from Morrlson-Maierle, Inc. on a re-1ooation of this line across Mr. Brown I s property
as has been suggested by his attorney, Mr. Seth Bohart.
Work Schedule for Fire Department
Written confirmation of the work schedule of the Fire Department disoussed at the meeting of
Ootober 16th, 1957, signed by members of the Department, was read.
Ordinance No. 803 - Amending Traffic Ordinance
The City Attorney, as instructed, has prepared the ordinance amending the traffic ordinance.
Ordinance No. 803 was presented, entitled:
AN ORDIN~CE AMENDING SECTION 21 OF ARTICLE II, SECTIONS 31 .AND 36 OF ARTICLE IV, SECTION
38 (b) OF ARTICLE V, SECTION 51 OF ARTICLE VIII, SECTION 82 OF ARTICLE XI, SECTION 92 (b)
OF ARTICLE XII, SECTIONS 144 AND 149 OF ARTICLE XVII, AND SECTIONS 162, 163, 164, 166, 167,
168 AND 170 OF ARTICLE XXI OF ORDINANCE NUMBER 768 OF THE CITY OF BOZEMAN, THE SHORT TITLE
OF WHICH IS THE TRAFFIC ORDINANCE, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN
CONFLICT THEREWITH.
It was moved by Commissioner Berg, seconded by Commissioner Erwin, that the Ordinance be passed
and adopted and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none.
Transfer of Beer & Liquor Lioense - Park Bar to Frank B. Tucker
Letter was read fromF'rank B. Tucker inquiring whether or not an application would

be approved to transfer a beer and liquor license from the Park Bar, formerly operated at 113 E.
Main St., to Frank B. Tucker for operation at 12 South Bozeman Avenue.
It was moved by Commissioner Erwin, seconded by Commissioner Berg, that, if application for
transfer is approved by the State Liquor Control Board, and when application for transfer is sub-
mitted in proper form, the request be granted, and the motion was carried by the following Aye
and No votel those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg;
those voting No, none.
Sales to Vote Shares of City at Meeting of Middle Creek Water Users Association
Notice has been received of the annual meeting of the Middle Creek Water Users Association to be
held in the Community Room of the Court House at 2:00 P. M., October 23rd, 1957.
It was moved by Commissioner Erwin, seconded by Commissioner Berg, that Walter R. Sales be
authorized to vote the shares of the City of Bozeman at the annual meeting of the Middle Creek Water
Users Association to be held on October 23, 1957, and the motion was oarried by the following Aye and
No votel those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those vot-
ing No, none.
Librarian to Great Falls
Written request from Margaret Hileman, Librarian, to attend a meeting of the Montana State
Library Association, November 2, 1957, in Great Falls, Montana, without cost to the City, was read.
It was moved by Commissioner Erwin, seconded by Commissioner Berg, that Miss Hileman be authorized
to attend this meeting as a member of the State Library Extension Committee, and not as a representa-
tive of the City of Bozeman, and the motion was carried by the following Aye and No votel those
Toting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none.
Garbage -- Hauling from Large Apartment Houses
Request has been received from the Bozeman Investment Company to have garbage collection from
the Blackmore Apartments removed from Ci ty collection so that they can hire a private concern to make
this collection on a six day per week basis. The matter was tabled pending further investigation.

There being no further business to come before the Commission at this time, it was moved by
Commissioner E~in, seconded by Commissioner Berg, that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner E~in,
Commissioner Berg; those voting No, none.
