M. Present were Mayor Swanson, Commissioner Erwin, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The follow- ing prooeedings were hadl Minutes of the last regular meeting of December 18, 1957 were read and it was moved by Commissioner Erwin, seconded by Commissioner Berg, the. t the minutes be approved a.s read and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Swanson.. Commissioner Erwin and Commissioner Berg; those voting No, none. C. M. 1947, have this day examined the receipts of the Federal Reserve Bank of Minneapolis for the Depository Bonds held by the Director of Finance as security for the deposit of oity funds held by the several banks oT Bozeman and find them to be as above stated, and are hereby acoepted and approved. s/ A. Reports The following reports were presented: Director of Finance for the month of November, 1957 Gas, Plumbing and Electrical Inspector for the month of December, 1967. Officials to Attend Community Development Conference The Manager announced a Community Development Conference to be held in Helena on January 23 and I I I 24, 1957 under sponsorship of the Montana State Planning Board. It was moved by Commissioner Berg, seconded by Commissioner Erwin, that the City Manager, City Engineer and members of the Ci~ Commission be authorized to attend this meeting and their expenses be paid from the General Fund, and the motion was oarried by the following Aye and No votel those voting ~e being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. I Hearing - S. I. D. No. 400 Resolution No. 878 - Creating S. I. D. No. 400 This was the time and place set for hearing protests to the oreation of Special Improvement Lighting District No. 400, special lighting in the Marwyn Addition. The affidavit of publication of the Notice was presented, together with the Clerk's Mailing Certificate that all property owners have been notified. No written protests had been filed and no one was present to protest. Commission Resolution No. 878 was presented entitled: A RESOLUTION OF THE CITY COMMISSION OF' THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 400 FOR THE PURPOSE OF' OPERATING AND MAINTAINING A LIGHTING SYSTEM TO LIGHT CYF'RESS AVENUE FROM ITS INTERSECTION WIlli EAST MAIN STREET TO THE NORTH PROPERTY LINE OF BLOCK D OF MARWYN ADDITION, EAST BABCOCK STREET TO AYLSWORTH AVENUE, AYLSWORTH AVENUE TO EAST CURTISS STREET AND EAST CURTISS STREET TO THE POINT OF ENDING, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY, ALL UNDER THE AUTHORITY OF AND IN CONFORMITY WITH SECTIONS 11-2245 to 11-2257 INCLUSIVE, OF THE REVISED CODES OF MONTANA, 1947, PURSUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NUMBER 875 OF SAID CITY COMMISSION AS PASSED AND ADOPl'ED BY SAID CITY COMMISSION ON THE 4TH DAY OF DECD!BER 1957. It was moved by Commissioner Erwin, seoonded by Commissioner Berg, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Hearing - Abandonment of Parking Maintenance District No. 72 Resolution No. 877 - Abandoning Parking Maintenance District No. 72 I This was the time and place set for public hearing on the abandonment of Parking Maintenanoe District 72, College Street from Grand Avenue to Seventh Avenue. The affidavit of publication of the notice was presented. There was no one present to protest and, no written protests having been filed, Resolution No. 877, abandoning said parking maintenance district was presented, entitledl A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ABANDONING CITY OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 72 AND ABANDONING THE MAINTENANCE OF STREET PARKINGS THEREUNDER, PURSUANT 10 THE STATUTES IN SUCH CASES MADE AND PROVIDED, AND PUR- SUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 876 AS PASSED AND ADOPTED BY SAID CITY COMMISSION ON THE 11TH DAY OF DECEMBER, A. D. 1957. It was moved by Commissioner Berg, seconded by Commissioner Erwin, that the resolution be passed and adopted and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Investment of Funds - Cemetery Permanent Care & Water System Improvement Funds The Director of Finanoe reoommended investment of surplus funds as follows; $30,000.00 of Cemetery Permanent Care Funds in 90-day Treasury Bills, $30,000.00 of Water System Improvement Funds in 90-day Treasury Bills. It was moYed by Commissioner Erwin, seoonded by Commissioner Berg, that the above investments be authorized, and the motion was oarried by the following A:te and No votel those voting Aye being I Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Paving of Single Blocks of Street. The state law provides that a special improvement distriot to pave may be established over the protests of 40% of the proper~ in e distriot on single blocks of unpaved streets that connect at right angles with three or more blocks of paving. Formation of Special Improvement Districts was considered to oover the following streets; Arthur Street from Willson to Grand Avenue Arthur Street from Grand Avenue to Third Avenue Bozeman Avenue from Koch to Story Street Koch Street from Bozeman Avenue to Lindley Place Action in the matter was deferred pending further study. '>fO .)')<.1 :~f70 Wholesale Beer Licenses Not to be Issued After January 1, 1968 The Ci~ Attorney reviewed the state law which permits cities to license beer dealers who sell at retail. He stated that he has met with local beer wholesalers and they have protested the license improved on them by the City of Bozeman. The Ci~ Attorney recoImnended that lioensing of beer wholesalers be discontinued. It was moved by Commiss ioner Erwin, seconded by Commissioner Berg, that issuing of wholesale beer license be dispensed with, and the motion was carried by the following Aye and No vote: those voting ~e being Mayor Swanson, Commissioner Erwin and Commissioner Berg; those voting No, none. Contract for Subletting Special Improvement District Contracts and Kiely Construction Co. The City Attorney reviewed the proposed contraot between McLaughlin, mc./to sublet special improvement district contracts to Kiely Construction Company and the City Attorney recommended certain changes in the proposed contract. The City Attorney was instructed to write to McLaughlin, Inc., asking that the changes and correo- tions as pointed out be made and the oontract be resubmitted.
