SUBJECT: Authorize the City Manager to sign the Notice of Award to award the
contract for the 2017 Seal Coat Im provements to Hardrives Construction, Billings, Montana, in
the amount of $178,311.09.

RECOMMENDATION: Authorize the City Manager to sign the Notice of Award to award the
contract for the 2017 Seal Coat Improvements to Hardrives Construction, Billings, Montana, in
the amount of $178,311.09.
BACKGROUND: Bids were opened April 11, for the 2017 Seal Coat Improvements project.
The project consists of seal coat applications (chip seals) on various streets as shown on the
attached map. Four bids were received for the project, with the low bidder being Hardrives
Construction, Billings, Montana, in the amount of $178,311.09. The bid appears to be
competitive with the bid being approximately 11% below the construction estimate
($202,292.20). A copy of the Certified Bid Tabulation is attached.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: Funding for this work has been planned for in the FY18 Street
Maintenance fund. The contract documents specify that work may not begin until after July 1,
2017, contingent upon Street Maintenance fund budget approval for FY18.

PROJECT: City of Bozeman 2017 Seal Coat Improvements
CONTRACT FOR: Seal coat improvements.
You are notified that your Bid dated April 11, 2017, for the above Contract has been considered. You are the
apparent Successful Bidder and have been awarded a Contract for seal coat improvements.
The Contract Price of your Contract is: one hundred seventy eight thousand three hundred eleven and
09/100 Dollars ($178,311.09).
Three copies of the proposed Contract Documents accompany this Notice of Award.
You must comply with the following conditions precedent within fifteen (15) days of the date of this
Notice of Award, that is, by .
1. You must deliver to the OWNER 3 fully executed counterparts of the Agreement including all the
Contract Documents and Drawings.
2. You must deliver with the executed Agreement the Contract Security (Bonds) as specified in the
Instruction to Bidders (page 8), General Conditions (paragraph 5.01) and Supplementary Conditions
(paragraph SC-5.02).
3. List other conditions precedent:
You must deliver with the executed Agreement the Certificates of Insurance as specified in
the General Conditions (paragraph 5.03).
Failure to comply with these conditions within the time specified will entitle OWNER to consider your
Bid abandoned, to annul this Notice of Award, and to declare your Bid Security forfeited.
Within ten (10) days after you comply with these conditions, OWNER will return to you one fully
signed counterpart of the Agreement with the Contract Documents attached.
