M. Present were Commissioner Erwin and the Clerk. There not being a quorum present the meeting was adjourned until Thursday, November 21, 1957 at 1:00 o'clock P. Montana November 21, 1957 The Commission of the City of Bozeman met in adjourned regular session in the Commission Room, City Hall Buildinl;;, Thursday, November 21, at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner Erwin, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The following proceedings were had: Minutes of' the regular session of November 13, 1957 were read and it was moved by Commissioner Erwin, seconded by Commissioner Berg. that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Peti tion for Lighting Distriot on Buttonwood Don Larson appeared before the Commission and presented a petition signed by 37 persons, for themselves or for organizations which they represent, requesting that street lights be installed on Buttonwood Avenue from Main Street to Curtiss and on Curtiss Street from Buttonwood to Cypress Street. Action on the petition was deferred pending further study. Petition for Lighting District in Merwyn Addition A petition requesting that a Special Improvement Lighting District be established in the Merwyn Addition was presented. The petition was signed by owners representing over 60% of the property in the proposed district. It was moved by Commissioner Berg, seconded by Commissioner Erwin, that the City Attorney be instructed to prepare a resolution of intention to create the district, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Sick Leave for Members of Fire Department John McCrosson, Chief, Win. Penttila, Assistant Chief, and Homer Fisher, Lieutenant, of the Fire Department, were present in connection with a written proposal whioh has been presented by Bozen~n Firemen relative to sick leave. The proposal was to grant special sick leave benefits to Firemen as a condition for continuation of the special duty sohedule under whioh they have been working on a trial basis since Ootober l7th,1957. The matter was discussed and action on it deferred pending; further study. Plat of Hospital Property - Southeast part of City C. V. Henderson, representing the Bozeman Deaconess Hospital Board, appeared before the Commission to disouss a proposed plat of part of the land in the southeast seotion of the City owned by that Board. He explained that this plat was being completed in accordance with recommendations of S. R. DeBoer & Company and had been approved by the City-County Planning Board. He requested tents. tive approval. of the City Commission before detailed work on completion of any official plat is continued. Mr. Henderson was informed that, when official approval of the City-County Plan Board is reoeived and if' a properly completed plat is received which is in aocordance with infOnIla tion given at this time, such a plat will be approved. I I I ~)"-h t):)d Retirement of Fire Chief McCrosson A communication from John McCrosson, Fire Chief, was read, stating that it is his intention to retire from aotive duty in the Fire Department as of December 31, 1957, conditioned on his being furnished written statement from the city stating that his sslary and retirement pay would be based on the court decision of the law adopted by the last legislature relative to longevity pay. It was I moved by Commissioner Erwin, seconded br Commissioner Berg, that the resignation be accepted subject to the conditions in the communication and that a letter be prepared for the signature of the Mayor and the Clerk of the Commission so stating, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swan.son, Commissioner Erwin and Commissioner Berg; those voting No, none. Water Improvement Project - Langohr Right-of-way A proposed agreement on right-of-way for installation of the main supply line of the water works project, now under construction for this City, in land owned by Langohrs and adjoining the south city limits, was presented. Also presented was a proposed agreement relative to enlargement by the City of the existing water service to the Langohr property from the water main on the present system extending east from Tracy Avenue on the line of Garfield Street. These agreements were presented by Keister and Bennett, attorney for Langohrs, and were conditioned on acceptance by the City of both of them before either of them would become effective. It was moved by Commissioner Berg, seconded by Commissioner Erwin, that subject to approval of them by the City Attorney, these agreements be accepted and approved and tha t the Mayor and the Clerk of the City Commission be and are hereby authorized to sign them for the City of Bozeman and the I motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Rouse Street Improvement - Moving Telephone Poles A written request was presented from the Mountain States Telephone and Telegraph Company for authority to move poles on North Rouse Avenue. The poles have been required by the Montana Highway Department to be moved outside this center 48 feet of the right-of-way of this street and a map, acoompanying the request, showed the locations to which they were proposed to be moved. It was moved by Commissioner Erwin, seconded br Commissioner Berg, that, subject to the recommendation that, where ever possible and feasible, the poles be moved out to property line instead of to five feet from property line as shown on the map, the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Traffic - Request from Irving PTA A written request from the Irving PTA was read suggesting certain actions to be taken to improve hazardous traffic conditions for children attending this school. The request was taken under advise- ment and referred to the Department of Public Safety for study. I Reports 1he following reports were presented: Cemetery Board for the month of October, 1957 Director of Finance for the month of September, 1957. It was moved by Commissioner Erwin, seconded by Commissioner Berg, that the reports be accepted and ordered filed, and the motion was carried by the followi ng Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Corrunissioner Berg; those voting No, none.
