The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, December l8, 1957 at 1100 o'olock P. M. Present were Mayor Swanson, Commissioner
E~in, Commissioner Berg, City Manager Henderson, Administrative Assistant Sales, City Attorney
Lovelace and the Clerk. The following prooeedings were had:
Minutes of the last regular session of December 11, 1957 were read and it was moved by Commissioner
Berg, seconded by Commissioner Erwin, that the minutes be approved as read and the motion was carried
by the following Aye and No votel those voting Aye being Mayor Swanson, Commissioner Erwin and
Commissioner Berg; those voting No, none.
Fenoing of Ditch on Eleventh Avenue
The City Manager reported that the portion of ditch on Eleventh Avenue whioh had to be enlarged
and increased in depth to accommodate the new storm sewer outfall can be fenced in for approximately
$210.00. This portion of the ditch has been protested as dangerous to children in the area and the
City Attorney stated such a fence would greatly alleviate any liability on the part of the City of
Bozeman.
The City Manager was instructed to have the fence built at the earliest practicable date.
Report - State Examiner, Fire Relief Association
The report of examination of the aocounts of the Bozeman Fire Department Relief Association by
the' state Examiner was presented. It was moved by Commissioner Erwin, seconded by Commissioner Berg,
that the report be accepted and ordered filed and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting
No, none.
City Offices to be Open December 24, 1957
The press reports that the Governor has proclaimed December 24, 1957 as a legal holiday. In view
of the fact that actually only office employees would get the benefit of such a holiday without 10s8 of
pay and that such services as police, fire and garbage collection would have to be continued whether or
not it is a holiday, the City Manager recommends that all operations of the City be continued in the
normal manner on that day.
It was moved by Commissioner Berg, seconded by Commissioner Erwin, that normal operations of the
City of Bozeman be carried on on December 24, 1957, and the motion carried by the following Awe and
No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Berg; those voting
No, none.
Hearing Resolution No. 871 ... Abandoning Maintenance District No. 31

This was the time and place set for hearing protests to the abandoning of Parking Maintenance
District No. 31, Black Avenue from Babcock to College Street. The affidavit of publication of the
Notioe was presented. There was no one present to protest and no protests having been filed,

It was moved by Commissioner Erwin, seoonded by Commissioner Berg, that the resolution be passed

Assigning S. I. D. Contracts Awarded to McLaughlin, Inc. to Kiely Construction Compa~
A proposed agreement assigning special improvement district contracts awarded to McLaughlin, Inc.,
to Kiely Construction Company was presented. The Agreement was referred to the City Engineer and the
City Attorney for study.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
CommissIoner Erwin, seconded by Commissioner Berg, that the meeting adjourn and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner
Berg; those voting No, none.
