The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, Deoember 4, 1957 at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner
Erwin, Commissioner Berg, City Manager Henderson, Administrative Assistant Sales, Ci~ Attorney
Lovelace and the Clerk. The following proceedings were hadl
Minutes of the regular session of November 27, 1957 were read and it was moved by Commissioner
Erwin, seconded by Commissioner Berg, that the minutes be approved as read and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson. Commissioner Erwin and
Commissioner Bergi those voting No, none.
Planning - Conference with State Highway Commission
John Dustrude of S. R. DeBoer & Co. appeared before the Commission to present Volume III of the
Ci ty Flan Preliminary Report. Mr. Dustrude announced the intention of his firm to confer wi th the
State Highway Commission in Helena regarding the location of the inter-state highway and proposed
interchanges. He requests that the City Manager and City Engineer also attend this conference.
It was moved by Commissioner Berg, seconded by Commissioner Erwin, that the City Manager and City
Engineer be authorized to go to Helena to confer wi th officials of the State Highway Commission and
their expenses be paid from the General fund, and the motion carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Bergi those voting No, none.
Petition to Abandon Parking Maintenance District No. 72
Petition signed by owners of 65.8% of the property in Parking Maintenance District No. 72, College
Street from Grand to Seventh Avenue, was presented requesting said district be abandoned.
It was moved by Commissioner Erwin, seconded by Commissioner Berg, that the City Attorney be
ins tructed to f,repa.re the resolution of intention to abandon the district and the motion carried by
the following Aye and No votel those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner
Berg; those voting No, none.

Re-investment of Water Improvement Funds
Director of Finance L. G. Shadoan reports that $75,000.00 is available in the Water System
Improvement Fund for re- investment and recommends the purchase of ninety day U. S. Treasury Bills.
It was moved by COIlunissioner Erwin, seconded by Commissioner Berg, that the Director of Finance
be authorized to invest $75,000.00 of Water System Improvement Funds in U. S. Treasury Bills due in
ninety days, and the motion carried by the following Aye and No vote: those voting Aye being Mayor

Sub-letting, of McLaughlin S. 1. D. Contracts to Kiely Construction Co.
Letter was read from McLaughlin, Inc. proposing to sub-contract to Kiely Construction Co. street
construction of six improvement districts which they have been awarded. The City Manager was instructed
to inform them that, if the proposed agreement to sub-contract or assign these contracts is presented,
and that agreement meets the requirements of the specifications pertaining to assignment, the
Commission will look wi th favor on such an agreement.

The Manager stated he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman and recommends that warrants be drawn for their payment. After examina-
tion of the claims in detail and checking against the Claim Register, it was moved by Cornmissior.er
Berg, seconded by Commissioner Erwin, that the claims be approved and warrants be issued for their
payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none.
Petition Regarding; Drainage Excavation on Eleventh Avenue
Petition signed by property owners in the area near the drainage excavation on Eleventh Avenue
between Curtiss and Babcock Streets was presented. The fetition states the excavation has created a
serious hazard to small children near the area.
The City Manager was instructed to investigate the conditions on Eleventh Avenue and report back
to the Commission on recommended action.
